No other changes are proposed. In response to the Completeness Review dated May 15, 3013, the following are tendered: Revised USR Map and Questionnaire — See attached. Water Source — Conversion of Irrigation Well #017028F to industrial/commercial use is pending and Division of Water Resources documentation will be provided upon said conversion and obviously is a preface to recording the USR Plat. Waste Handler Provider (trash) — See attached. Portable Toilet Provider — See attached. Drainage Narrative — A Drainage Narrative was provided in the Application tendered April 30, 2013, as prepared by CES Consultants, LLC, dated April 19, 2013. Said Drainage Narrative is now revised to reflect potential installation of some 20 - 20,000 gallon portable fresh water tanks. The original Application proposed 10 such tanks. Enclosed Engineering calculations suggest no Water Quality Feature is warranted — see attached. Access Photos — said photos were re -sent via separate electronic attachment on May 13, 2013 as a portion of the original submittal apparently was not received by Weld County Planning. Traffic Narrative — The Traffic Narrative has been revised (copy attached) to reflect up to 200 water truck loads per day versus the originally anticipated 100 loads per day. The Applicant and his Agent realize certain traffic "triggers" may be incumbent as a result and would be reflected in approval processes and an On-Site/Off-Site Improvements Agreement. Respectfully submitted, Linn T. Leeburg 1 Everitt Water Depot (Enderson Site) NW Corner CR-111 /134 Hereford, CO 80732 Parcel # Project Overview Proposed USE of the Property Mr. Kenneth H. Everitt owns the aforesaid parcel. The parcel is the East 1/2, SE 1/4, Section 31, T12N, R59W east of Hereford, Colorado. His intention is to build a Water Depot for oil field services of some 2± acres on the 80 -acre parcel via a Use by Special Review (USR) Proceeding within Weld County. Water will be supplied via a commercial well to up to 20-20,000 gallon portable water tanks with appropriate manifolding. A maximum of 200 truck loads per day would be anticipated. No permanent employees will be on Site with truck drivers being there during loading operations for less than 30 minutes. Hours of operation will be 24/7/365. Portable toilets are requested, as well as a trash dumpster. No domestic water source is proposed. No storage of equipment will be required with farmed lands, fallow lands and natural grasses elsewhere on the parcel. Truck tankers of up to 85,000 gross vehicle weight (gvw) will access the Site via gravel CR-111 and CR-134 with traffic thence disbursing equally north, south and east from the CR-111/134 intersection thence further disbursing largely equally to other roads in the area depending on oil field customers' needs. No. 2 Consistency with the Intent of the Weld County Code. Chapter 22 of the Comprehensive Plan Comprehensive Plan Consistency The Weld County Comprehensive Plan addresses goals and policies for agriculturally zoned properties and oil and gas facilities. The Comprehensive Plan also addresses the presence of oil Revised May 17, 2013 and gas deposits in the County and encourages the extraction of oil and gas resources that conserve the land and minimize the impact on surrounding land and the existing surrounding land uses. This new facility will assist in the extraction of oil and gas resources as water is a critical component to the drilling operation. The new Water Depot and tanks should not impact the area surrounding the facility. The proposed Water Loading Depot will decrease the impact on roads and traffic in other areas of Weld County by providing access to water that is closer to drilling operations in the area. Trucks that transport the water will drive less to service operations in the area, thus decreasing impact on roads throughout the County. The Applicant will pay for all on and off site improvements attendant to the planned USE. The USR will be serviced by an existing Irrigation Water Well (Permit #017028-F), decreed in W-8022-75, Water Division 1, on May 31, 1977, which will be converted to Commercial/Industrial purposes. No. 3: Consistency with the Intent of the Weld County Code, Chapter 23 (Zoning) and the Zone District in which it is located Section 22-2-10 (D) emphasizes the extraction of natural resources as an important part of the economy of the County. The Water Loading Depot supports the extraction of these natural resources by providing water for drilling processes. Oil and gas facilities are allowed as a Use by Right in the A (Agricultural) Zone District. Oil and gas support