Mr. and Mrs. Ellis own property located on Weld County Road 25.5 ("CR 25.5"), which is approximately 500 feet north of the proposed site. There are two parcels between the proposed site and the Ellis's property, a vacant parcel owned by Ram Land Co, LLC, and a parcel with a single family home on it owned by the Ruggles. The Ruggles property sits immediately North of the proposed site. Mr. and Mrs. Ellis purchased their property on CR 25.5 with the intention of constructing their own single family home to enjoy the peace and quiet offered by residential land in the County. The proposed use indicated in the USR application raises several concerns for Mr. and Mrs. Ellis. The Site The application proposes to change the use on a parcel of property located at the northwest corner of the intersection of County Road 40 ("CR 40") and CR 25.5 (the "Site") to a commercial use, for the intended use as an oil and gas service company, equipment storage, repair and maintenance facility. Diana Aungst, Planner September 19, 2013 Page 2 of 7 Weld County Code Sec. 22-2-90 provides guidelines and standards for commercial development in the County as follows: Sec. 22-2-90. Commercial development. A. The purpose of commercial development Goals is to characterize, by intensity, those areas throughout the County for retail, offices, services and other similar uses. Commercial uscs arc primarily located along major roadways, at major intersections and in commercial parks designed to accommodate these uses. When of an appropriate scale that accounts for pedestrians and public space, limited commercial activity is also appropriate within neighborhoods. B. These commercial Goals and Policies intend to further enhance and solidify the economic base of the County. It is critical to attract sustainable commercial growth and economic development. This is achieved by accommodating patterns that neither undermine the quality of life for County citizens, nor compromise the viability of the agricultural and industrial economies. C. Generally, commercial development is located within or adjacent to existing urban areas. D. Regional commercial activity, which has impacts on multiple jurisdictions and the County, should be developed in a culture of collaboration. By respecting the differences in their values and policies, municipalities and the County can create the best possible development and improve the delivery of services. E. Neighborhood commercial development provides locations for uses that supply conveniences, goods and services for residents of the immediate area. It should typically link to transportation networks, while minimizing traffic and parking problems for the adjacent residences and promoting compatibility between such commercial areas and nearby residential areas. The design, scale and scope of commercial facilities are particularly important when neighborhood commercial uses are planned. (Weld County Code Ordinance 2002-6; Weld County Code Ordinance 2008-13) Presently, the site does not meet any of the development standards as identified in Sec. 22-2- 90. First and foremost, the site is not located along a major roadway, at a major intersection or in a commercial park. The site is in fact located along a county road that is roughly' mile from the nearest major roadway, Highway 60. There is no commercial development in the immediate area that would be at all similar to the proposed use. The application alleges that there are also uses related to "oil/gas equipment storage" surrounding the site. A quick overview of surrounding uses reflects that there are some oil/gas well Diana Aungst, Planner September 19, 2013 Page 3 of 7 heads and a few storage tanks in the immediate vicinity. However, it does not appear there are any oil/gas equipment storage uses nearby. We would request that the applicant provide greater information and detail regarding the oil/gas equipment storage uses the applicant believes are surrounding the site. Without substantial mitigation efforts and requirements being established by the county in connection with the USR, the proposed use at this site will compromise the quality of life for the County citizens living near the site and living along CR 40 and CR 25.5 as the site is located immediately adjacent to a residence and will be within 500 feet of a future residence. Furthermore, the proposed use indicates that it will bring 35 to 40 vehicles and pieces of equipment to the site that will travel along county roads comprised of a dirt road base, much of which are heavy trucks. The proposed number of oil/gas service vehicles indicated will alone substantially increase traffic along CR 40 to somewhere around 80 to 120 trips per day at a minimum. The applicant does not appear to have accounted for the number of trips employees will make in their personal cars and the total impact or total number of trips that will be made along CR 40. It is important to note that there is only one means of ingress and egress along County Road 40 east to Highway 60. There is no access out of the area to the west on CR 40 or to the north on CR 25.5. Therefore the entire burden of traffic will be borne by the half mile stretch of CR 40 to Highway 60. Roadway and Traffic Safety The applicant is proposing to bring a mix of 38 ton and 28 ton trucks along County Road 40 from Highway 60 to the Site. Therefore there needs to be sufficient accommodations for safety to the public traveling along both CR 40 and Highway 60 for any of the large vehicles