SPECIAL PUBLIC NOTICE
Due to the increased activities in Colorado waterways , the
Omaha District Engineer once again wishes to notify the gen-
eral public of the necessity of obtaining Department of the
Army permits pursuant to Section 404 of the Clean Water Act .
On 18 October 1972 , Congress enacted the Federal Water Pollu-
tion Control Act (recently re-named Clean Water Act) with the
announced purpose of restoring and maintaining the chemical ,
physical , and biological integrity of the Nation' s waters .
Section 404 of that Act was delegated to the Department of the
Army to regulate the discharge of dredged or fill material
into waters of the United States .
In simple terms , anyone planning any filling type activities
in waterways , natural lakes , or wetlands should contact the
Corps of Engineers for the proper authorization well in
advance of the date the work is expected to begin.
Some typical activities requiring Corps ' permits are :
Artificial islands Levees
Boat Ramps Intake pipes
Breakwaters Outfall pipes
Bulkheads Piers and wharves
Dams and Weirs Riprap
Diversion structures Pipelines and cables
Road fills Groins and jetties
Violators of Section 404 of the Clean Water Act may be subject
to civil and/or criminal court action resulting in possible
fines of $500 to $50 , 000 per day, imprisonment for up to two
years and/or removal of the fill material and restoration of
the area to its original condition.
