The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. All issues of concern and critical issues during further review must be resolved with the Public Works Department. COMMENTS: This project is located at the Northeast corner of CR62 and CR15 section line right of way. County Road 62 is designated on the Weld County Road Classification Plan as an arterial roadway, which requires 140 feet of right-of-way at full build out. The applicant shall verify the existing right-of-way and the documents creating the right-of-way and this information shall be noted on the plat. All setbacks shall be measured from the edge of future right-of-way. This road is maintained by Weld County. County Road 15 adjacent to this parcel is unmaintained county right of way. The City of Windsor vacated 30ft of right of way on the west side of the section line. Weld County retains 30ft of unmaintained county right of way on the east side of the section line. Due to surveyors' interpretation of the location of the section line, there is a potential of a wedge shaped parcel of land and possible joint ownership along the west side of the subject property. Average Daily Traffic in 2011 was reported as 5,052 on CR 62. The application states that less than 10 people will use this site and Ford F250 and F350 will visit the site twice daily seasonally. A 45' radius is required on all accesses to public roads for accesses designed to accommodate commercial/truck traffic. When feasible, there shall be no net increase in the number of accesses to a public road (Sec. 24-8-40). The site currently has 1 main access point. A secondary access on the west side of the property exists for access to the 50ft utility easement. This access should only be used for that purpose. Show the existing access point on the Plat and label it with the Access Permit number (will be provided). The applicant shall be responsible for providing a water quality feature that conforms to the methodology outlined in Volume 3, Section 3.3.0 of the Urban Storm Drainage Criteria manual. The applicant shall indicate specifically on the plat the type of road right-of-way and/or utility easement and indicate whether it is dedicated, private, or deeded to provide adequate access to the parcel. It will detail any onsite and offsite requirements. REQUIREMENTS: 1. Show on the Map: a. County Road 62 is designated on the Weld County Road Classification Plan as an arterial roadway, which requires 140 feet of right-of-way at full build out. The applicant shall verify the existing 60 feet of right-of-way and the documents creating the right-of- way and this information shall be noted on the plat. All setbacks shall be measured from the edge of future right-of-way. If the existing right-of-way cannot be verified, it shall be dedicated. This road is maintained by Weld County. b. The County Road 15 Section Line has 30 feet of unmaintained County line right-of-way. The applicant shall verify the existing 30 feet of right-of-way and the documents creating the right-of-way and this information shall be noted on the plat. All setbacks shall be measured from the edge of right-of-way. c. Show the existing access point on the Plat and label it with the Access Permit number (will be provided). d. Delineate the water quality feature(s) on the plat and label as "No Build/Storage Area". Label the volume and dimensions of the water quality feature(s) on the plat. e. Show a 45' radius on the map for access onto CR62 to accommodate commercial/truck traffic. f. Show areas of gravel, paving, or recycled concrete/asphalt, identify parking areas. g. Show on the map the type of right-of-way/easement and indicate whether it is dedicated, private, or deeded to provide adequate access to the parcel. 2. Before Recording the Map: a. An improvements agreement including collateral for all on -site and off -site improvements may be required for this site. 3. Add the following notes on the map: a. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum height of 12 inches until the area is completely developed. b. Off-street parking spaces and internal drive isles shall be surfaced with gravel, asphalt, recycled asphalt base, concrete or the equivalent and shall be graded to prevent drainage problems. c. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. d. The applicant must take into consideration storm water quality and provide accordingly for best management practices. e. Weld County is not responsible for the maintenance of drainage related features. This must be addressed by the homeowner's association or owner. The application indicates there will be a maximum of 10 employees who come to the site and retrieve trucks and/or equipment and continue to the job site. The following section is from Environmental Health Services, Weld County Department of Public Health & Environment, Septic Policies. 2.2.K Use of portable toilets and bottled water (revised 5/8/12) Purpose: To define when portable toilets and commercially bottled water are allowed. Policy: Bottled water from a commercial source is allowed in the following circumstances: 1. Temporary or seasonal uses that are utilized 6 months or less per year (for example recreational facilities, firework stands, farmers markets ) 2. Gravel mines 3. 10 or less customers or visitors per day and/or one of the following: 4. 2 or less full time (40 hour week) employees located on site 5. 4 or less part time (20 hour week) employees located on site 6. employees or contractors that are on site for less than 2 consecutive hours a day Policy: Portable toilets are allowed in the following circumstances: 1. Temporary or seasonal uses that are utilized 6 months or less per year (for example recreational facilities, firework stands, farmers markets ) 2. Gravel mines 3. 