TRACTS
TRACT A:
Township 7 North, Range 67 West, 6th P.M.
Section 25: NW
Tract A is the entirety of the captioned lands, excluding Tract B.
We have reviewed a survey of the NW/4 of Section 25, dated September 11, 2012 (drawing date)
prepared by Petroleum Field Services, LLC, ("2012 Survey") which indicated that the entirety of the
NW/4 includes 158.3 acres based on monuments found in the field. However, based on the information
provided, we calculate the acreage at 156.8 acres, and subtracting 1.0 acre (Tract B) from that total, we
are using 155.8 acres for Tract A. Virtually all of Tract A is within Casa Loma Subdivision. In addition
we examined the Final Plat of the Casa Loma Subdivision dated July 15, 1998 and prepared by TST, Inc
and found additional information useful for this opinion ("Final Plat")
Tract B is Weld County Road 23, which was initially a deeded 50' wide strip crossing the far SE/4
of the NWI4 of Section 25, quitclaimed at Book 76, Page 23 (December 23, 1889) and later supplemented
by a Quit Claim Deed dated February 8, 1941, Book 1074, Page 466 that added 10' to its width. It is
bordered on the northeast by Casa Loma Subdivision and on the southwest (within the NW/4 of Section
25), by Tract 83. The 1941 Quit Claim Deed described the lands supplemented to the right of way as
follows:
Township 7 North, Range 67 West, 6'" P.M.
Section 25: A strip of land 10' in width and approximately 750' in length adjoining and lying
immediately E of the right of way for a road described in that Quit Claim Deed
recorded in Book 76 at Page 223, being in the W%: NW'''A, beginning at the S right
of way line of said property and extending Northerly for a distance of
approximately 750' to the farm improvements located on said property.
The 20I2 Survey does not depict Tract B, and so no acreage information is available for Tract B.
However, we calculated an acreage amount on the 750' length and the 60' width of the road, at 1.03 (1.0)
acres, which does not include the portion of Casa Loma Subdivision that appears from the plat of Casa
Loma Subdivision to supplement the width of the roadway. The acreage within the Casa Loma
Subdivision that supplements the roadway which appears to be 30' in width is considered to be acreage
that augments the adjoining lots of the subdivision for purposes ofniincreal ownership. See below.
SUBDIVISIONS OF TRACT A:
We further subdivide Tract A into Tracts 1-84, which includes all of the platted lots within Casa
Loma Subdivision. The following Tracts are within Tract A but not within the Casa Loma Subdivision:
Tract 50 Also referred to as Lot A, located in the W/2 NW/4 of Section 25, having 5.9
acres according to the 2012 Survey.
Tract 82 Located in the far SFJ4 NW/4 corner of Section 25, having 4.9 acres according to
the 2012 Survey.

Section 25: County Rd 23: Tract A — A strip of land 50' wide along the E side of the Larimer & Weld
canal in the W'/2 SW'/a of said Section, and a strip of land 30' wide in said V‘P/2 NW'/a of
said Section, corn at the NW corner of said described land running E along the N line of
said described land across the said Larimer and Weld Canal to the intersection of first
described 50 ft strip;
Also Tract B — Beginning at a point on the E line of Co Rd #116 about 40 rods S of the N
line of the SW% of said Section, thence E at right angles to the road, one rod. Thence
parallel to the Co Rd in a southerly direction 20 rods, thence, in a southwesterly direction
