SUBJECT: USR12-0075, Plains Marketing LP (Tampa Site)
The Weld County Public Works Department reviewed the submitted application for critical items, including but
not limited to Site Plan, Traffic Study, Preliminary Drainage Report, Geotechnical Soils Report, and Flood
Hazard Development Permit. A detailed review of these items was not completed at this step in process.
Comments made during this stage of the review process will not be all inclusive; as revised materials are
submitted other concerns or issues may arise. All issues of concern and critical issues during further review
must be resolved with the Public Works Department.
COMMENTS:
CR 398 is a local gravel road and requires a 60 -foot right-of-way at full build out. There is presently a 60 -foot
right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld
County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
Traffic counts for CR 398 between CR 63 and 1-76: 118 ADT (9-16-2011).
REQUIREMENTS:
Noxious Weeds: Should noxious weeds exist on the property or become established as a result of the
proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Section 15-1-180 of the Weld County Code.
Traffic Study: Weld County Public Works has received a Traffic Study for the Plains AAP Loading Facility site
prepared and stamped by Frederick Lantz. After reviewing the submitted traffic Study I have prepared the
following comments:
A right deceleration lane on CR 398 at the facility entrance is warranted by the proposed traffic volumes to the
facility. The facility is proposing 33 vehicles per hour (vph) during a peak hour turning right into the facility. This
meets the 25 vph trigger fora right deceleration lane.
A left deceleration lane at the intersection CR 398 and Market Street is warranted by the proposed traffic
volumes to the facility. The facility is proposing 33 vehicles per hour (vph) during a peak hour turning left onto
CR 398. This meets the 10 vph trigger for a left deceleration lane. The segment of Market Street that would
require the turn lane is in the jurisdiction of the Town of Keenesburg and CDOT. The applicant will need to
develop an agreement with the town and CDOT to allow for the construction of this safety improvement.
The Colorado Department of Transportation (CDOT) has jurisdiction over all State highways. Please contact
the Greeley office (970-350-2148 or 970-350-2163) to verify if any improvements will be required on 1-76 to
accommodate traffic from the project site.
Other roadways Improvements may be triggered due to heavy truck traffic associated with the facility including
additional turn lanes onto CR 398 and Market Street; the following is a list of the triggers for turn lanes:
a. 50vph turning right onto Market Street during a peak hour.
b. 50 vph turning right out of the facility during a peak hour.
c. 10vph turning left into the facility during a peak hour.

The applicant has approximately 520 trips per day for the facility. CR 398 is a gravel roadway the most recent
traffic count was taken in September 2011. The AADT was 118 vpd with 57% trucks. Due to the increased
traffic volumes proposed at the facility the trigger for the upgrading, widening, and paving of WCR 398 from the
facility entrance to Market Street is warranted. The trigger for the paving improvements is 400 vehicles per day
the facility is proposing 520 vehicles per day meeting the trigger requirement.
The applicant has proposed that 100% of the traffic will be travelling from the southwest, however there may
be vehicles reaching the site from the northeast. Due to the increased traffic volumes at the facility here is a list
of triggers for the improvements for the upgrading, widening, and/or paving of WCR 398 northeast of the facility
entrance:
a. 200 vehicles per day Mag-Chloride
b. 400 vehicles per day Pavement
An annual road inspection will be performed in the spring to establish the condition of CR 398 to determine if
any road damage was caused by the operation of the facility. The applicant will be responsible excavate,
repair, or patch any damage on the roadway to mitigate for heavy truck traffic created by the facility. The type
and method of repair will be determined by the Department Public Works. If road damage is beyond repair, the
applicant will pay their proportional share for the reconstruction to restore the road.
A stop sign will be required to be installed at the facility accesses onto CR 398. The access will have 60' radius
to accommodate the larger trucks entering and exiting the site.
No parking or staging of commercial vehicles on the county road is allowed. Use on -site parking area.
CR 398 is a local gravel road and requires a 60 -foot right-of-way at full build out. There is presently a 60 -foot