that are proposed to be accessing the site. Given that the CR 40 and CR 25.5 currently consist of only about a 20 foot wide road base, with irrigation ditches at various points substantial consideration needs to be given to how best protect the traveling public. This is especially true given that the vast majority of uses around the site are agricultural uses that require the use of CR 40 and CR 25.5 to transport farming equipment between sites. Perhaps more important is the safety concerns raised by the intersection of CR 40 and Highway 60. At present this is a uncontrolled intersection with no accommodations for or warnings regarding traffic crossing or turning onto or from Highway 60 off of CR 40. To that end Sec. 23-2-240 provides for a means of providing safe ingress and egress from the facility and surrounding streets: Diana Aungst, Planner September 19, 2013 Page 4 of 7 Sec. 23-2-240. Design standards. A. An applicant for a Use by Special Review shall demonstrate compliance with the following design standards in the application and shall continue to meet these standards if approved for DEVELOPMENT. 8. The access shall be located and designed to be safe; ingress and egress shall not present a safety hazard to the traveling public or to the vehicle accessing the property. For USES generating high traffic volumes and large number of large, slow -accelerating vehicles, acceleration and deceleration lanes may be required to mitigate a potential traffic hazard. A review of some USR applications over the past several years reflects that the County has indeed used this design standard in reviewing USR#1614, USR#1604, USR#1661 and USR#1665. Each of those applicants was required to make significant improvements to existing roadways and intersections to accommodate higher traffic volumes and to accommodate heavy equipment and trucks. Specifically, the County required those applicants to install acceleration and deceleration lanes and to improve road surfaces as well as widen certain roadways to accommodate the type of truck traffic that is proposed in this application. It is also important to note that the existing road surface on CR 40 is dirt and is therefore subject to substantial rutting and erosion during wet months and generates significant dust and dirt during dry months. With such a substantial increase in heavy truck traffic each of these scenarios will only be magnified and worsened, without CR 40 being paved. Without a completed site plan it is also difficult to determine how the intersection of CR 40 and CR 25.5 will be used or impacted by this use. The intersection of CR 40 and CR 25.5 is a small intersection that is not designed to or intended to handle 120 trips of heavy truck traffic. Given the dynamics of a heavy truck making such a turn on dirt, the intersection of CR 40 and CR 25.5 will be subject to substantial erosion, rutting and deterioration. At present, the roadway along CR 40 and the intersection at Highway 60 are wholly insufficient to accommodate the increased in heavy truck traffic proposed by this application. We therefore would request that the County require the applicant to obtain a traffic study from the Colorado Department of Transportation, and then make significant improvements to CR 40, Highway 60 and the intersection of CR 40 and Highway 60 to include paving of CR 40, widening of both CR 40 and Highway 60 and the installation of acceleration and deceleration lanes at the intersection of CR 40 and Highway 60. Ifire Safety The applicant has made no mention of fire mitigation or fire safety standards that are or will be met at the site. Despite the fact that the applicant intends on using the site to store vehicles that arc used in the oil and gas industry and will therefore likely have residual hydrocarbons in them, on Diana Aungst, Planner September 19, 2013 Page 5 of 7 them and around them, the applicant states only that "Fire protection at the site" consists of "Platteville Fire Protection District." The applicants answer to this requirement is wholly insufficient, and in fact is not an answer to the design requirement. To that end, Sec. 23-2-240 requires that the applicant provide adequate fire protection on site as stated in the following design standard: Sec. 23-2-240. Design standards. A. An applicant for a Use by Special Review shall demonstrate compliance with the following design standards in the application and shall continue to meet these standards if approved for DEVELOPMENT. 4. Adequate fire protection measures are available on the site for the STRUCTURES and facilities permitted. The applicant has given no indication of how this standard will be met "on the site". Hours of Operation The applicant proposes to use the site for truck traffic 24 hours a day, 7 days a week. This level of use and traffic in and out of the site poses a significant hardship on the surrounding residential uses as it will involve large, loud trucks traveling on dirt road ways, generating significant dust, and shining headlights and overhead parking lights into neighboring homes. If the County is to allow the application to go forward, the County must place sufficient and reasonable restrictions on the hours of operation to mitigate noise pollution, light pollution and dust as required in Sec. 23-2-160 which provides that the applicant must demonstrate that it will comply with the following standards: 1. Noise. USES and STRUCTURES in the COMMERCIAL and Industrial Zone Districts shall be located, designed and operated in accordance with the noise standards as established in Section 25-12-101, C.R.S. 2. Air Quality. USES in the COMMERCIAL and Industrial Zone Districts shall be located, designed and operated in accordance with the air quality standards established by the Colorado Air Pollution Control Commission. 