RE: APPROVE ACCEPTANCE OF DEED OF DEDICATION FOR PUBLIC HIGHWAY AND
AUTHORIZE CHAIR TO SIGN NECESSARY DOCUMENTS - STEVEN WINICK
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Deed of Dedication for Public Highway
for a portion of County Road 23 between the County of Weld, State of Colorado, by and through
the Board of County Commissioners of Weld County, on behalf of the Department of Public
Works, and Steven Winick, 11083 Highway 14, Ault, Colorado 80610, with terms and conditions
being as stated in said deed of dedication, and
WHEREAS, after review, the Board deems it advisable to accept said deed of dedication,
a copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Deed of Dedication for Public Highway for a portion of County Road 23
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Department of Public Works, and Steven Winick
be, and hereby is, accepted.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign any necessary documents.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 25th day of November, A.D., 2013.

DEED OF DEDICATION
FOR PUBLIC HIGHWAY
THIS DEED, made this ol5 day of& , 2013, between Steven J. Winick, "Grantor" whose
legal address is 11083 Highway 14, Ault, Colorado 80610, and the County of Weld, a body corporate
and politic of the State of Colorado, through its Board of County Commissioners, (Grantee), whose
legal address is 1150 "O" Street, Greeley, Colorado 80631:
WITNESSETH: That Grantor, for and inconsideration of the sum of Ten Dollars and no/100
$10 the receipt and sufficiency of which is hereby acknowledged, does, pursuant to Colorado
Revised Statute §43-2-201(1)(a), hereby dedicate and convey forever unto Grantee for use as a
Public Highway, free and clear of all liens and encumbrances and warrants title to that real property
lying and being in the County of Weld, State of Colorado, to wit:
The real property described and shown if the attached Exhibit "A"
EXCEPTING existing easements of record, and
RESERVING unto Grantors the mineral estate under said property, including oil, gas and any
and all water rights currently ached or associated with said property, except as required to sustain

LEGAL DESCRIPTION
Right-of-way to be Dedicated for Weld County Road 23
A parcel of land located in a portion of Lot B of Weld County Recorded Exemption
0705 -12 -3 -RE -277 as recorded in Book 810 under Reception number 173621, situated in the
Southwest Quarter of Section 12, Township 7 North, Range 67 West of the Sixth Principal
Meridian, Weld County, Colorado, more particularly described as Follows:
the West line of the Southwest Quarter of said Section 12 was assumed to bear North
00°39'42" East, between the Southwest corner of said Section 12 as found monumented with a
number 4 rebar in a monument box and the West Quarter corner of said Section 12 as found
monumented with a 3-1/4" aluminum cap on a #6 rebar by LS 4392, with all bearings contained
herein relative thereto.
Commencing at the Southwest corner of said Section 12 thence North 00°39'42" East,
along the West line of said Southwest Quarter, a distance of 47.00 feet to a point on the
Northerly right-of-way line of Colorado State Highway No. 14 as described in a Deed recorded
in Book 1484 at page 603 under reception no.1260723;
thence North 90°00'00" East, along said Northerly right-of-way line, a distance of 109.13 feet to
a point on a non tangent curve, said point being the POINT OF BEGINNING;
thence northwesterly along the arc of said non -tangent curve to the left, the center of which
bears North 90°00'00" West, having a central angle of 25°55'46" and a radius of 144.66 feet, an
arc length of 65.47 feet, the chord of said curve bears North 12°57'53" West a distance of 64.91
feet;
thence North 25°55'46" West, a distance of 209.62 feet to a point on the West Line of the
Southwest Quarter of said Section 12;
thence North 00°39'42" Fast, along the West line of the Southwest Quarter of said Section 12, a
distance of 526.36 feet, to the Northwest Corner of Lot B of said Recorded Exemption RE -277;
thence South 54°10'59" East, along the North line of said Lot B a distance of 36.69 feet;
thence departing said North line, South 00°39'42" West, along a line parallel to and 30.00 feet
Fast of the West line of said Southwest Quarter, a distance of 401.34 feet to a point on a tangent
curve to the left;
thence southeasterly along the arc of said curve to the left, the center of which bears South
89°20'18" East, having a central angle of26°35'28" and a radius of 126.03 feet, an arc length of
58.49 feet, the chord of said curve bears South 12°38'02" East a distance of 57.97 feet;
thence South 25°55'46" East, a distance of 232.69 feet to a point of curve to the right:
thence southerly along the arc of said curve to the right, having a central angle of 25°55'46" and
a radius of 204.66 feet, an arc a length of 92.62 feet, the chord of said curve bears South
12°57'53" East a distance of 91.83 feet, to a point on the Northerly right-of-way line of said
State Highway No. 14;
thence North 90°00'00" West, along said Northerly right-of-way line, a distance of 60.00 feet to
the POINT OF BEGINNING.
Containing 33,333 square feet or 0.7652 acres, more or less.
