COMMISSIONERS
The Weld County Council met in regular session in full conformity with the Weld County Home
Rule Charter, Monday, February 11, 2013, 6: 30 p.m. at the Weld County Administration
Building, Greeley, CO.
ROLL CALL: The meeting was called to order by President Mueller and on roll call the
following members were present, constituting a quorum of members thereof:
Councilman Don Mueller
Councilman Brett Abernathy
Councilman Bernard C. Kinnick
Councilman Kinnick made a motion to excuse Councilwoman Klein due to family illness. The
motion was seconded by Councilman Abernathy and carried.
Also present: Weld County Sheriff John Cooke and Karleen Watson, Council Secretary.
APPROVAL OF AGENDA: Councilman Abernathy made a motion to amend the agenda to
add to new business a discussion regarding the timing of mileage payments being changed.
The motion was seconded by Councilman Kinnick and carried.
APPROVAL OF MINUTES: Councilman Kinnick made a motion to approve the January 21,
2013 minutes. The motion was seconded by Councilman Abernathy and carried.
APPROVAL OF DOCUMENTATION: Councilman Kinnick made a motion to approve
Resolution 195 setting 2013 meeting dates. The motion was seconded by Councilman
Abernathy and carried.
PUBLIC COMMENT: No public comment at this time.
REVIEW PROGRAM: Sheriff Cooke described his duties as having a wide range of
responsibilities. He stated that it is a constitutional position with some powers through statute.
Sheriff is required statutorily to uphold the constitution, supervise department, house prisoners,
issue concealed weapon permits (CCWs), serve civil papers and investigate felonies. As the
Chief Fire Warden, his office covers forest fires and also performs search and rescue. CCWs
are a huge undertaking as the public is worried about future action at the state and federal
levels. In 2006, his office gave out 300 permits, in 2007 it went up to 900 permits. In 2008
applications were 1500. Last year applications taken were almost 1800 and a little over 1200
were approved. Currently, there is a backlog due to applications being submitted at the end of
the year and timing of background checks. Last year the Sheriff revoked 15 permits due to
arrests such as DUI; he denied a total of 7 (five were arrest records, 1 mental health and one
discretionary.) Mental health issues are hard to determine due to HIPPA laws. Past numbers
for CCWs were 1,754 issued last year, 1100 in 2011 and 1002 in 2010. Every year the

number goes up. As of January 11, there are 6,269 CCWs out and 309 pending. Last month
there were 250 renewals and 217 new applications.
The Sheriffs Office has a contract for security for Aims Community College in Greeley, Ft.
Lupton and Loveland which provides continuity between campuses. The Sheriff has an outside
presence in Weld County at substations in Ft. Lupton and Del Camino. His total overall staff is
346.5 employees, 180 officers work in the jail together with a support staff for a total of 200
employees. Patrol employees are a little over 100. Sheriff Cooke provided some stats on the
jail for 2011 and 2012. In 2011, 9,502 adults were booked in and in 2012, 9591 adults were
booked. They do not house ICE inmates as other Sheriffs offices do. An addition to the jail
was added in 2008 and another addition has been approved with a 10 -year exemption to delay
building. It is for about 380 beds.
Sheriff Cooke explained the different authority levels in the department. The Auxiliary includes
four levels: Explorer Posts (youth ages 14-21) chartered through Boy Scouts; Volunteers,
Reserves and Posse. Posse requires a horse or access to a horse. The Reserves are
volunteers that have gone through a Reserve Academy.
Sheriff Cooke provided some crime stats. Violent crime is down and property crimes are up.
They have seen a ration of battery thefts. His office started "Operation AC/DC" in October and
ended in December. At the end of that project, they identified 45-50 persons of interest,
recovered $40,000 in stolen property and $240,000 in court -ordered restitution. Phase II is
called "Lighting Strike" and so far they have arrested 11 people for battery and copper thefts.
Sheriff Cooke addressed term limitations for his office. In 2007, a new provision was added to
the Home Rule Charter limiting terms for Sheriff, Clerk and Recorder and Assessor. The
Charter is a stand-alone document that is why Weld County is different in certain areas such
as setting salaries for elected officials. His view is that the new provision was passed in 2007,
so the term limitations should begin from that date forward. It is his belief that there is
precedence for this view. The Sheriff wants the courts to decide so that it is legal.
OLD BUSINESS:
Set meeting review planners for September, October and November. Councilman Kinnick
made a motion to defer this action to the next regular meeting scheduled for March 18, 2013.
The motion was seconded by Councilman Abernathy and carried.
NEW BUSINESS:
Coordinator Reports: Councilman Mueller met with Board of County Commissioner Chair Bill
Garcia and has attended some of Commissioner Garcia's staff meetings.

The motion was seconded by Councilman Abernathy and carried.
Councilman Abernathy made a motion to change the issuance of mileage checks until the
amount of reimbursement reaches a total of $50 and above based on each individual council
member except for the end of the calendar year in which case the check will be issued not
dependent on the amount. The motion was seconded by Councilman Kinnick and carried.
Councilman Abernathy made a motion to change the review program for the March 18, 2013
meeting to Bruce Barker to discuss general term limitations of Elected Officials and then to
move Weld County Assessor Christopher Woodruff to April 15, 2013, and Eric Bergland to a
date to be determined. The motion was seconded by Councilman Kinnick and carried.
