HomeMy WebLinkAbout20130622.tiffRESOLUTION RE: APPROVE BYLAWS FOR THE CRIMINAL JUSTICE ADVISORY COMMITTEE AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the newly drafted bylaws of the Criminal Justice Advisory Committee have been presented to the Board of Weld County Commissioners for approval, and WHEREAS, the Board of Commissioners of Weld County deems it advisable to adopt said Criminal Justice Advisory Committee bylaws, and WHEREAS, the bylaws call for a designation of administrative support, and WHEREAS, after review, the Board deems it advisable to designate the Justice Services Division to serve in this capacity. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the bylaws for said advisory committee, be, and hereby are, adopted. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said bylaws. BE IT FURTHER RESOLVED by the Board that the Justice Services Division be designated to provide administrative support to said advisory committee. This Board at a recent Work Session previously reviewed these Bylaws. A question raised at that time was whether Human Services Director, Judy Griego would be available to serve on this committee as was originally contemplated in Article III_ She respectfully declined indicating that she would prefer to be considered on an ad hoc basis to support the committee's efforts. as requested. Please note that Article IX of these Bylaws denotes that this Board shall designate administrative support for the CJAC. The CJAC recommends that this Board specify its Justice Services Division to serve in this capacity. County Attorney. Bruce Barker and Chief Judge, James Hartmann have both reviewed these Bylaws. I recommend that you approve the CJAC Bylaws as presented and designate the Justice Services Division to provide administrative support as necessary. Thank you. 2013-0622 BYLAWS WELD COUNTY CRIMINAL JUSTICE ADVISORY COMMITTEE ("CJAC") Article I - Name of Committee The committee shall be called the "Weld County Criminal Justice Advisory Committee" (hereinafter referred to as "the Committee"). Article II — Purpose & Mission The purpose of the Committee is to serve as the primary planning body to formulate policy, and discuss and develop plans and programs for the criminal justice systems in Weld County and the 19th Judicial District. The Committee may make recommendations to the Board of Commissioners of Weld County and/or other Weld County/19th Judicial District justice agencies concerning important criminal justice matters and the delivery of local correctional services. Further, the Committee shall provide a forum for interagency coordination of criminal justice services in Weld County. It will seek to develop long range strategic planning and make recommendations for justice system efficiency. This requires ongoing and continuous study of the Weld County and 19th Judicial District criminal justice systems seeking continuous improvement of comprehensive strategic management/planning and systems case processing. Article III — Membership Composition: A. The Committee membership shall include: 1. A Weld County Commissioner; 2. The Chief District Court Judge for the Nineteenth Judicial District; 3. A presiding Weld County Court Judge for the Nineteenth Judicial District; 4. The District Attorney for the Nineteenth Judicial District; 5. The Weld County Sheriff; 6. The Chief Public Defender for the Nineteenth Judicial District; 7. The President of the Weld County Chiefs of Police organization CJAC Bylaws Page 1 of 6 >pc/.3-Od.a,2 8. The City of Greeley Police Chief; 9. The Chair of the Weld County Community Corrections Board; 10. The Chief Probation Officer for the Nineteenth Judicial District Probation Department; 11. The Northeast Parole Office Supervisor; Colorado Department of Corrections; 12. The Director of North Range Behavioral Health; 13. An attorney specializing in criminal defense and is a legal resident of Weld County; 14. The District Administrator for the Nineteenth Judicial District; and 15. The Director of the Weld County Justice Services Division. Appointment of Members —members of the Committee shall become so by virtue of the position held or be appointed by the group or entity, which they represent. C. Terms of Membership —Membership shall be for the term of appointment, for as long as the position listed in Subparagraph A, above is held. Membership shall not be limited in number however, all appointments must be in accordance with the terms and conditions set forth in the Weld County Home Rule Charter. D. Alternate Member —each member may designate one (1) alternate member who may attend Committee meetings in the member's absence. 1. Any member wishing to designate an alternate member must identify the alternate member in written correspondence addressed to the Committee Chair. Alternate members can be changed only by notifying the Committee Chair in writing. E. Member Duties —Members shall perform their duties, including participation on sub committees upon which they may serve, with utmost care and professionalism. Members shall: 1. Regularly attend and actively participate in meetings (not missing more than three (3) Committee meetings a year); 2. Serve on subcommittees as needed; 3. Remain informed and vote on matters before the Committee, and CJAC Bylaws Page 2 of 6 4. Distribute and disseminate information on the work of the Committee, as needed. Member Resignation— any member who wishes to resign is encouraged to provide a written resignation to the Committee Chair at least thirty days prior to the next scheduled meeting, if possible. Vacancies shall be filled in accordance with procedures set forth herein. Conflict of Interest —a member(s) shall not vote in a decision in which that member(s) has a private pecuniary interest. Member(s) must fully disclose possible conflicts of interest to the Committee or Chair as soon as such potential conflicts become apparent. H. Ex Officio Members --Ex Officio membership