A Use by Special Review permit for Oil and Gas laydown yard and office
The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process.
COMMENTS:
This site is located on CR29 south of CR38.5/Hwy85. The parcel numbers are 105732400002 and
105732400001. The applicant indicated there will be a maximum of 10 cars coming to the site.
CR 29 is a local gravel road and requires a 60 -foot right-of-way at full build out. There is presently a 60 -
foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the
Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
A Weld County access permit has been submitted and will be reviewed by the Traffic Engineer. Show the
approved accesses on the plat and label with the approved access permit number (will be provided).
Per discussion with the applicant, there would be a maximum of 5 vehicles per day visiting the site 3
times per day each resulting in 30 vehicles trips per day. The average daily traffic on CR29 in 2012 was
118 vehicles per day.
The applicant should become familiar with the US 85 Access Control Plan 1-76 to WCR 80, 1999. This
document can be found on the County's website. The intersection improvements per the access control
plan at Hwy 85 and CR38.5 are as follows:
"An existing public road access on both sides of US85. This access currently functions as
a full movement, un-signalized intersection. This intersection will be simplified before
higher traffic volumes complicate operations. The west side access from CR29 and
CR38.5 will be closed, but the connection between these roads will remain. CR29 on the
east side will be a RIRO with closure of the median."
Tracking control is required to ensure mud and debris from the site does not track onto County
maintained roadways. The application material indicated gravel will be used for the internal driving
surfaces.
The application material indicates an existing water quality depression will be utilized on the site. Show on
the plat the limits of this minimum required water quality volume. Label the water quality feature as "Water
Quality Feature, No Build/Storage Area"
Show on the plat drainage flow arrows.
Show on the plat 45' turning radius to accommodate commercial vehicles.
If more than one acre is disturbed a Weld County grading permit and State construction stormwater
permit will be required.

This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA).
REQUIREMENTS:
1. Prior to recording the plat:
A. Plat shall be amended to delineate the following:
1. County Road 29 is designated on the Weld County Road Classification Plan as a
local road, which requires 60 feet of right-of-way at full build -out. The applicant
shall verify and delineate on the plat the existing right-of-way and the documents
creating the right-of-way. All setbacks shall be measured from the edge of future
right-of-way. This road is maintained by Weld County.
2. Show the approved accesses on the plat and label with the approved access
permit number (will be provided).
3. Make reference on the plat to the improvements at Hwy 85 and CR22 as outlined
in the US85 Access Control Plan 1-76 to WCR80, December 1999.
2. Prior to Construction:
A. If more than 1 acre is to be disturbed, a Weld County grading permit will be required prior to
the start of construction.
Development Standards (notes on the plat):
1. Should noxious weeds exist on the property, or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Chapter 15, Articles I and II, of the Weld County Code.
2. The historical flow patterns and runoff amounts will be maintained on the site.
3. Weld County is not responsible for the maintenance of onsite drainage related features.
4. There shall be no parking or staging of vehicles on County roads. On -site parking shall be utilized.