3. Water Quality. USES in the COMMERCIAL and Industrial Zone Districts shall be located, designed and operated in accordance with the standards established by the Colorado Water Quality Control Commission. 4. Radiation and Radioactive Materials. The handling, USE, storage and processing of radioactive materials shall be in accordance with the applicable regulations of the State and the United States government. USES located within the COMMERCIAL and Industrial Zone Districts shall not emit heat in such an amount sufficient to raise the temperature of the air or of materials at or beyond the LOT line more than five degrees (5°) Fahrenheit. 6. Glare. Any lighting USED to illuminate an OFF-STREET PARKING AREA, outside storage area, outside activity area, sign or other structure shall be arranged to deflect light away from any adjoining residential zone and from County roads. Any lighting, including light from high -temperature processes such as welding or combustion, shall be designed, located and operated in such a manner as to meet the following standards: sources of light shall be shielded so that beams or rays of light will not shine directly onto ADJACENT properties; neither the direct nor reflected light from any light source may create a traffic hazard to operators of motor vehicles on PUBLIC or private STREETS; and no colored lights may be used which may be confused with or construed as traffic control devices. The application does not demonstrate that the applicant will meet any of these standards at the site, much less how the applicant plans on mitigating any of these factors through 24 hour operations. Property Values The development codes do not have per se standards relating to the maintenance of property values in and around a particular development project or improvement. Instead, the development code, on the whole, is designed and intended to protect the concerns that adjacent land owners have regarding their property values. Such concerns exist in code sections such as Sec. 22-2-90, that is intended to ensure that commercial uses do not intrude into residential uses and thus negatively impact the property values of residential land owners. In fact, all of Chapter 23 of the Weld County code can be said to have a general purpose of ensuring that like uses are zoned together in a reasonable and logical fashion so as not to impact the value of one use or another. In this particular instance, the creation of a commercial use in the middle of surrounding residential and agricultural uses, and immediately abutting a single family residence, will have a substantial impact on surrounding property values. That degree of impact is in contravention of the intent and purpose of the development code. Conclusion Mr. and Mrs. Ellis would prefer not to see this site turned into a commercial site for the use of oil and gas heavy trucks and machinery. The use does not fit with the surrounding uses and there are more suitable sites located throughout the County that have better access and would have a significantly lower impact on surrounding residential uses. It would appear that this site was selected simply because Austin Peitz, Vice President of Operations, is the current owner of the site, not because this site offers any special accommodations. Diana Aungst, Planner September 19, 2013 Page 7 of 7 Mr. and Mrs. Ellis request that the County deny the application for a USR filed by Heat Wave Oil Services. My first husband and I purchased our property at 11258 County Road 40, Platteville in 1975. We built our dairy barn and home to establish our dairy and crop farm. We enjoyed the peace and quiet until the gas wells moved in. We didn't want them on our property, but were told we had no choice, our property would be condemned — the state owned the mineral rights. I would also add that, although the roads were dirt roads, they were kept graded and were in excellent condition — until the gas well companies and A & W Water trucks began traveling them. Now they are in totally abysmal condition! In 2003 our neighborhood fought against the gravel pit off of Road 38 and Road 23'A . Weld County Planners and Commissioners had the wisdom, knowledge, experience and foresight to turn down the gravel pit for which we were very appreciative. The gravel pit got in anyway, but later went defunct. Now, my present husband and I have been informed that we are facing the possibility of the Heat Wave Truck Garage, a commercial property use, going in at County Roads 25 %z and 40. These roads cannot absorb the endless traffic and hours of operation that would result! Our area is comprised of farm property and personal residences and as I mentioned earlier, the condition of these roads are horrendous, are narrow, lack any lighting and need to be driven on at very low speeds. In the winter months we are often snowed in due to blowing, drifting snow as we are on an east west road. Even, after being plowed they often drift shut again due to the wind. At these times, we are reduced to one lane traffic. Once again, we find ourselves asking that you consider our situation and request your help when evaluating this major change of land use mixed