RE: GRANT CHANGE OF ZONE FROM A - AGRICULTURAL DISTRICT TO C -
C' COMMERCIAL DISTRICT FOR 0. FRED ANDERSON, 12681 WELD COUNTY

WHEREAS, the Board of County Commissioners of Weld County,

;--1 Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
,-) WHEREAS, a public hearing was held on the 31st day of May,

1978 at 2 : 00 o' clock p.m. , for the purpose of hearing the petition
of 0. Fred Anderson, 12681 Weld County Road 141, Fort Lupton,
Colorado 80621, requesting a change of zone from A-Agricultural
to C-Commercial District for the following described parcel of
land, to-wit:
A parcel in the NE4 of Section 31, Township 2 North,
Range 66 West of the 6th P.M., Weld County, Colorado,
described as:
Beginning at the Southeast corner of said NE-; Thence
S 89°53'09" W along the South line of said NE 1/2, a
distance of 1707.0 feet to the True Point of Beginning;
Thence N 00°56'09"E. , a distance of 415.0 feet. Thence
S 89°53'09" W and parallel to the South line of said
NEa a distance of 500.0 feet. Thence S00°56'09"W a
distance of 415.0 feet to a point on the South line
of said NE4; Thence N89°53"09"E along said Southline,
a distance of 500.0 feet to the True Point of Beginning.
Said parcel contains 4.764 acres more or less.
WHEREAS , the petitioner was present and presented evidence on
his behalf, and
WHEREAS, persons opposing the change of zone were also pre-
sent and presented evidence on their behalf, and
WHEREAS , Section 8. 2 and 8. 3 of the Weld County Zoning
Resolution authorizes the Board of County Commissioners to grant
a change of zone upon the showing by the petitioner of certain
facts , and
WHEREAS , the Board of County Commissioners heard all the
testimony and statements of those present, has studied the request
of the petitioner and the recommendations of the Weld County
Planning Commission, and having been fully informed and satisfied
that the request for rezoning complies with the Weld County

Comprehensive Plan and the conditions set out in Section 8 .2 and
8 . 3 of the Weld County Zoning Resolution;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the petition of O. Fred
Anderson for a change of zone from A-Agricultural District to
C-Commercial District on the above described tract of land be, and
hereby is , granted.
BE IT FURTHER RESOLVED by the Board that the reasons for
approval contained in the Planning Commission recommendations
dated April 18 , 1978 , be and hereby are, incorporated as the find-
ings of fact of the Board of County Commissioners in this matter .
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 31st day of
May, A.D. , 1978 .

I hereby certify that pursuant to a notice dated April 24 ,
1-978, duly published April 27, 1978 and May 18, 1978 in the
Johnstown Breeze a public hearing was held on the request
of O. Fred Anderson for a change of zone from A-Agricultural
to C-Commercial District. Mr. Anderson and George Barber of
Sage Engineering were present and made their request.
Jim Black, City Administrator from Fort Lupton was also
present and requested that the Board deny the change of zone
and request Mr. Anderson to apply to the City of Fort Lupton
for annexation. After all testimony was received, Commissioner
Jacobucci made a motion to approve the change of zone for
Mr. O. Fred Anderson from A-Agricultural to C-Commercial
District. Commissioner Carlson seconded the motion and it
carried unanimously. All five commissioners were present
for the hearing.

1962, for this area the City of Ft . Lupton has annexed all the
area south of County Road 14*, west of Highway 85 and east of
the South Platte River. Located within this area are several
commercial and light industrial uses. Prior to the development
of this property to the current land uses, the predominant land
use was agricultural .
2. The rezoning request agrees with the policies contained within
-the Weld County Comprehensive Plan in that the request for
commercial development is located adjacent to an existing
municipality (City of Ft. Lupton) and in compliance with the
Comprehensive Plan of that municipality. The general plan of
the City of Ft . Lupton designates the future land use of this
area as industrial.
3. The Weld County Engineering Department has indicated there are
no engineering problems anticipated by this request .
4. The Ft . Lupton Fire Protection District has indicated that they
have no problems with this request .
5. The Platte Valley Soil Conservation District has no opposition
to this request.
6. The Weld County Health Department has indicated that the
applicant has secured plans and specifications for an engineered
designed septic system. These plans have been approved by the
Weld County Board of Health as per County regulations . No
problems is foreseen in the installation and final inspection of
this system.
Comments :
1. The City of Ft . Lupton Planning Commission has requested the
County deny the change of zone and request Mr. Anderson to apply
to the City of Ft . Lupton for annexation . Alan Sandberg, City
of Ft. Lupton Planning Commission Chairman , indicated that the
Planning Commission felt that if this request was approved it
would encourage other commercial and industrial uses to locate
next to the existing city limit which would put a demand on city
utilities and services to serve properties located outside of the
city.
2. Our office has received a letter from David Conner, President of
the Ft . Lupton Development Corporation, a surrounding property
owner, encouraging Mr. Anderson to annex to the City of Ft .
Lupton. He indicated that he felt the city could service this
property without too much difficulty and would have better
-control of the use of the property if it were annexed.

