HEARING CERTIFICATION DOCKET NO. 2013-41 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR13-0022, FOR A MINERAL RESOURCE DEVELOPMENT FACILITY, OIL AND GAS SUPPORT AND SERVICE, INCLUDING STORAGE OF PIPE AND PRODUCTION EQUIPMENT AND ANY LNG RELATED USE PERMITTED AS A USE BY RIGHT, ACCESSORY USE OR USE BY SPECIAL REVIEW IN THE COMMERCIAL OR INDUSTRIAL ZONE DISTRICT; AND A TRUCK PARKING AREA IN THE A (AGRICULTURAL) ZONE DISTRICT - NOBLE ENERGY, INC. A public hearing was conducted on July 17, 2013, at 10:00 a.m., with the following present: Commissioner William F. Garcia, Chair Commissioner Douglas Rademacher, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Barbara Kirkmeyer Also present: Acting Clerk to the Board, Susan Brown Assistant County Attorney, Brad Yatabe Planning Department representative, Kim Ogle Public Works representative, Heidi Hansen Health Department representative, Mary Evett The following business was transacted: El I hereby certify that pursuant to a notice dated June 14, 2013, and duly published June 19, 2013, in the Greeley Tribune, a public hearing was conducted to consider the request of Noble Energy, Inc. for a Site Specific Development Plan and Use by Special Review Permit, USR13-0022, for a Mineral Resource Development Facility, Oil and Gas Support and Service, including storage of pipe and production equipment and any LNG related Use permitted as a Use by Right, Accessory Use or Use by Special Review in the Commercial or Industrial Zone District; and a truck parking area in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. El Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. He said reviewed the referral responses and submitted as a memo, marked Exhibit H, requesting three modifications: delete Conditions of Approval #5.A - #5.H, Development Standard #25, and modify Development Standard #26 to reflect the language in the memorandum, because this is new standard language. The "shall" will also become "may" by assent of the Board. la Heidi Hansen, Department of Public Works, provided a brief overview of the transportation plans and requirements. (USR13-0022) PAGE 2 reviewed traffic counts on each. She reviewed the haul route (same as the water depot to the north, not going through the Town of Gill) and said an improvements agreement with triggers is required. She also said there will be changes to the wording of Development Standard #19. a Mary Evett, Department of Public Health and Environment, reviewed the water and sewer provisions and requirements. She noted that an air permit may be required, but LNG facilities typically do not require one. e Vince Harris, Baseline Corporation, representing the applicant, stated this is a new storage facility to meet Noble Energy's expanded needs. He said the second component of the site, a mobile LNG fueling station with 24 hour access, will be for Noble Energy's vehicles only. He reviewed the site plan, access, gates and fencing/security, and the haul route. He said the screening plan consists of an open fence around the entire facility. He said they have solicited comments from the closest neighbors and only one responded and expressed concern about a potential for explosions. Mr. Harrison referred to potential fuel hazards (flash -fires versus explosions), explained the safety mechanisms in place, and provided hand-outs, entered into the record as Exhibit G. He said he has reviewed the Conditions of Approval and Development Standards and has no issues with them. His PowerPoint presentation was entered into the record as Exhibit D. • No public testimony was offered concerning this matter. • Mr. Ogle said the entrance to the facility was primarily what staff recommends be screened and Mr. Harris confirmed they are working on a plan to keep headlights from shining toward neighbors' homes. Chair Garcia recommended the deletion of Conditions of Approvals #5.A — 5.H and Commissioner Rademacher requested that #1.E be modified to state "for security purposes"; these changes were made by assent of the Board. Development Standard #20, regarding landscaping, was discussed at length - Commissioner Conway stated this should remain between the applicant and the property owners. Mr. Harris said he was fine with a short area of opaque fence to screen neighbors from headlights. After further discussion, a sentence to the effect of "screening will not interfere with the provision of security for the property" was added by concurrence of the Board to Condition of Approval #1.E. Commissioner Kirkmeyer requested an additional condition stating the applicant will meet with the Fire Department in the area and with Roy Rudisill, of the Office of Emergency Management, to address concerns they may have, and this was placed under Condition of Approval #1.H, by assent of the Board. Mr. Harris said that is acceptable. Chair Garcia suggested the deletion of Development Standard #25, with #26 to be amended as noted above. Commissioner Rademacher verified the number of employees was adequate. In response to Chair Garcia, Mr. Harris said he and the applicant have reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as amended. Commissioner Kirkmeyer moved to approve the request of Noble Energy, Inc. for a Site Specific Development Plan and Use by Special Review Permit, USR13-0022, for a Mineral Resource Development Facility, Oil and Gas Support and Service, including storage of pipe and 2013-1793 PL2227 HEARING CERTIFICATION - NOBLE ENERGY, INC. The motion was seconded by Commissioner Conway, and it carried unanimously. There being no further discussion, the hearing was completed at 11:28 a.m. This Certification was approved on the 22nd day of July, 2013.
