WHEREAS, the Board of County Commissioners of Weld County,

WHEREAS, the Board of County Commissioners of Weld County,
Colorado has reviewed the request of Donald Schoenleber, Sr. for
an exemption from the definitions of "subdivision" and "sub-
57.• divided land" in Section 30-28-101 (10) , CRS 1973, as amended,
0^ and Section 2-1 of the Weld County Subdivision Regulations, and
WHEREAS, the Board of County Commissioners finds that Donald
Schoenleber, Sr. and Donald Schoenleber, Jr. are owners of certain
parcels of land located in the East Half and the West Half of the
East Half of the Southeast Quarter of Section 3, Township S North,
Range 64 West of the 6th P.M. , Weld County, Colorado. Mr. and
Mrs. Donald Schoenleber, Sr. own a 40-acre parcel with a resi-
dence. Mr. and Mrs. Donald Schoenleber, Jr. own the adjoining
40-acre parcel with residence. Mr. Schoenleber, Jr. wishes to
sell his residence and 21 acres. He also wishes to sell the
remaining 37. 5 acres to his father, Mr. Schoenleber, Sr. The
37. 5-acre parcel would be tied to the 40-acre parcel for future
development purposes creating one 77 . 5-acre parcel . The legal
description of the land to be exempted from the definitions of
"subdivision" and "subdivided land" is as follows:

east Quarter and East Half of the East Half
of the Southeast Quarter of Section 3, Town-
ship 5 North, Range 64 West of the 6th Prin-
cipal Meridian, Weld County, Colorado, con-
taining 80 acres more or less , EXCEPT
A tract of land located in the East Half of
the East Half of the Southeast Quarter of
Section 3 , Township 5 North, Range 64 West
of the 6th P.M. and being more particularly
described as follows :
Beginning at the East Quarter Corner of said
Section 3, and considering the East line of
said Section to bear South 00°00 '00 " West,
and with all other bearings contained herein
being relative thereto;

parcel be, and hereby is, declared to be exempt from the defini-
tions of "subdivision" and "subdivided land" as set forth in
Section 30-28-101 (10) , CRS 1973, as amended, and Section 2-1
of the Weld County Subdivision Regulations, and
BE IT FURTHER RESOLVED by the Board that the abovedescribed
parcel of land be, and hereby is, considered to be a single lot.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 1st day of
August, A.D. , 1979.

lations adopted August 30, 1972, which defines the term subdivi-
sion:

The Planning Department has reviewed this request and recommends
that the request be approved for the following reasons:

COMMENTS:
Mr . and Mrs. Donald Schoenleber, Sr. own a 40 acre parcel with a residence.
Mr. and Mrs. Donald Schoenleber , Jr. own the adjoining 40 acre parcel with
residence. Mr. Schoenleber, Jr. wishes to sell his residence and 2-1/2
acres. He also wishes to sell the remaining 37. 5 acres to his father, Mr.
Schoenleber, Sr. Mr. Schoenleber, Sr. feels the 37.5 acre parcel is neces-
sary for efficiency of the farm operation. The 37. 5 acre parcel would be
tied to the 40 acre parcel for future development purposes creating one 77. 5
acre parcel. No new building sites or lots are created by this exemption.
The subdivision exemption will tie the productive farmland together while
dividing the improvements parcel from the larger agricultural unit.

Dear Sirs,
As an agricultural property owner in Weld County Colorado, I
am asking the Board to favorably consider my request to realign the
property boundries of the 40 acre parcel of land described as "the
East 4 of the East 4 of the Southeast a of Section 3, Township 5
North, Range 64 West of the 6th P.M."
We purchased the aforementioned property on March 6, 1975, in
a joint venture with my parents Donald M. and Norma L. Schoenleber
Sr. , who purchased the adjoining 40 acres to the West. We made long
range plans to build a home on our unimproved property so that both
families could be close together and all could participate in
improving the total 80 acre farm.
On November 30,1978, the home we had planned was completed.
In early January of 1979, I was asked by my employer, Monfort of
Colorado, to help assume the task of opening a new production
facility in Jacksonville, Florida. My family and I have now taken
up residence in Florida and I am employed as Plant Coordinator
Monfort Foods, Jacksonville Division.
Due to the unexpected transfer and the hardships incured from

managing the home from Florida, it is therefore my request that the
Board consider realignment of the property boundries to exclude
the home and 21 acres. The remaining 371 acres will be kept intact
as agricultural property for use by my parents, who would not be
able to continue the farming operation they now have on only
their own 40 acres.

ditch adjacent to the road which apparently delivers water to the
property.