The applicant is proposing one access point onto CR 398. A complete access permit application including
access pictures, a construction traffic control plan, and $150 application fee need to be submitted.
Show the approved access on the plat and label it with the approved access permit number (AP#).
Off-street parking spaces including the access drive shall be surfaced with gravel, asphalt, concrete or the
equivalent and shall be graded to prevent drainage problems.
Parking lots shall conform to all standards of the American with Disabilities Act.
A vehicle tracking control pad consisting of the preferred option (double cattle guards) will be required to
prevent tracking of material from your site in the way of mud or debris on to Weld County Roads. This needs to
be placed and shown on the plat drawing across both lanes. A stop sign shall be installed prior to entering on
to CR 398 as a safety item. A 45-60' radius is required on all accesses to public roads for accesses designed.
to accommodate commercial/truck traffic.
Drainage Report:
The applicant provided a "Drainage Report" dated November 26, 2012 and signed and stamped by Noah
Nemmers PE 39820 with Baseline Engineering. Review of that report includes redline notes on the provided
plans, in the report text, and the summary comments below.
1. Add the following notes to the plat:
a. The historical flow patterns and run-off amounts will be maintained on site in such a manner that
it will reasonably preserve the natural character of the area and prevent property damage of the
type generally attributed to run-off rate and velocity increases, diversions, concentration and/or
unplanned ponding of storm run-off.

b. The applicant must take into consideration storm water capture/quantity and provide accordingly
for Best Management Practices.
c. Weld County is not responsible for the maintenance of onsite drainage -related features.
Drainage Report Comments
1. Drainage Report should be stand alone. Please ensure references for equations and variables used in
design are included. Define any hidden equations in appendix spreadsheets.
2. Document and discuss all design results and calculations in narrative of report. Reference appendices
for additional information.
3. All areas of concentrated flow must be returned to sheet flow before leaving the property. Verify
4. Label all drainage facilities including all pipes, spillways, drainage swales, and ditches. Ensure
consistency with labeling between documents, maps, and plans. Verify acres, curve numbers, rainfall
data throughout documents. Ensure consistency between report, calculations and drawings for labels,
variables, results etc...
5. Verify basins are delineated correctly with the number of culvert crossings and size and type. Appears
there may be inconsistencies with what is in the field and also between documents.
6. Verify culverts as delineated in plans and designed in appendix calculations are sized properly to pass
the offsite flows when necessary.
7. It appears the proposed pond is undersized. The pond must detain the 100 -year on -site runoff and
release at the 5 -year historic release rate.
8. Appears a spillway is designed in the appendix; however none is shown on plans. Please include
discussion in report how project is proposed to meet County Code. Is the Railroad being used as pond
embankment? Provide more detail on pond grading and embankment materials used.
9. Appears culverts are outletting into ditches. Label ditches and provide more information on how
concentrated flows are returned to sheet flow.
10. Provide all electronic spreadsheets and models for review.
11. See redline notes on the plans and in the report. Return redlines to Weld County Public Works.
Grading Permit:
If more than 1 acre is to be disturbed, a grading permit will be required prior to the start of construction. The
grading permit application must contain: an erosion and sediment control plan, a grading plan, installation
details of all BMPs to be utilized, typical installation and maintenance notes for all BMPs to be utilized, and a
copy of the approved CDPHE stormwater permit.
Flood Hazard Development Standards:
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA).
Contact the Permitting/Inspection agent for Weld County Public Works, at (970) 304 6496, ext. 3764 for a
Right -of -Way permit for any work that may be required in the right-of-way. A special transport permit will be
any oversized or overweight vehicles that may access the site and may also be obtained through the same
office.
Weld County Public Works is asking applicant to enter into an Improvements Agreement and post collateral for
all on -site and off -site improvements (Haul Routes).

SUBJECT: USR12-0075 PLAINS MARKETING LP

Environmental Health Services has reviewed this proposal for a crude oil rail loading
facility. Crude oil will enter the facility via tanker trucks or pipelines, and will leave the
facility via rail tank cars. There will be up to 60 employees, contractors, truck drivers and
rail personnel accessing the site. There will be up to 20 employees working 12 hour
shifts.
Permanent water and sewage disposal will be required for employees and other
personnel. An engineer designed septic system will be required and the septic permit
will require Weld County Board of Health approval. An individual well is proposed. The
applicant will need to submit documentation from the Colorado Division of Water
Resources that the well is approved for commercial use.
The waste handling plan stipulates that there will be a trash dumpster on site and will
likely be serviced by Waste Management. The applicant is proposing to submit a final
waste handling plan after the Use by Special Review Permit is approved. The final plan
will include a list of types and quantities of chemicals to be stored on site, procedures
for cleanup and disposal of spilled hazardous materials, and a list of chosen waste
handlers and disposal companies.
On site dust will be controlled by having the access drive and circulation areas graveled,
and a water truck will be utilized to suppress dust.
A Spill Prevention Control and Countermeasure plan (SPCC) will be required and the
plan shall be available on site at all times.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit evidence of an Air Pollution Emission Notice
(A.P.E.N.) and Emissions Permit application from the Air Pollution Control
Division (APCD), Colorado Department of Health and Environment. Alternately,
the applicant can provide evidence from the APCD that they are not subject to
these requirements.
2. A signed copy of the Spill Prevention, Control and Countermeasure Plan shall be
provided to Environmental Health Services Division of the Weld County
Department of Public Health & Environment.
3. The applicant shall submit written evidence from the Colorado Division of Water
Resources, demonstrating that the well is appropriately permitted for the
commercial use.
4. In the event the facility's water system serves more 25 persons on a daily basis
the water system shall comply with the Colorado Primary Drinking Water
Regulations (5 CCR 1003-1). Evidence shall be provided to the Weld County
Department of Public Health and Environment that the system complies with the
Regulations.
5. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
conditions that must be met one month prior to construction activities:
1. The applicant shall submit evidence of a Colorado Discharge Permit System or
CDPS permit from the Colorado Department of Public Health and Environment
(CDPH&E), Water Quality Control Division, to cover stormwater discharges from
construction sites (5 CCR-1002-61). Alternatively, the applicant can provide
evidence from CDPH&E that they are not subject to the CDPS requirements.
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to the issuance of the Certificate of Occupancy:

1. An individual sewage disposal system is required for the proposed facility and
shall be installed according to the Weld County Individual Sewage Disposal
Regulations. The septic system is required to be designed by a Colorado
Registered Professional Engineer according to the Weld County Individual
Sewage Disposal Regulations.
2. The applicant shall submit evidence of an Underground Injection Control (UIC)
Class V Injection Well permit from the Environmental Protection Agency (EPA)
for any large -capacity septic system (a septic system with the capacity to serve
20 or more persons per day). Alternately, the applicant can provide evidence
from the EPA that they are not subject to the EPA Class V requirements.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan".
5. The applicant shall comply with all provisions of the Above Ground Storage Tank
Regulations.
6. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan" at all times.
7. This facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in Section 14-9-30 of the Weld County Code or all
applicable State noise statutes and/or regulations.
8. The operation shall comply with all applicable oil and gas operations regulated by
the Colorado Oil and Gas Conservation Commission.

9. In accordance with Colorado Oil and Gas Conservation Commission Rule 604, a
spillage retention berm shall be constructed around the aboveground storage
tanks. The volume retained by the spillage berm should be greater than the
volume of the largest tank inside the berm and sufficient freeboard to contain
precipitation. Alternative protective measures may be allowed provided they
comply with the Colorado Oil and Gas Conservation Commission regulations.
10. The facility shall be constructed and operated to ensure that contamination of soil
and groundwater does not occur.
11.Any petroleum contaminated soils on the facility shall be removed, treated or
disposed of in accordance with all applicable rules and regulations.
12.A Spill Prevention Control and Countermeasure plan shall be kept on site, at all
times.
13. Adequate drinking, hand washing and toilet facilities shall be provided for
employees and patrons of the facility, at all times.
14. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
15. In the event the facility's water system serves more 25 persons on a daily basis
the water system shall comply with the Colorado Primary Drinking Water
Regulations (5 CCR 1003-1).
16. All potentially hazardous chemicals must be stored and handled in a safe manner
in accordance with product labeling and in a manner that minimizes the release
of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's).
17. The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

Weld County Public Works has received a Revised Traffic Study for the Plains AAP Loading Facility site
prepared and stamped by Frederick Lantz. The original traffic study was dated November 21, 2012 the revised
traffic study was dated December 17, 2012. After reviewing the submitted revised Traffic Study, I have
prepared the following comments:

In the November 2012 Traffic Study the applicant proposed 520 trips per day for the facility. In the December
2012 Traffic Study the applicant proposed 220 trips per day. The reduction in trips per day is due to a future
pipeline at the facility, until the pipeline is constructed the reduction in truck traffic will not occur. Even with the
reduction from 400 truck trips per day to 100 truck trips per day, the Passenger Car Equivalents (PCE) with the
truck reduction is still 420 vehicles per day. The most recent traffic count for CR 398 (gravel roadway) was
taken in September 2011. The AADT was 118 vpd with 57% trucks. Due to the increased traffic volumes
proposed at the facility the trigger for the upgrading, widening, and paving of WCR 398 from the facility
entrance to Market Street (Keenesburg) is still warranted even with the proposed reduction of truck traffic. The
trigger for the paving improvements is 400 vehicles per day the facility is proposing 420 vehicles per day
meeting the trigger requirement.

