WHEREAS, it has been determined by the Board of County Com-
missioners, Weld County, Colorado, that a certain tract of land being
the property of Edward J. Fritzler, La Salle, Colorado, and more particu-
larly described as follows:
All of the Northeast Quarter of Section 31, Township 4 North,
Range 66 West of the 6th P. M. , County of Weld, State of
Colorado, lying West of the Westerly right-of-way line of
the Farmer's Independent Ditch, more particularly described
as follows:
Beginning at the North Quarter corner of said Section thence

amended, and
WHEREAS, the Board of County Commissioners of the County of
Weld, State of Colorado, has studied the request of the petitioner and
studied the recommendations of the Weld County Planning Commission, and
having been fully informed, now desires to exempt this particular division
of land pursuant to its authority under 1973 C. R. S. 30-28-101 (10) (d), as
amended.
NOW, THEREFORE, BE IT RESOLVED, that the hereinabove de-
scribed tract of land owned by Edward J. Fritzler, La Salle, Colorado, be
exempted from the definition of the terms "subdivision" and "subdivided
lands" as provided for in the new Weld County Subdivision Regulations at

RE: Recorded Exemption #207
Dear Commissioners:
The attached application, plat, and related items are in reference to
a request, by Edward J. Fritzler, for a recorded exemption. The par-
cel in question is described as part of the NEa of Section 31 , T4N, R66W
of the 6th P.M. , Weld County, Colorado. Said parcel is located 2 miles
west and 1 mile south of Gilcrest southeast of the junction of County
Roads 251 and 40. The subject property contains 64.24 acres. The re-
quest is to split off a 1 .48 acre parcel with improvements from the re-
mainder of the irrigated parcel which would be left without improvements.
Mr. Fritzler's intent is to transfer ownership of the 1 .48 acre parcel
with improvements to his daughter and son-in-law, Mr. and Mrs. Donald
Mitchell . Mr. Fritzler would retain the 62.76 irrigated parcel and his
stated intent is to continue farming said parcel . His farmstead is located
in Section 30 which is adjacent to this property to the north.
Based upon the information submitted, the Planning Commission staff re-
commends approval for the following reasons:
1 . Mr. Fritzler has complied with the requirements of Section
9-4A of the Weld County Subdivision Regulations and has
obtained approval of Lot Size Variance on May 7, 1975.
2. The proposed split complies with the Weld County Compre-
hensive Plan in-so-far as it promotes agricultural use of
agricultural lands.

3. The proposed split complies with the intent clause,
Section 9-2, of the Weld County Subdivision Regulations
and the intent clause, Section 3.3 (A), of the Weld
County Zoning Resolution, because non-productive agri-
cultural lands will be developed for higher and more
productive uses.
