RESOLUTION
RE: A FORFEITURE OF CONTRACT BOND OF RAYMOND F. LARSON, DBA RAY
LARSON REALTY, CONCERNING JOHNSON SUBDIVISION (PART OF THE
NORTHEAST QUARTER OF SECTION 2, TOWNSHIP 5 NORTH, RANGE 66
WEST OF THE 6TH P.M. , WELD COUNTY, COLORADO) .
WHEREAS, heretofore and on May 2 , 1973 , the Board of
County Commissioners, Weld County, Colorado, did accept Contract
Bond #5474051 in the amount of $2, 500. 00 from Raymond F. Larson
DBA Ray Larson Realty, Greeley, Colorado, to guarantee completion
of certain roads in Johnson Subdivision, and
WHEREAS, it has come to the attention of the Board that
to the present time said roads have not been completed as agreed,
and
(
WHEREAS, it has been recommended by the County Engineer
that said Contract Bond now being held by Weld County, Colorado,
for the completion of certain road requirements within said
Johnson Subdivision (Part of the NE1 of Section 2, Township 5
North, Range 66 West of the 6th P.M. , Weld County, Colorado) be
declared to be in default and forfeited, and
WHEREAS, declaration of default and forfeiture of said
bond is necessary to obtain funds for completion of certain
improvements within said Johnson Subdivision for compliance with
county standards.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners of Weld County, Colorado, and it hereby declares
said performance bond guaranteeing completion of certain roads
in Johnson Subdivision to be in default and forfeited.
BE IT FURTHER RESOLVED, by the Board and hereby authorizes
and directs the County Finance Officer, Barton Buss, to convey
notice of the Board' s action to Raymond F. Larson, principal,
and Western Surety Company, as surety, on Contract Bond #5474051,
dated May 2, 1973, in the sum of $2, 500. 00.
The above and foregoing resolution was, on motion duly
made and seconded, adopted by the following vote this 7th
day of June , A. D. , 1976 .
