A Use by Special Review permit for a water hauling facility.
The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process.
COMMENTS:
CR 40 and CR 35 are local gravel roads and require a 60 -foot right-of-way at full build out. There is
presently a 60 -foot right-of-way. These roads are maintained by Weld County. Pursuant to the definition
of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future
right-of-way line.
The applicant has obtained an Access Permit for two accesses to the property. Please show the
approved accesses on the Plat and label them with the approved Access Permit number (AP12-00284).
Access improvements are required and shall include 60' radiuses to accommodate turning trucks and
tracking control to prevent the tracking of mud onto the gravel roadway. The standard tracking control for
accesses onto gravel roads includes double cattle guards at the access point. After speaking with Jeff
Wright of A&W Water, the applicant would like to provide and construct a proposed gravel cross section
for the interior roadway. This gravel cross section will be part of the Improvements Agreement and a
clause stating that additional tracking control (possible installation of cattle guards) will be provided if the
County determines that tracking is occurring. A required upgrade of the tracking control to either 300 feet
of pavement onsite or 100 feet of pavement plus double cattle guards will also be included in the
Improvements Agreement and would be triggered if CR 40 were to be paved.
The proposed traffic stated in the application is 100 round trips per day. The applicant agreed to the
triggers for paving and turn lanes in their application. These triggers will be a part of the Improvements
Agreement. The proposed haul route for this facility is west on CR 40 to CR 35 and then half the traffic
will travel north to CR 44, then west to Hwy 85 while the other half of the traffic will travel south on CR 35.
This haul route will be finalized with further discussions with the applicant. The installation of a stoplight at
CR 42 and Hwy 85 may make that the safer intersection to utilize. CDOT must be contacted to see if this
increase of traffic at CR 44 and Hwy 85 will trigger any requirements through them. Maintenance of the
haul route is required.
An Improvements and Road Maintenance Agreement is required for this site. Public Works will provide a
draft of the Agreement after the Board of County Commissioners hearing for this project.
There shall be no parking or staging of vehicles on County roadways.
The maximum number of proposed trucks utilizing the site is 100 roundtrips. If the number of trucks
exceeds this maximum, the Improvements and Road Maintenance Agreement shall be revised and
additional improvements may be required to mitigate the additional impacts to the haul route.
A Stormwater Drainage Letter was submitted, stamped and signed by Kurt Rollin PE#24802 with CES
Consultants, LLC regarding on -site drainage conditions for the existing and proposed site. No outdoor
storage or overnight parking of vehicles is proposed for this site therefore, the water quality area has
been waived.

This property is not in a Special Flood Hazard Area (SFHA) defined by the Federal Emergency
Management Agency (FEMA).
REQUIREMENTS:
1. Add the following conditions of approval to the plat:
a. Show and label the approved access points on the Plat (will be provided).
b. Submit a proposed gravel cross section for the accesses. Public Works will review the
cross section and provide comments.
c. An Improvements and Road Maintenance Agreement is required for this site. Access
improvements shall include 60' turning radiuses and gravel section to prevent the
tracking of mud onto the County roadway. Additional improvements will be required if
tracking occurs or if trucking numbers increase. The haul route shall be determined in
additional discussions with the applicant. The triggers for roadway improvements agreed
to by the applicant in the application will be included in the agreement. The agreement
and form of collateral shall be reviewed by County Staff and accepted by the Board of
County Commissioners prior to recording the Use by Special Review plat.
2. Add the following development standards to the plat:
a. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist
on the property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds. All
vegetation, other than grasses, needs to be maintained at a maximum height of 12
inches until the area is completely developed.
b. The historical flow patterns and run-off amounts will be maintained on site in such a
manner that it will reasonably preserve the natural character of the area and prevent
property damage of the type generally attributed to run-off rate and velocity increases,
diversions, concentration and/or unplanned ponding of storm run-off.
c. There shall be no parking or staging of vehicles on County roadways.
d. The maximum number of proposed trucks utilizing the site is 100 roundtrips. If the
number of trucks exceeds this maximum, the Improvements and Road Maintenance
Agreement shall be revised and additional improvements may be required to mitigate the
additional impact to the haul route.