10 or less customers or visitors per day and/or one of the following: 4. 2 or less full time (40 hour week) employees located on site 5. 4 or less part time (20 hour week) employees located on site 6. employees or contractors that are on site for less than 2 consecutive hours a day Note: Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. As indicated above, it is the policy of this department that portable toilets are allowed when employees or contractors are on site for less than 2 consecutive hours a day. As personnel will be on site for a short duration, in accordance with Environmental Health Services policy the use of portable toilets is allowed. The waste handling plan indicates Waste Management will provide trash pickup and metals will be taken to Anderson Salvage. No vehicle maintenance will take place onsite. An onsite dust abatement plan was not submitted with this application, however a dust abatement plan was supplied at the 7 day review phase. The 7 day document states the road going into the property is constructed of road base. The plan shall be updated to include how dust will be controlled on the outside storage area. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirement be met prior to allowing the plat to be recorded: 1. The applicant shall submit a dust abatement plan, detailing on site dust control measures, for review and approval, to the Environmental Health Services, Weld County Department of Public Health & Environment. 2 We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 4. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. 5. This facility shall adhere to the maximum permissible noise levels allowed in the Non -specified Zone as delineated in Section 14-9-30 of the Weld County Code. 6. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 7. Adequate drinking, handwashing and toilet facilities shall be provided for employees and patrons of the facility, at all times. As employees or contractors are on site for less than 2 consecutive hours a day portable toilets and bottled water are acceptable. Records of maintenance and proper disposal for portable toilets shall be retained on a quarterly basis and available for review by the Weld County Department of Public Health and Environment. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers. 8. A Colorado Discharge Permit System or CDPS permit from the Colorado Department of Public Health and Environment (CDPH&E), Water Quality Control Division shall be obtained, as applicable. 9. All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. 3 10. Director This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide informal comments. The site contains an existing metal building that is proposed to be used to store construction tools and equipment for a small construction concrete business. Outdoor storage will be provided for pick-up trucks, trailers, a backhoe, forklift, and other vehicles and equipment. There will be no employees stationed at the site. It will be used to pick up and drop off vehicles, equipment, and materials during the workday. According to the submitted materials, there is no water on site. A portable toilet is available at the site for use by employees. If water becomes available to the site in the future, the applicant proposes to purchase a water tap and put in an indoor bathroom. Well permit no. 262798 was issued to Mr. Kessler on April 12, 2005 to construct a well on the subject 8.25 -acre parcel for ordinary household use inside one single-family dwelling. Well permit no. 262798 may not be used by employees at the site without first obtaining a new well permit allowing for such commercial use. This office has not received evidence of construction of the well, and the permitted expiration date was April 12, 2007. Based on the information provided to this office, it is likely that a well was never constructed under permit no. 262798. This office requests that Mr. Kessler contact this office to confirm that a well was not constructed under permit no. 262798 so that we may update our records to show this permit as expired. The subject property is located inside the Town's Growth Management Area (GMA) and is designated as High Density Estate Residential (E-2) on Windsor's Land Use Plan Map. This application proposes storage of pickup trucks, trailers, tools, and other equipment related to the landowners construction business on an existing 8.3± acre property. The proposed use is inconsistent with the Town's land use designation and with the adjacent land uses. However, due to the lack of services available in proximity to the site, annexation is not warranted at this time. Based on the aforementioned information, the Planning Commission voted to request that the Planning Department forward the following comments to Weld County for their consideration: 1. It does not appear that the site plan accurately depicts improvements on the property. As an example, the driveway on the west side of the property is not shown on the site plan. 2. The proposed use is inconsistent with the Windsor Land Use Map designation of E-2 (High Density Estate Residential). 3. Planning Commission does not recommend annexation at this time because Town of Windsor water and sewer is not in the vicinity of the site. 4. The applicant has proposed adding three trees to the site for additional screening. The Planning Commission recommends additional landscaping to reduce the impacts of the large fenced area, and the opening in the fence.