may be offered to others interested in participating in the activities of the Committee. An individual interested in becoming an ex -officio member must petition the Committee Chair in writing indicating their commitment, desire and rationale for becoming an ex -officio member. Final determination shall be made by majority vote of the Committee. If necessary, final determination shall be made by the Weld County Board of Commissioners. Ex Officio members are non -voting members of the Committee. Article IV — Officers, Powers and Duties A. The Committee shall elect from its own members a Committee Chair and Vice -Chair. The term of office shall be for two (2) years and the Chair and Vice -Chair are eligible to run for additional terms. The nomination and election of Committee officers shall be held during the first regular meeting of the Committee of the calendar year in which an Officer's term of office is scheduled to end. A member in good standing must second each nomination. Elections shall be by written ballot unless there is only one person nominated for the office, in which case the vote may be through oral motion and vote. A simple majority (51%) of members nominating and electing an officer(s) shall constitute formal nomination and election procedures. B. In the absence of the Committee Chair, the Vice -Chair will act in that capacity. C. In the absence of the Committee Chair and the Vice -Chair, a temporary Chair will be selected by majority vote of the Committee. D. A Secretary will be appointed by the Committee Chair. It shall be the responsibility of the Secretary to send notices of all meetings to members, and retain minutes of all such meetings and inform the Board of County CJAC Bylaws Page 3 of 6 Commissioners of Weld County of the names of Committee membership, their terms, and the names of the groups or entities they represent. E. Chair —shall at a minimum: 1. Preside at each Full Committee meeting; 2. Engage Committee members and keep them informed of matters pertaining to their responsibilities; 3. As needed, represent the Committee and speak on its behalf at various events/ meetings, or designate another member in the Chair's absence; and 4. Sign correspondence and / or other official documents on behalf of the Committee. F. Vice Chair —shall at a minimum: 1. Carry out all duties of the Chair in his/her absence; and 2. Serve on any subcommittees by appointment of the Chair. G. Removal of Officer(s)—any officer(s) elected or appointed by the Committee may be removed by majority vote of the Committee at a regularly scheduled Committee meeting because the member has failed to perform the duties detailed in Section III. E, above. Article V - Meetings A. Regular meetings of the Committee will be conducted quarterly at a location(s) and time(s) scheduled on the second Tuesday of January, April, July, and October, and/or as otherwise noticed pursuant to Section V. B., below. B. Written notice of all regular meetings will be provided to members at least one (1) week prior to the Tuesday meeting date. C. Special meetings may be called when deemed necessary by the Committee Chair or designee. D. The Committee shall annually review its current strategic plan, modify the plan when appropriate, and identify initiatives consistent with its overall purpose and mission. E. Robert's Rules of Order, Newly Revised shall prevail to the extent they are not in conflict with specific provisions of these Bylaws. CJAC Bylaws Page 4 of 6 Article VI - Voting A. Each Committee member has one (1) vote. Alternates may vote on behalf of a member if the member has identified them in written correspondence to the Committee Chair. B. A quorum shall consist of two thirds of the voting members of the Committee. A majority vote (51%) of the membership shall constitute decision -making powers unless otherwise noted. Article VII — Open Meetings All meetings, accounts and records of the Committee and any of its subcommittees shall follow all provisions of the Open Meeting Requirements of the Colorado Sunshine Law, as promulgated in § 24-6-402, C.R.S. Article VIII — Subcommittee(s) To serve the interest of the Committee, and upon its consensus, the Committee Chair or designee may establish a subcommittee(s). A. Members of a subcommittee(s) shall be appointed by the Committee Chair or designee. Ex Officio members may volunteer to participate as approved by the Chair or designee. B. A subcommittee(s) shall designate a Subcommittee Chair. The Subcommittee Chair's powers and duties shall include: 1. Set and conduct a meeting at least once every two months; 2. Review and approve the agenda; 3. Preside at all subcommittee meetings; 4. Continually address the goals and objectives of the subcommittee in relation to the Full Committee; and 5. Report activities, progress, outcomes and make recommendations of the subcommittee(s) to the Full Committee. Article IX — Administrative Support Weld County Government, as specified by the Board of Commissioners of Weld County, shall provide administrative support to the Committee, as designated and necessary. Duties shall include: A. Collaborate with the Committee Chair to set agendas, meeting times/dates and location(s); CJAC Bylaws Page 5 of 6 B. Maintain schedules and inform members of all committee meetings and activities; C. Take all minutes of all Committee proceedings and distribute to members; D. Maintain/update membership rosters, files, documents and Bylaws for the Committee; E. Assist new members; and F. Honor and preserve the purpose and mission of the Committee. Article X —Amendment of Bylaws Any amendment(s) to the Bylaws shall be included on the Committee's agenda of a regularly scheduled meeting. A proposed amendment(s) shall be distributed in writing to members of the Committee in advance of the regularly scheduled meeting. The Board of Commissioners of Weld County must also approve amendments approved by the Committee prior to becoming effective.
