RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 293 - RENE MORGAN. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Commissioners of Weld County, Colorado at a public meeting held on the 12th day of December, 1977, in the Chambers of the Board of County Commissioners of Weld County, Colorado, that the div- ision into two parcels of a certain parcel of land, as shown on the flat known as Recorded Exemption No. 293, being the property of Rene Morgan, and being more particularly described as follows, to-wit: The West 60.00 acres of the West Half of the Northwest Wuarter of Section 23, Township 3 North, Range 66 West of the 6th P.M. , County of Weld, State of Colorado, more particularly described as follcws: BEGINNING at the Northwest corner of said Section; thence along the North line of said West Half South 89°23'16" East 977.71 feet to the East line of said West 60.00 acres; thence along said East line South 00°48'48" East 2670.16 feet to the East-West centerline of said Section; thence along said centerline North 89°50'19" West 977.55 feet to the West Quarter corner of said Section; thence along the West line of said Northwest Quarter North 00°48'48" West 2677.85 feet more or less to the point of BEGINNING. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado , and WHEREAS, the Board of County Commissioners has determined • at a public hearing held on the 7th day of November, 1977 in the Chambers of the Board of County Commissioners of Weld County, Colorado, that a certain parcel of land is owned by Rene Morgan, which land is more particularly described as follows , to-wit : Pt. NW'; of Section 23 , T3N, R66W of the 6th P.M. , Weld County, Colorado WHEREAS, the owners of said tract of land desire to obtain a variance from the minimum lot size requirement so that Mr. Morgan may make application to the Board of County Commissioners 4 to apply for a recorded exemption, as set forth in Section 9-4 . COLORADO 80631 COLORADO November 7, 1977 Board of County Commissioners Weld County, Colorado 915 - 10th Street Greeley , Colorado 80631 RE: Lot Size Variance i.49 Dear Commissioners : The attached letter and related materials are in reference to a request by 1 Rene Morgan for a lot size variance. The subject J property is described as i Pt . NWq of Section 23 , T3N, R66W of the 6th P. M. , Weld County, Colorado. Said property is located 31- miles east of Platteville . The property in question contains approximately GO acres of Class VI dryland soils. The request is to obtain a variance from the minimum lot size requirement , Section 9-4(a) (G) , so that Mr . Morgan can make application to apply for a recorded exemption. Section 9-4(a) (6 ) states : • "That the original tract or parcel of land to be divided under this section meets the minimum lot size requirements established by the Weld County Zoning Resolution ; variance from this requirement being allowed only upon good cause being shown to the Board of County Commissioners or where said tract or parcel of land lies within the Comprehensive Plan area of an existing' incorporated town of Weld County. (Revised 4-17-74 )" If this lot size variance is granted, Mr. Morgan will proceed with his appli- cation for a recorded exemption to divide the property into two lots. One lot is proposed to contain approximately 20 acres with the existing set of improvements and out buildings . The second lot is proposed to contain ap- proximately 40 acres which is presently unimproved, nonirrigated land . As indicated in a letter dated October 13, 1977, Mr. Morgan desires to retain the 20 acres and existing residential improvements and to sell off the i pro- posed 40 acre parcel which is currently unimproved. 1 Based upon the information submitted and the adopted policies in the County, the Department of Planning Services staff recommends the request be approved I for the following reasons : / Lot Size Variance 1149 Page 2, con ' t . November 7, 1977 1 . The request complies with the intent clause of the Recorded Exemption Procedure in that nonproductive agricultural land (Class VI - nonirrigated soils) is proposed to be split and utilized for residential purposes which would be comptaible with the land uses in the surrounding areas. In conjunction with this Lot Size Variance request , Mr. Morgan made a petitioi • to open County Road 33 south to the north boundary line of the proposed 40 acre parcel to provide access to that 40 acre parcel . The County Engineer ' s Office reviewed the request to open County Road 33 and indicated they recom- ment to the Board of County Commissioners that County Road 33 not be opened. Therefore, if the Board of County Commissioners approve Mr. Morgan ' s lot size variance request , then it will be necessary for Mr . Morgan to provide an access easement across his 20 acre parcel to provide access to the 40 acre parcel . Additionally, it will be necessary for Mr . Morgan to make applicatior to the Board of Adjustment for a variance from the requirement of providing 180 feet of frontage onto a public road as set forth in Section 3 . 14 of the Weld County Zoning Resolution and Section 9-4(a) (3 ) of the Weld County Sub- 1 division Regulations. j Res tfully)r, to Thomas E.