and service operations require Use by Special Review authority. No. 4: Surrounding USES The parcel abuts the CR-134/111 intersection (NW corner) and is located approximately 15+ miles east of the Town of Hereford. Farm/ranch operations are to the north, west, east and south with rural residences 1+ mile to the northwest. Oil/gas wells abound throughout the area with a wind farm immediately west. No. 5: Questionnaire Response a. Water Depot: Approximately 200 people will visit the site per day. b. None — Depot employees will be transient, truck drivers and an occasional supervisor. c. The Site will be open 24 hours per day, 365 days per year. d. Water Depot: Twenty 20,000 -gallon portable tanks. e. None. f. No. 9: Construction Schedule Water Depot: Construction would entail a water line from an existing well, an access to/from CR-134/111 intersection, gravel on site and placement of 20 - 20,000 gallon portable water tanks. The proposed site is located in the E %2 of the SE A of Section 31, Township 12 North, Range 59 West of the 6th Principal Meridian in Weld County. More specifically, the site is located approximately at the northwest corner of the intersection of Weld County Road (WCR) 111 and WCR 134. The site is bound on the east by WCR 1 11, on the south by WCR 134 and on the other two sides by undeveloped farmland. The overall USR site is covered by natural grasslands and is 80 acres. The proposed water loading dock site will be located in the southeast corner of the 80 acre USR parcel and is 2.07 acres. The existing topography of the water loading dock site slopes from the southwest corner to the northeast corner at a 1% to 1.5% grade. The proposed development of the site will consist of the installation a "water loading dock" with twenty (20) 20,000 fresh water tanks. A gravel road base area will be installed around the tanks. A proposed gravel drive off of WCR 134, located approximately 100 feet west of the southeast corner of the site will be used to access the site. The existing drainage from the site sheet flows from the southwest to the northeast. Offsite flows from the undeveloped natural grasslands east of the site will also sheet flow across the site. Since the proposed development of the site is minimal, the existing drainage patterns will be maintained. Per the attached drainage calculations, the difference in the overall existing and proposed 100 year runoff quantities (Existing = 5.1 cfs, Proposed = 5.6 cfs) generated from the site will be negligible and no site detention or water quality features will be required. An occasional supervisor with pickup will inspect the operations. Traffic will enter and exit the Site on an existing gravel access (CR-134 right-of-way), proceeding at minimal (10 mph) speed, access the Water Depot, thence egress to the CR-134/111 intersection. An Access Permit Application is hereby tendered for the entry/egress point. Access is "gravel to gravel". A "GRAVEL SECTION" IS SPECIFICALLY REQUESTED IN LIEU OF ACCESS PAVEMENT AND/OR CATTLE GUARDS. This approach parallels those provisions recently authorized by Weld County for similar projects — notably USR 12-0027 and USR 12- 0062. Traffic to and from the USR Site is dependent upon actual water user demand. Projections suggest some 200 round-trip trucking events per day, spread over a 24 -hour period or 400 total trips per day, averaging 17 per hour. All USR traffic is projected to enter and exit the Site from/to the CR-134/111 intersection on CR-134 right-of-way; arriving/disbursing largely equally northward on CR-111, southward on CR-111 and eastward on CR-134. In other words, some 133 trips per day or 6/hour average) arrive/depart to/from the north, south and east, respectively. Traffic thence further dissipates to graveled county roads in the area depending on oil/gas field needs. Vehicle Per Day (VPD) or Vehicle Per Hour (VPH) Triggers are recognized as probable provisions in an On/Off Site Improvements Agreement between the Owner and Weld County. The design plan is to place twenty (20) future fresh water tanks on the site. These tanks are 20,000 gallon tanks and are raised off the ground with integral skids. CES reviewed the soils information for the site as produced by the West Greeley Conservation District. This information showed the soils types at the site as classified by the US Agricultural Department Weld County Soil Survey. Per this information, and the observations at our site visit, it is our opinion that the existing soils have adequate strength and bearing capacity of support the proposed twenty (20) fresh water tanks on integral skids as shown.
