HomeMy WebLinkAbout780940.tiff RESOLUTION RE: ABATEMENT OF TAXES - TOWN OF DACONO, A MUNICIPAL CORPORATION, AND DACONO AREA FIRE PROTECTION DISTRICT, A SPECIAL DISTRICT, ALL OF DACONO, COLORADO. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, pursuant to Colorado Revised Statutes 39-1-113 , 1973, as amended, a hearing was held on the 27th day of November, 1978 , on petition number 7 of the Town of Dacono, a municipal corporation, and Dacono Area Fire Protection District, a special district, all of Dacono, Colorado for abatement of taxes for the year 1977 in the amount of $731. 23, and WHEREAS , at such hearing, H. H. Hansen, Weld County Assessor, was present, and WHEREAS, the Board of County Commissioners of Weld County, Colorado has considered the petition and the evidence presented, and does find that the assessments in the aforementioned tax abatement matter were improper, and therefore should be abated for the calendar year 1977 , and WHEREAS , said petition was submitted to the Property Tax Administrator of the State of Colorado, R. E. Carper, who has reviewed said petition and approved the action of the Board of County Commissioners of Weld County, Colorado, said approval having been made on the 30th day of November, 1978. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the aforementioned matter for abatement of taxes on property owned by the aforemen- tioned taxpayer, be, and hereby is , allowed to the extent as set forth in this Resolution. 780940 The above and foregoing Resolution was , on motion duly made and seconded, adopted by the following vote on the 27th day of November, A.D. , 1978. For your information, the property was municipal owned until late 1972 when it was conveyed to D&S Steel in connection with lease and option arrangement for construction of a Firehouse. In other words, D & S Steel contracted to build the Firehouse, for the fire district , on ,land donated by -the town, then D & S assigned its lease and option to the Bank and Dacono assigned its contract to the Fire District. To permit D & S to get a construction loan, the Town quit-claimed the property and D & S did so in return, but' its deed was hold by the Bank until building was paid off. This has now been done -- The Fire District has title to the property. Now the taxes, on property which never was private property except':as. a matter of formality, have come back to haunt the town and Fire :District and we seek your help. ,I Please advise.