After reviewing the application and documents submitted the Building Department has the following
comments for a transloading of oil and gas commodities.
A building permit will be required for any new construction, alteration, or addition to any buildings or
structures on the property. A building permit application must be completed and two complete sets of
engineered plans including engineered foundation plans bearing the wet stamp of a Colorado registered
architect or engineer must be submitted for review. A geotechnical engineering report performed by a
registered State of Colorado engineer shall be required or a open hole inspection.
Buildings, equipment and structures shall conform to the requirements of the various codes adopted at
the time of permit application. Currently the following has been adopted by Weld County: 2012
International Building Code; 2012 International Mechanical Code; 2012 International Plumbing Code:

A plan review shall be approved and a permit must be issued prior to the start of construction.

The Town of Keenesburg has received a referral request from Weld County Planning for the
proposed Plains AAP Loading Facility. The Facility is located approximately one mile north of the
Town limits. While not within the existing IGA boundary between the County and Keenesburg,
this site is within the Town's Comprehensive Planning Area and the site is designated as
agricultural use on the future land use plan. The Town is currently working on a comprehensive
plan amendment that will be re-evaluating the future land uses along the highway and rail
corridors for commercial and industrial uses.
The Town is very supportive of economic development in both the County and within the Town
limits however after review of the Plains application submittal it is very apparent that impacts to
the Town of Keenesburg were not taken into consideration even after Town Officials contacted
the applicants representatives to request a meeting to discuss the impacts to Keenesburg. Most
of the traffic generated by the use is proposed to go through the center of Town on Market Street
and CR 396. A portion of Market Street is CDOT ROW and per Keenesburg's code is designated
as a major collector. CR 398 is designated as an arterial and is a weight limited roadway within
the Town limits. The proposed traffic route and volume of additional traffic will create impacts to
the Town of Keenesburg.
Because the impacts to Keenesburg have not been addressed we respectfully request that any
approval be conditioned upon the following prior to any development of the site:
1. The applicant enter into a pre -annexation agreement with the Town of Keenesburg;
2. The applicant enter into a road improvements and maintenance agreement with the Town
of Keeneburg for Market Street and that portion of CR 398 within the Town limits,
Keenesburg appreciates the opportunity to review and provide a referral response concerning this
request. We are very willing to work with the applicant and their representatives to insure that the
Impacts to Keenesburg are adequately addressed prior to development of the site. The applicant

Dear Mr. Trimble
I wanted to follow up concerning our most recent telephone conversation in regard to
Keenesburg's request for a road agreement, and in addition, I am requesting that this email
become a part of the Planning Commission packet in regard to your application USE -0075
for the Tampa Loading Facility. When we last met on October 3, 2012, I indicated to you
that we needed to have an agreement in place regarding upgrades and maintenance to our
roadways, as well as a change to our municipal code due to the weight limited roadway you
propose to use for your truck traffic. In addition there are three different traffic numbers
based upon submittals and telephone conversations. Due to the fact that our requests
have gone unanswered it will be our recommendation that the application be denied or
continued until we have an agreement in place. The town staff and I are available and
request again that we meet to work out an agreement prior to the Planning Commission

Ibis letter is in response to the referral sent by Weld County Planning Services dated December 6, 2012.
regarding the proposed crude oil rail loading facility including tracks, office buildings. tanks. and all
related equipment.
The Iollowing findings and or comments would like to be discussed and evaluated further:
• A pressurized_ insulated cistern for tire protection of said facility as it does not appear to have
appropriate tire flow on -site. Size quantity IBD.
• Backup generator for emergency operations of the cistern.
• Secondary egress to the site.
• The lire protection system on the tanks state that they are of a foam nozzle type. blow are they
supplied, loam:water? Depending on this statement, there may be an amendment to the cistern.
• Cross training with Plains staff, initial and ongoing.
• All tire protection systems on site would need to be accompanied with a plan and schedule for
review prior to construction.
Southeast Weld Fire Protection District has adopted the 201)6 International Fire Code (IFC') in its entirety.

Dear Ms. Ogle:
This referral is for a crude oil rail loading facility and does not appear to qualify as a
"subdivision" as defined in Section 30-28-101(10)(a), C.R.S. Therefore, pursuant to the
State Engineer's March 4, 2005 memorandum to county planning directors, this office will
only perform a cursory review of the referral information and provide informal comments.
The comments do not address the adequacy of the water supply plan for this project or the
ability of the water supply plan to satisfy any County regulations or requirements. In
addition, the comments provided herein cannot be used to guarantee a viable water supply
plan or infrastructure, the issuance of a well permit, or physical availability of water.
According to the submitted information, the proposed water supply will be from a
new well. The well permit application for the well will be evaluated pursuant to applicable
statutes and rules at the time it is submitted. It appears that a small capacity commercial
use well permit will be available.