Environmental Health Services has reviewed this proposal for a mineral resource
development facility including oil and gas support and service (water hauling) in the A
(Agricultural) zone district. The facility will be leased to A and W Water Services.
A commercial well will provide water to the loading dock. The application states 100
people will utilize the site on a daily basis and up to 100 truck trips per day could occur.
The following section is from Environmental Health Services, Weld County Department
of Public Health & Environment, Septic Policies.
2.2.K Use of portable toilets and bottled water (revised 5/8/12)
Purpose: To define when portable toilets and commercially bottled water are
allowed.
Policy: Bottled water from a commercial source is allowed in the following
circumstances:
1. Temporary or seasonal uses that are utilized 6 months or less per year
(for example recreational facilities, firework stands, farmers markets )
2. Gravel mines
3. 10 or less customers or visitors per day
and/or one of the following:
4. 2 or less full time (40 hour week) employees located on site
5. 4 or less part time (20 hour week) employees located on site
6. employees or contractors that are on site for less than 2 consecutive
hours a day
Policy: Portable toilets are allowed in the following circumstances:
1. Temporary or seasonal uses that are utilized 6 months or less per year

2. Gravel mines
3. 10 or less customers or visitors per day
and/or one of the following:

Note: Records of maintenance and proper disposal for portable toilets shall be retained
on a quarterly basis and available for review by the Weld County Department of Public
Health and Environment. Portable toilets shall be serviced by a cleaner licensed in
Weld County and shall contain hand sanitizers.
As indicated above, it is the policy of this department that portable toilets are allowed
when employees or contractors are on site for less than 2 consecutive hours a day. As
personnel will be on site for a short duration, in accordance with Environmental Health
Services policy the use of portable toilets is allowed.
The applicant submitted a dust abatement plan which states the onsite driven surfaces
will be graveled, on site speeds will be minimal and water will be applied to mitigate dust
when necessary.
The waste handling plan states that work practices will discourage driver trash to be left
on the site and no trash bins will be provided.
We have no objections to the proposal; however, we recommend the following
requirements be incorporated into the permit as development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed
for final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a
solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5,
C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, fugitive particulate emissions, blowing debris, and other
potential nuisance conditions. The applicant shall operate in accordance with
the approved "waste handling plan", at all times.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.

5. This facility shall adhere to the maximum permissible noise levels allowed in
the Commercial Zone as delineated in Section 14-9-30 of the Weld County
Code.
6. Adequate drinking, handwashing and toilet facilities shall be provided for
employees and patrons of the facility, at all times. As employees or contractors
are on site for less than 2 consecutive hours a day portable toilets are
acceptable. Records of maintenance and proper disposal for portable toilets
shall be retained on a quarterly basis and available for review by the Weld
County Department of Public Health and Environment. Portable toilets shall be
serviced by a cleaner licensed in Weld County and shall contain hand
sanitizers.
7. The fresh water storage and loading system shall be operated in a manner to
minimize spills. Fresh water spills should be captured in above -ground
containment areas for reuse or allowed to infiltrate. There shall be no discharge
from this process to surface waters or to the facility's stormwater management
system, in accordance with the Rules and Regulations of the Colorado Water
Quality Control Commission, and the Environmental Protection Agency.
8. The operation shall comply with all applicable rules and regulations of State
and Federal agencies and the Weld County Code.

The Weld County Building Department has reviewed the history and investigated any complaints or
violations that accompany the parcel the establishment resides on. The findings are as followed:
There are currently no existing building violations. Building permits are required for new structures that
will be placeabr erectedon the site. Building Permits for the water tankincluding engineered
foundation and plans, will be required.
Any owner or authorized agent who intends to construct, enlarge, alter, repair, move, demolish, or
change the occupancy of a building or structure, or to erect, install, enlarge, alter, repair, remove,
convert or replace any electrical, gas, mechanical or plumbing system, or to cause any such work to be
done, shall first make application to the building official and Weld County to obtain the required permit.

We have reviewed the above referenced proposal. The submitted material does not appear to
qualify as a "subdivision" as defined in § 30-28-101(10)(a), C.R.S. Therefore, pursuant to the State
Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will
only perform a cursory review of the referral information and provide comments. The comments will not
address the adequacy of the water supply plan for this property or the ability of the water supply plan to
satisfy any County regulations or requirements.
The applicants are seeking a use by special review permit for a mineral resource development
facility including oil and gas support and service, more specifically described as a Water Loading Dock. The
Water Loading Dock is proposed to be located on about 2.5 acres of a 160 -acre farm. It is presumed that
the remaining acreage will continue to be used for agricultural purposes.
No potable water will be required for the Water Loading Dock, as all employees will be transient.
The industrial water is to be supplied via the well with permit no. 76241-F. The well may also be used for
irrigation purposes under well permit no. 8522 -RR. Well permit 76241-F allows the appropriation of 1122
acre-feet of water per year for industrial uses including equipment washing, oil and gas exploration,
development, reclamation, and dust suppression. The wells may not be operated for these industrial uses
unless they are included in a substitute water supply plan approved by the State Engineer or a plan for
augmentation approved by the water court. The wells are currently included in the Green Water Resource
Alliance et al. substitute water supply plan valid through June 30, 2013 (if not renewed).
So long as the existing well is operated in accordance with the terms and conditions of permit no.
76241-F while used for industrial purposes this office has no concerns regarding the subject proposal. If you
