This phase of the planning process is a content review of the submitted materials, NOT a technical review. Staff comments made during this phase of the process will not be all- inclusive, as other concerns or issues may arise during the remaining application process. The critical issues of concern addressed include but are not limited to the Site Plan, Traffic Study, Preliminary Drainage Report, Geotechnical Soils Report, and Flood Hazard Development Permit. The Public Works Department will perform a detailed technical review of the project once the submittal application is deemed acceptable and is promoted to the review phase of the planning process. COMMENTS: This project is located on C St. in the northern Greeley area. Parcel number is 080536400099 and address is 1460 C St., Greeley. C St. is a local paved road and requires a 60 -foot right-of-way at full build out. There is presently a 60 -foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. Average Daily Traffic in 2010 was reported as 2,669 on C St. This area is within the Poudre River 100 -year floodplain Special Flood Hazard Area (SFHA), as defined in the Army Corps of Engineers 2003 Poudre River Floodplain Study accepted by Federal Emergency Management Agency (FEMA) as best available data. Portions of lots located in the current effective FEMA 100-yr floodplain may not be buildable. Please contact Weld County Floodplain Administrator, Clay Kimmi for detailed floodplain information. REQUIREMENTS: 1. Show on the Map: a. C St. is designated on the Weld County Road Classification Plan as a local paved roadway, which requires 60 feet of right-of-way at full build out. The applicant shall verify the existing 60 feet of right-of-way and the documents creating the right-of-way and this information shall be noted on the plat. All setbacks shall be measured from the edge of future right-of-way. If the existing right-of-way cannot be verified, it shall be dedicated. This road is maintained by Weld County. b. The applicant shall indicate specifically on the plat the type of right-of-way/easement and indicate whether it is dedicated, private, or deeded. c. Show and label the floodplain and floodway (if applicable) boundaries on the plat. Label the floodplain boundaries with the Floodplain Study information, Army Corps of Engineers 2003 Poudre River Floodplain Study. Should noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II, of the Weld County Code. b. The historical flow patterns and runoff amounts will be maintained on the site. c. This site is located in a State Designated, Municipal Separate Storm Sewer System (MS4) Area which may trigger specific water quality requirements or other drainage improvements if the lot develops further. d. WARNING: LOTS MAY NOT BE BUILDABLE DUE TO FLOODPLAIN OR FLOODWAY DESIGNATION. Please be advised that owners of the property may not be able to obtain building permits to construct structures or store materials outside. All construction or improvements occurring in the floodplain as delineated on Federal Emergency Management Agency FIRM Community Panel Map # 080266-1528E, dated June 10, 2005, shall comply with the Flood Hazard Overlay District requirements of Chapter 23, Article V, Division 3 of the Weld County Code and all applicable FEMA regulations and requirements as described in 44 CFR parts 59, 60, and 65. e. Flood hazard development permits are required for development activities located within the FEMA mapped Poudre River Floodplain. The FEMA definition of development is any man-made change to improved or unimproved real estate, including by not limited to buildings or other structures, mining, dredging, filling, grading, paving, excavation, drilling operations, or storage of equipment and materials. f. FEMA's floodplain boundaries may be updated at any time by FEMA. Prior to the start of any development activities, the owner should contact Weld County to determine if the floodplain boundaries have been modified. Department of Public Health and Environment CASE NO.: COZ13-0003 NAME: Gutierrez Environmental Health Services has reviewed this proposal to rezone 3.98 acres from the (R-1) Low -Density Residential Zone District to the (A) Agricultural Zone District. This rezoning will allow the applicants to apply for a Use by Special Review (USR) permit for a concrete company. Can -Do Concrete is currently operating from the property. The City of Greeley provides water and an individual sewage disposal system provides sewer (SP -0900161). Once an USR application is submitted, this department will require specific items such as; dust abatement plan, waste handling plan and adequacy of septic system for business usage. The Department recommends approval with the following notes which should appear on the change of zone and final plats: 1. Water service shall be obtained from the City of Greeley. 2. This subdivision is in rural Weld County and is not served by a municipal sanitary sewer system. Sewage disposal shall be by septic systems designed in accordance with the regulations of the Colorado Department of Public Health and Environment, Water Quality Control Division and the Weld County Code in effect at the time of construction, repair, replacement, or modification of the system. 3. Language for the preservation and/or protection of the absorption field shall be placed on the plat. The note shall state that activities such as permanent landscaping, structures, dirt mounds or other items are expressly prohibited in the absorption field site. 4. Weld County's "Right to Farm" as provided in Appendix 22-E of the Weld County Code shall be placed on any recorded plat. MEMORANDUM IRk. COLORADO To: Diana Aungst, Planner August 9, 2013 From: Bethany Salzman, Zoning Compliance Officer Subject: COZ13-0003 Referral Upon review of my case files and computer, an active Zoning Violation (ZCV13-00061) was noted. This violation was initiated due to the operation of concrete business (Dba: Can Do Concrete) without first completing the necessary Weld County Zoning Permits. Due to the current zoning of the property, this application process is necessary before completing any actual specific land use permits. This case has not been presented to the Weld County Court Magistrate through the Violation Hearing process. Since this application was submitted prior to an actual court date being scheduled, NO investigation fee is required. Staff has no comment at this stage of the Change of Zone (COZ) application process. Due to records release laws, staff no longer tracks complainant information, but please be aware it is staff's policy to no longer accept staff initiated complaints. This application if approved by the Board of County Commissioners and once a plat is recorded will change the zone district; therefore allowing the applicant the ability to submit the specific land use application necessary to correct this outstanding violation. If this application is denied, all commercial operations and storage of commercial vehicles, materials and/or equipment shall be removed from the property within 30 (thirty) days of denial or the violation will proceed in court accordingly. The application is for a change of zone from RI (residential) to AG (agricultural) for an industrial use- a concrete construction company. The City's Land Use Guidance Map identifies this area as future park land/open space. The industrial use (concrete company) is consistent with other industrial uses in the vicinity. The property does not have any contiguity with city boundaries; therefore, the property would not be eligible for annexation. This site is served by an existing City of Greeley 5/8" water tap, fed by a ()- water main located along the north side of the property. Please he aware that the existing water main has reached capacity and any additional water service requested will require additional infrastructure improvements. ❑ Advisory.