in with our residential/farm neighborhood. Please do not allow Heat Wave Garage to build in this neighborhood! Thank You! The road dust abatement, rutting and deterioration is a year around issue, as mentioned in other documents. The snow and winter deterioration issues are also of concern. We are in an open area and the storms tend to cause much drifting on the roads here. It is not uncommon to be "snowed -in" several times a year. Then the roads become very wet and the large trucks cause extra rutting and potholes. Severe drifting has caused vehicles to become stuck and they, as well as roadgraders, then cause damage to the fences and landscaping. We think that Heat Wave should include a road paving, or road maintenance plan for all the affected roads in this neighborhood. Historically, large trucks in the oil industry will go around certain restricted roads for a short while and then tear up all of them. Even after reprimands they will go where they wish. Examples can be made if necessary. They have torn up fences on short turns and have damaged culverts and irrigation pipes. A yet another guard rail repair has just been installed at the corner of Hwy 60 and Road 40. We do not feel that our tax dollars should be used in this way. Nor do we feel that we should have to pay for repairs on our vehicles that are caused by the problems of bad roads created by traffic that they were never designed to carry. 2. Speed control is another large issue. These truck drivers don't live here and don't realize how dangerous and how noisy they are. They often don't even slow down when passing by anyone on the roads. No one wants to listen to them coming in and changing gears at all hours of the day and night. No jake brakes! We have called A&W several times about their drivers honking their horns and parking in undesignated areas, especially at very early morning hours. Sound carries easily in the country! 3. Fencing. We feel that we have not been honored with the intentions stated in other dealings within this industry. We would ask for at least 8' high solid fencing around the perimeter, of earthtone color, either of metal or of wood. The fencing should be setback off the Right of Way and other landscaped areas. 4. Landscaping. This garage as stated in the permit application will be a total eyesore. There should be bushes and trees on a berm with a mix of 4" to 6" diameters, planted on the perimeter and watered with a drip line irrigation, between the ROW and the fenced yard. Dead trees are also ugly and must be mitigated. 5. Lighting. They want to run as they wish at all hours of the day and night with no concern about intrusive lighting from the trucks and the yard. There should be minimal lighting, not more than normal farm yard single light. Trucks should maintain low enough speeds to not use bright lights. Yard lights should be down cast and ground level. 6. The buildings should be also of earthtone color. The Housing trailer should be new and be maintained as a home would expected to be. 7. Repair work at night must be muffled by being inside a closed building. Welding, clanking and use of air gun tools is not conducive to good sleep. Again, we already deal with some early morning noise here with A&W and don't wish any more. 8. We hope the Environmental Department is looking very hard at all the hazardous materials used and stored at this site. The recent flood is a good example of the possible contaminations so easily possible. One of us also bought a piece of land with soil contamination undisclosed at time of purchase. The decontamination process is now in its third year and we cannot use this land until it is complete. Do they really need 900 gallons of hazardous materials stored on site along with trucks carrying thousands of gallons propane? Are they bonded and insured to pay for any contamination? What about the water wells adjacent to the area? What about crops grown on contaminated land? There is much extended liability involved beyond their gates. 9. From historical experience, we want all details to be communicated in written form, with penalties expressed before this business is allowed to exist in our rural neighborhood. We are extremely thankful to the commissioners for their thoughtful rejection of the quarry/sand pit. Hot Oil Heating Trucks- 6- These trucks typically exit and return to the applicant site only one time per day on the average. Water Tank Trucks- 8- These trucks typically exit and return to the applicant site only one time per day on the average. Truck Driver Personal Vehicles- 20- These vehicles typically arrive and leave the applicant site only one time per day on the average. Office/Shop Staff Personal Vehicles- 5- These vehicles typically arrive and leave the applicant site only one time per day on the average. The typical and high operating season for this service business is between October 1 and April 30 and when the maximum vehicle travel will occur. From May 1 to September 30, 23 of the 30 service vehicles will be parked at the applicant site. During this period most of the truck drivers will not be working thus the personal vehicle count will be decreased accordingly. During the high operating season the maximum estimated daily vehicle count accessing the site will be approximately vehicle 39 trips in and 39 trips exiting. During the low season the estimated daily vehicle count will average approximately 8 service vehicle trips in and exiting and 13 personal vehicle trips in and exiting. 3.