3. The State Engineer' s Office, Division of Water Resources, has
indicated in a letter dated April 3, 1978, that the Anderson
well (Registration No. 20306-F) located on the property is
adjudicated for domestic and irrigation use. Therefore,a
change in use must be approved by the Division I Water Court
so that the water can be used for commercial purposes. Due
to these comments, the Division of Water Resources cannot
recommend approval for this request.

Anderson Rezoning
1. Current zoning is Agricultural
The size of the• tract makes it impractical for the purpose of
raising crops. The use was formerly a dairy operation with a re-
tail. milk and dairy products manufacturing abusiness. Because of
restrictive requirements of various governmental agencies the opera-
. tion became unecomonical and was discontinued several years ago.
2. The long range plan of the county is to have developement occur
adjacent to or near existing towns.

This tract addoins*the city of Fort -Lupton and is compatable to the
zoningof the„ city,.which-it adjoins.
3. It is questionable if the adjoining property would benefit from
change of zoning but it would certainly not deter from the value of
adjoining property.
4. Land immediately adjacent to and surrounding this tract on three
sides is a large tract, which is feasible to be used for crop
production.
Land across the county road to the South is within the City of Ft.
Lupton and is already zoned as Commercial.
5. Existing facilities on the subject property which has been con-
verted 'to commercial use make it more desirable than other land
zoned Commercial in this area.

6. The Agricultural Zoning is the original zoning. There has been no
rezoning done on the subject tract. •
Conditions have definetly changed in this area. The annexation to
It. Lupton of the Industrial Park across the road to the South of
the subject tract is probably the most important change.
7. The most significant economic developement in this area is the oil
and gas developement in the immediate area of Fort Lupton which has
created a need for this type of operation which requires commercial
zoning.
8. The specific type of operation that is presently being operated from
this location is as follows.
A. Oil field construction
:Roustabout crews that do maintenance and construction work
directly connected to oil and gas production; building tank
batteries, laying flowlines, hooking up meter runs, fence
construction and repairs. Weed Control, repairing and re-
placing existing as lines.
B. Municipal. Construction
Sewer iices, water lines, r.uptic tanks and leach-fields

C. Engineering
Survey, Sewer and Water Design, Aerial:- Mapping,
Tax Mapping, R.O.W. Acqui.stion, Permits
The existing facility being used here is an old dairy pro-
Lessi.ng plant. Part of it was used as office space and is still
being used for that purpose. Part of the facility has been con-
verted to a shop for storage and maintenance of equipment used
in the constimeLion business. Another part has been converted to
storage space for supplies used in the construction business such
as post, wire, pipe fittings, pipe etc. The balance of the area
is used as crew quarters for the people that are employed in
the operation.

Dear Mr. Cunliffe:
We have reviewed the material concerning the above referenced rezoning
case . We understand that -all facilities are existing and that water is to be
supplied from the Anderson well (Registration No. 20306-F) . This well produces
water tributary to the South-Platte River. Although this well has been adjudicated
(Case No. W-2113), the appropriation date of December 31, 1900 represents a
fairly junior water right in the South Platte Drainage. As such, the well will be
subject to curtailment during most of the irrigation -season unless included in an
approved plan for augmentation. We must also point out that the well was
adjudicated for domestic and irrigation use. Therefore, a change in use must
be approved by the Division 1 Water C9urtso that the water can be used for
commercial purposes .
Due to these comments, we cannot recommend approval of the Anderson
Rezoning. We would be most happy -to consider additional information at your
request.
