RESOLUTION WHEREAS, a public hearing was held on February 18, 1976, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of Bang-A-Way, Inc., c/o Arnold B. Gurtler, Jr. , 4620 West 38th Avenue, Denver, Colorado, requesting approval for expansion of an existing controlled game bird farm operation on the follow- ing described property, to-wit: A parcel of land located in the Northwest Quarter (NW4) of Section 5, Township 3 North, Range 68 West of the 6th P. Said described parcel of land contains 58. 171 acres, more or less, and WHEREAS, the petitioner was present, and WHEREAS, there was no opposition to the request of petitioner for expansion of an existing controlled game bird farm operation, and WHEREAS, according to Section 3. 3 E (3) of the Zoning Resolution of Weld County, said request to locate a controlled game bird farm operation or any expansion thereof may be authorized upon the approval of the Board of County Commissioners, Weld County, Colorado, and WHEREAS, the Board of County Commissioners heard all the testi- mony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Com- missioners, that the application of Bang-A-Way Inc. , c/o Arnold B. Gurtler, Jr. , 4620 West 38th Avenue, Denver, Colorado, for expansion of an existing controlled game bird farm operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to effect expansion of said controlled game bird farm operation and that it shall have up to one (1) year from date hereof to effect the same. 3. That said controlled game bird farm operation be limited to the plans as submitted for said activity. 4. That all applicable subdivision regulations and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado. Gurtler, Jr. DISCUSSION: This operation is under the auspices of State Fish and Game people. Is licensed by State Fish and Game and must operate under State rules and regulations. The hunter must be licensed by the State and is accompanied in the field by a guide and bird dog. The operation has existed since 1972. Would like to utilize additional 59 acres. Will be used for hunting alone. No buildings to be erected in the immediate future. Land will he left in an agricultural state. Appears to be an illegal land split involved with the property. Weld County Planning staff recommends approval for the following reasons: 1 ) Complies with the Comprehensive Plan in that agricultural lands will remain under cultivation and the controlled game bird farm activity does not conflict with surrounding agricultural uses; and 2) all items required for a Special Use Permit application in Section 3.3E(3) of the Weld County Zoning Resolution are complete and in order. Received Board of County Commissioners approval on Auaust 2.0, 1975, conditional on water and sewer facilities being installed by State Health Depart- ment. City of Brighton will provide these facilities to the park. Made some changes in easements at Utility Board. Public Service Company, Mountain Bell and City of Brighton have no objections to these changes. Weld County Planning staff recommends approval for the following ` reasons: 1 ) the proposed final plat agrees with the approved preliminary plat as required by Section 6-3 B (3) of the Weld County Subdivision Regulations; 2) all items required for a final plat have been submitted and are in order; 3) the Weld County Utilities Coordinating Advisory Committee recommends approval of the final plat as submitted; and 4) the City of Brighton recommends approval . of the final plat as submitted. Glenn Paul pointed out that residents on north side of park are afraid drainage is going to run off in that direction. There are private wells in that direction. Final plat was submitted with drainage study and report, approved by County Engineer. Any individual site development on the property goes through specific review at that time. Holding ponds will be completed each time an individual lot is completed. There will be two lots on this first filing, consisting of about 15 acres. Total planned unit development to consist of thirty acres . Glenn Paul expressed his approval if provisions are made to protect wells, if an industry was to develop on property. RESOLUTION: Be it therefore resolved to recommend to the Board of County Commissioners approval of S-119, Ida Industrial Unit Development, subject to Weld County Planning staff recommendations and subject to site development plans being submitted before any development takes place. Essentially this was implemented in an effort to ' preserve larger economic agricultural units in the County. This stems from one of the basic premises behind the meld County Comorehensive Plan; namely that agriculture should and must be protected. On November 5, 1975 by Warranty Deed (Reception #1674307), the Northern Colorado Sod Company transferred a parcel of land containing approximately 58 acres to Bang-A-Way, Inc. Property research by our office reveals that the Northern Colorado Sod Company as a result of the above transaction appears to have two remaining parcels containing about 35 acres and 38 acres both of which fall below the minimum lot size requirement adopted by 'Weld County. As stated in Section 3.3(6) of the Weld County Zoning Resolution, "Variance from this minimum lot area shall be considered a Conditional Use subject to the provisions of Section 3.3(D) of this Resolution (Zoning Resolution). Also, as stated in Section 3.3(H) of said Resolution, "No building permit shall be issued for any construction on any parcel of .land in this zone unless it is in connection with a legal ' conditional use pursuant to the provisions of Section 3.3(0) of this , Resolution. The proposed application is for the addition of fifty-eight (58) acres, adjacent to the present location of Bang-A-Way Gun Club and Kennel. Prior approval dated February 16, 1972, and Resolu- tion signed March 22, 1972. The operation of the company is to act as a gun club and dog training kennel. The kennel operation is for the purpose of training various breeds of hunting dogs. (On some occasions dogs will board only.) Training sessions are performed in water as well as on land. The Conservation Plan and cropping system is identical to that of a well managed irrigated farm in the area raising alfalfa, irrigated pasture and small grains, Some of the crops such as small grains and pasture are permitted to mature and be used as wildlife cover. From a soil building standpoint this is an ideal practice. He has undertaken a complete Canada thistle eradication program and the re-building of the irrigation system.
