The Weld County Council met in regular session in full conformity with the Weld County Home Rule Charter at 401 N. 15th Avenue, Greeley, Colorado, on Wednesday, October 20, 1976 at the hour of two o'clock. ROLL CALL: The meeting began with an invocation by President John T. Martin. On roll call the following were present: President John T. Martin Vice President Nancy Clark Councilman Floyd Oliver Councilman Bob E. White Councilman Robert Martin Also present: Bonnie Hickman, secretary; Commissioner June Steinmark; District Attorney Robert Miller; and two members of the press. MINUTES: The minutes of October 6, 1976 were passed unanimously by motion of Nancy Clark and second by Floyd Oliver. REPORTS COUNTY CHARTER AMENDMENT: Nancy Clark reported she had received a written statement from County Attorney David regarding Charter Section 3-8-(4b). Mr. David suggested that Section 3-8-(4b) be written as follows - "Enact legislation including such means of enforcement thereof as shall be authorized by law and otherwise formally promulgate county policy. Unless otherwise required by statute, the board shall act only by ordinance in matters of legislation, appropriations and disposition of property. Approval of contracts under sub section (n) below shall be accomplished by the resolution of the board. In other matters the board shall act by ordinance resolution or motion as may be appropriate." Nancy Clark suggested that any action on this be delayed until after the November 2 general election and possibly then proposed before a county election. Mr. David is currently reviewing the Charter and has been invited to the November 17 Council meeting to discuss any other problems he might find in the Charter. EXECUTIVE SESSION POLICY: Nancy Clark stated she had discussed with District Attorney Bob Miller the legal aspects of executive session during Council meetings. Mr. Miller's response was that executive sessions 760690 _Zounty Council Minutes---- Page 2 October 20, 1976 of the Council may be held in accordance with C.R.S. 29-9-101 - ". .. may go into executive session for consideration of documents or testimony given in confidence but shall not make final policy decisions nor shall any resolution, rule, ordinance, regulation, or formal action approving a contract or calling for the payment of money be adopted at any session which is closed to the general public. " A motion was made by Nancy Clark, seconded by Bob White, that the Council include this statement in the rules of order of the Council. Motion carried unanimously. DISTRICT ATTORNEY: Bob White received a letter from District Attorney Bob Miller regarding a private business enterprise in which he and two associates, Bill Crosier and Wayne Leusink have planned to rent a house to the Crossroads of Weld County. Suspecting that there might be suspicion of a conflict of interest (since Crossroads is partially funded by the Department of Social Services) Mr. Miller requested an opinion from the Council on this matter. After discussing this with Mr. Miller, a motion was made by Bob White, seconded by Floyd Oliver (pursuant to Charter Section ]6-9) ruling that such a business transaction with the Crossroads of Weld County would not be a conflict of interest for Mr. Miller and his two associates. The Council voted four in favor and one, Nancy Clark, objecting. The motion carried. BUDGET: John Martin noted he had received an invitation by Glenn Billings for the Council to attend the Thursday, October 21, budget finalizing. The Council discussed what their role would be if they had to approve a 5% increase. EXECUTIVE SESSION: At this time the Council withdrew into executive session. NEWSPAPER SUBSCRIPTIONS: The Council reviewed the list of newspapers to which the office subscribes. Several were deleted and the Times-Call and the Windsor Beacon were added.