Environmental Health Services has reviewed this proposal for a wet oilfield service
facility and laydown yard on Lots A and B of RE -4214. There is an existing maintenance
shop and residence on Lot A, and future office and modular house/office are proposed
for lot B.
There are currently 24 employees who access the site, with future growth of up to 50
employees. According to the applicant, there will be 5-10 employees working onsite on
a regular basis, with the others accessing the site on occasion. Permanent water and
sewage disposal are required for all employees accessing the site.
Both Lots A and B of RE -4214 are served by existing drinking water wells, Permit No.
26405-A on lot A, and Permit No. 269729 on lot B. Both wells are permitted for domestic
purposes only. The applicant will be required to permit one or both of the drinking water
wells for commercial use through the Colorado Division of Water Resources.
There is an existing septic system serving the residence on Lot A, Septic Permit SP -
0500276. The applicant is proposing to install a new septic system on Lot B when the
new buildings are constructed. According to the applicant, the employees currently use
the restroom facilities on Lot A, and a portable toilet is also provided for the employees.
As mentioned above, permanent sewage disposal is required for employee use.
Existing septic system SP -0500276 is permitted for 4 bedrooms or 8 persons. There are
currently 24 employees accessing the site. Therefore, the existing septic system will
require review by a Colorado Registered Professional Engineer to determine if
adequate for residential and employee use.
The waste handling plan stipulates that a dumpster is provided for trash and garbage,
and is serviced by B&C Refuse of Platteville. Used oils and other vehicle fluids are
removed by LaSalle Oil, and tires and batteries are returned to the stores where
purchased for recycling or disposal. There was no mention in the application if there
are floor drains in the maintenance facility. If there are floor drains, the drains must
discharge to a watertight vault and contents removed for proper offsite disposal. If
vehicle and equipment washing occurs onsite, the wash water discharge must also be
contained for proper offsite disposal. Floor drains in maintenance facilities and vehicle
wash water must not discharge to a septic system.
The dust abatement plan stipulates that the access drives and circulation areas will be
graveled. The applicant will need to revise the dust abatement plan to include the
material to be used to suppress onsite dust.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit written evidence from the Colorado Division of Water
Resources demonstrating that one or both wells are appropriately permitted for
the commercial use.
2. In the event the applicant intends to utilize the existing septic system at the home
on Lot A of RE -4214, for employee use, the septic system shall be reviewed by a
Colorado Registered Professional Engineer. The review shall consist of
observation of the system and a technical review describing the system's ability
to handle the proposed hydraulic load. The review shall be submitted to the
Environmental Health Services Division of the Weld County Department of Public
Health and Environment. In the event the system is found to be inadequately
sized or constructed the system shall be brought into compliance with current
Regulations.
3. The applicant shall submit evidence of an Underground Injection Control (UIC)
Class V Injection Well permit from the Environmental Protection Agency (EPA)
for any large -capacity septic system (a septic system with the capacity to serve
20 or more persons per day). Alternately, the applicant can provide evidence
from the EPA that they are not subject to the EPA Class V requirements.
4. The applicant shall designate the location of the septic systems (existing and any
proposed septic system) on the plat. No vehicle access drives, vehicle parking or
equipment storage shall be located in the area of the septic system. The septic
system must be protected from vehicle traffic.
5. The applicant shall revise the dust abatement plan to include the dust
suppressant to be used to mitigate onsite dust. The revised plan shall be
submitted to the Environmental Health Services, Weld County Department of
Public Health & Environment for review and approval
6. In the event washing of vehicles will occur on site the applicant shall ensure that
any vehicle washing area(s) shall capture all effluent and prevent discharges

from the washing of vehicles in accordance with the Rules and Regulations of the
Water Quality Control Commission, and the Environmental Protection Agency.
Vehicle washing areas should be designated on the plat.
7. The applicant shall submit documentation that floor drain wastes from any
vehicle maintenance facility is captured in a watertight vault and hauled off for
proper disposal.
Prior to release of building permits:
1. A septic permit(s) will be required for future building additions. The septic system
is required to be designed by a Colorado Registered Professional Engineer
according to the Weld County Individual Sewage Disposal Regulations. The
septic system shall be installed according to the Weld County Individual Sewage
Disposal Regulations.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed
for final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a
solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5,
C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, fugitive particulate emissions, blowing debris, and other
potential nuisance conditions. The facility shall operate in accordance with the
approved "waste handling plan", at all times.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall operate in accordance with the approved "dust abatement
plan", at all times.
5. This facility shall adhere to the maximum permissible noise levels allowed in
the Commercial Zone as delineated in Section 14-9-30 of the Weld County
Code.
6. Adequate drinking, handwashing and toilet facilities shall be provided for
employees and patrons of the facility, at all times.

7. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County
Code, pertaining to Individual Sewage Disposal Systems.
8. In the event the facility's water system serves more than 25 persons on a daily
basis the water system shall comply with the Colorado Primary Drinking Water
Regulations (5 CCR 1003-1). If not subject to these requirements, the Weld
County Department of Public Health and Environment strongly encourages well
users to test their drinking water prior to consumption and periodically
thereafter.
9. All potentially hazardous chemicals must be handled in a safe manner in
accordance with product labeling. All chemicals must be stored secure, on an
impervious surface, and in accordance with manufacturer's recommendations.
10. Any vehicle or equipment washing areas shall capture all effluent and prevent
discharges in accordance with the Rules and Regulations of the Water Quality
Control Commission, and the Environmental Protection Agency.
11. Floor drain wastes from any vehicle maintenance facility shall be captured in a
watertight vault and hauled off for proper disposal. Records of installation,
maintenance, and proper disposal shall be retained.
12. The operation shall comply with all applicable rules and regulations of State
and Federal agencies and the Weld County Code.

building on the property, per Section 29-3-10 of the Weld County Code
Buildings and structures shall conform to the requirements of the various codes adopted at the
time of permit application. Currently the following has been adopted by Weld County: 2006
International Residential Building Code; 2012 International Energy Code; 2006 International
2011 National Electrical Code; and Chapter 29 of the Weld County Code. A plan review shall be

Upon review of my case files and computer, an active Zoning Violation (ZCV13-00074) was noted. This
violation was initiated due to the operation of an oil & gas support related business without first completing
the necessary Weld County Zoning Permits. This case has not been presented to the Weld County Court
Magistrate through the Violation Hearing process. Since this application was submitted prior to an actual
court date being scheduled, NO investigation fee is required.
Due to records release laws, staff no longer tracks complainant information, but please be aware it is
staffs policy to no longer accept staff initiated complaints.
This application if approved by the Board of County Commissioners and once a plat is recorded will
correct this outstanding violation. If this application is denied, all commercial operations and storage of

The submitted material does not appear to qualify as a "subdivision" as defined in § 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011
memorandums to county planning directors, this office will only perform a cursory review of the referral
information and provide comments. The comments will not address the adequacy of the water supply
plan for this property or the ability of the water supply plan to satisfy any County regulations or
requirements.
The referral consists of two applications for site specific development plan and use by special
review. The first application seeks to allow business operations for wet oilfield service to be conducted
in an existing shop on a 4.00 -acre parcel, known as Lot A of RE -4214. There is an existing single-
family residence and pole barn with four horses on Lot A. The second application seeks to operate a
laydown yard for an oilfield service company on the adjacent 4.27 -acre parcel, known as Lot B of RE -
4214. A building with office space and restrooms is proposed to be built on Lot B. A modular house
may also be added to Lot B to be used for office space. The oil service company that will utilize both
sites currently has 24 employees and plans to grow to a total of 50 employees. Approximately five to
ten employees would be working from the site on a regular basis. Employees have access to
restrooms on Lot A or a portable restroom until the building including office space and restrooms is built
on Lot B.
There is an existing well with permit no. 264052-A located on Lot A. The use of ground water
from this well is limited to fire protection, ordinary household purposes inside one single-family dwelling,
the irrigation of up to one acre of home gardens and lawn, and the watering of poultry and domestic
animals. There is another existing well, permit no. 269729, located on Lot B. The use of ground water
from this well is limited to ordinary household purposes inside one single-family dwelling. The existing
wells (permit nos. 264052-A and 269729) may not be used as a water supply for the oil service
company and its employees unless new permits allowing for such commercial use are obtained.
Both wells withdraw ground water from the not-nontributary Laramie -Fox Hills aquifer. It is
anticipated that this office could issue an exempt commercial well permit for one or both wells. This type
of well permit limits the use of water from the well to drinking and sanitary facilities inside a single
business with no outside use allowed. A well permit allowing for both commercial and outside uses could
only be issued pursuant to a court -decreed plan for augmentation.
