WHEREAS, a public hearing was held on September 20, 1976 in the Chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of Earl Anderson, Route 1, Box 94 , Greeley, Colorado, requesting a Special Use Permit for a Greyhound training track located on a parcel of land in the Northwest Quarter of Section 13, Township 6 North, Range 65 West of the 6th P.M. , Weld County, Colorado, being more particularly described as follows : Beginning at the Northwest Corner (NW Cor) of said Section 13, and considering the North Line of said Section 13 as bearing North 90°00 ' 00" East, with all other bearings contained herein relative thereto; Thence North 90°00 ' 00" East, along said North Line, 369 . 8 feet to the True Point of Beginning; Thence continuing North 90°00 ' 00" East, along said North Line, 708. 05 feet; Thence South 00°00 ' 00" West, 325. 00 feet; Thence South 90°00 ' 00" West, 918. 70 feet; Thence North 32°57 ' 00" East, 387 . 30 feet to the True Point of Beginning. Tom Honn explained that the uses would be listed in the County Zoning Regulations under both Commercial and Industrial Districts, but would have to be compatible with the City of Greeley's light industrial zone regulations. Final Site Plans and Parking will have to be reviewed by the County and the City at time of submittal . Mr. Sears stated he has talked with the City some more, and there is good possibility that he will be making application to the City for sewer. RESOLUTION: Be it therefore resolved to recommend to the Weld County Board of County Commissioners approval of this request for a change of zone from "C" to "I-UD" . Motion by Tim Weigand . NWq Sec. 13 T6N R65W SUBJECT: Greyhound training track APPEARANCE: Earl Anderson DISCUSSION: Mr. Anderson explained that he has been in the business of training greyhounds for 10 years. It is a competitive business and he can't compete unless he is equiped to do so. Weld County Planning staff recommends approval for the following reasons: 1 ) The request is in compliance with the Comprehensive Plan in that it is compatible with the area and surrrounding land uses; 2) The Weld County Engineering Department indicated there were no anticipated engineering problems; 3) The Weld County Health Department has indicated that the proposed operation is in conformance with all applicable State Health Standards and regulations; 4) The Cache La Poudre Reservoir Company has indi- cated the ditch company has no objections to the greyhound training track; 5) The applicant has submitted a petition form signed by the majority of the surrounding property owners. Page 1308 1 Development standards were read into record. Mr. Anderson explained that the cost of this track (without ground) is approximately $20,000. There will be no expansion in the number of dogs. Other trainers in the area will also use the track. Traffic will not be increased by this track. Mr. Anderson explained that training will be com- pleted by 10:00 each morning because the dogs can't run in the heat of the day. The track will be used as long as possible except for months when the ground is frozen. There is no other facility like this in Colorado. This facility was approved for Mr. Anderson' s own use and has already been constructed. Construction was started last April . Mr. Anderson does not feel that this will encourage other breeders to come into this area. RESOLUTION: Be it therefore resolved to recommend to the Board of County Commissioners, approval of this request for a dog training track. Motion by Bill Elliott. Seconded by Percy Hiatt. SEQ Sec. 3 T2N R68W SUBJECT: Extention of Zone Change "A" to "C" APPEARANCE: Clarence Evers DISCUSSION: Mr. Evers explained that the property was zoned "C" for only six months. Now he would like for it to be permanently zoned as Commercial . The property is for sale, but there is no specific plan for its use. Property all the way around it is zoned commercial . Ramada Inn is to the west of this property (Del Camino Area). Mr. Fortner explained that when this property was before the Commission several months ago it had been misrepresented as commercial several times because of the other zoning around it. Basically, there is no land there that can really be used for agricultural purposes. Weld County Planning staff recommends approval for the following reasons: 1 ) The original commercial zoning of the contiguous property to the east and a portion of this parcel did not conform to the proposed lines at the time of rezoning. (Part of the parcel was zoned C and part A); 2) The proposed change of zoning is com- patible with surrounding zoning which is all commercial ; and 3) The proposed change of zone would not effect the commercial value of any gravel deposits because of the small acreage involved and be- cause all surrounding zoning prohibits mineral extraction. RECOMMENDA- TION OF APPROVAL IS CONDITIONAL UPON: 1 ) The applicant shall sub- mit a final site plan and construction schedule to be reviewed by the Weld County Planning Commission and approved by the Board of County Commissioners prior to development on the subject property; 2) The applicant shall comply with all of the conditions under which the commercial zoning was granted except that the subject property shall have a permanent commercial zoning classification. The Facility shall be utilized by any kennel owner who has greyhound pups to start and train. Only dog owners and their trainers shall be allowed at the facility. No overnight boarding of dogs shall be permitted. 2. The track surface will be a sand/loam material . All surface areas other than the track will be seeded with fairway wheatgrass. A single row windbreak of cottonless cottonwoods spaced at 15 feet will be planted on the North and Northwest side of the area as shown. Maintenance will be as per Soil Conversation Service recommendations. 3. No lighting will be provided with exception of security lights as shown on the plans. 4. Fencing around the tract (outside land) will be standard chain link fence, 42" in height. Inside rail will be 2" x 10" treated rail set on treated 6" half posts 8 feet apart. 5. No domestic water or sewer service will be installed on the permit area. 6. Access will be via an existing access from County Road #70 as shown. Parking will be graveled. 7. Raising greyhounds is a business in which I have engaged since 1967. Fortunately we have been able to raise some reasonably successful dogs. However, the most serious weakness in our program and the program of other persons with whom we work lies in the area of training. Training is required if the dogs are to perform properly at the track. Myself and other persons in the area who raise racing dogs require a facility for the purpose of familarizing the dogs with the kind of performance which will be expected when they reach a commercial dog track. As you know, I have taken great pains and spent a considerable amount of money in order to create a schooling track or training facility for dogs which may potentially enter track competition. It would be plainly unfair to the dogs, the spectators, and the breeders should the dogs be forced to enter track competition unprepared. Myself and other people who work in the business of breeding fine dogs for the purpose of racing, must survive economically. This can not be accomplished without a good sound ability to compete. In order to compete, our dogs must be trained prior to entering formal competition. I believe we can assume that with more adequate training of our animals, greater revenues will be generated and, (taxes are paid on those revenues), thus benefiting both persons who attend the dog track and those persons who do not attend. I am certain that you are also aware that we have received no objections from any person living in our vicinity regarding the schooling track. I sincerely hope that you will see fit to permit the schooling of racing dogs on my premises and under my auspicies and for the purpose I have stated. I thank you for your kind consideration.
