MEMORANDUM TO: Kim Ogle, Planning Services FROM: Lauren Light, Environmental Health SUBJECT: USR13-0032 Public Service Co. DATE: 9/24/2013 Environmental Health Services has reviewed this proposal for a Site Specific Development Plan and Special Review Permit for a major facility of a public utility (one 115 KV transmission extending approximately 2.5 miles) in the A (Agricultural), R-1 (low density Residential) and 1-3 (Industrial) zone districts. Permanent water and sewer is not required as this is a temporary construction use. Portable toilets, hand washing units and bottled water can be utilized during construction of the pipeline. The application indicates that dust suppression will consist of applying water and revegetation of disturbed areas. An Air Pollution Emission Notice (APEN) may be required if the amount of disturbed area exceeds 25 acres. All construction materials, waste, and debris will be removed from the project area in a timely manner. Waste will be kept in dumpsters and taken to a permitted waste disposal facility. We have no objections to the proposal; however, we recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The facility shall operate in accordance with the approved "waste handling plan", at all times. 4. Fugitive dust and fugitive particulate emissions shall be controlled along the construction route. The facility shall operate in accordance with the approved "dust abatement plan", at all times. 5. Adequate toilet facilities (portable toilets) and handwashing units shall be provided during construction of the project. 6. Bottled water shall be utilized for drinking during construction of the project. 7. Environmental Protection Measures for Construction Projects, as identified in Appendix B of the application, shall be adhered to. 8. This facility shall adhere to the maximum permissible noise levels allowed in the Non -Specified Zone as delineated in Section 14-9-30 of the Weld County Code. 9. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. 10. The facility shall comply with the Air Pollution Emission Notice (A.P.E.N.) permit requirements as stipulated by the Air Pollution Control Division, Colorado Department of Public Health and Environment, as applicable. 11. The proposed preferred Route A is situated adjacent to future collector roadways, and therefore, this alignment will have a significant impact on the future roadway design and the visual impact on the future corridors. Therefore, the City of Greeley's preferred alignment is Route B. If Route B is not possible. then the design of either Route A or Route C shall incorporate the City of Greeley 2035 Comprehensive Transportation Plan which states that 1" Avenue (CR 41), Balsam Avenue. C Street (CR 62) and O Street (CR 64) will ultimately be two lane collector roadways with a right-of-way width of 90'.
