RE: AUTHORIZATION TO PAY BUILDING PERMIT, PLAN CHECK, DRAINAGE IMPACT,
SEPTIC AND DEMOLITION FEES REPAIRS AND RECONSTRUCTION ON BEHALF
OF WELD COUNTY PROPERTY OWNERS IMPACTED BY THE 2013 FLOOD
EMERGENCY DISASTER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, heavy rains occurring west of and throughout Weld County, from
September 9 through 13, 2013, have caused flooding resulting in substantial property damages
to structures located in the unincorporated areas of Weld County, that will require repair and/or
reconstruction in order to occupy, and
WHEREAS, on September 13, 2013, the Board declared Weld County to be in a state of
emergency disaster, pursuant to Section 24-32-2101, C.R.S., et. seq. (the "Colorado Disaster
Emergency Act of 1992"), and Title VI of PL 93-288, as amended, The Robert T. Stafford
Disaster Relief and Emergency Assistance Act, and
WHEREAS, in response to said flood disaster emergency, the Board desires to
authorize the use of Weld. County funds on behalf of such property owners for the payment of
fees normally charged by the Department of Building Inspection for building permit, plan check,
drainage impact, septic and demolition fees for the repair or reconstruction of buildings
damaged by the flood disaster.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Board hereby authorizes that Weld County funds be made
available to pay, on behalf of owners of properties located within the unincorporated areas of
Weld County and who are in need of repairing and/or replacing structures that have been
significantly damaged or lost due to recent flooding, the fees normally charged by the
Department of Building Inspection for building permit, plan check, drainage impact, septic and
demolition fees for such repair and/or reconstruction.
BE IT FURTHER RESOLVED by the Board that the authority issued herein shall be for
one year beginning on the date of this Resolution.
