Drew:
It is my understanding that the well or wells you propose to use for a water depot are
located on the 70 Ranch, on the south side of the South Platte River. We have
previously identified 5-8 wells in this location in Case No. 10CW306, as the United
Diversion No. 6. In that case we seek to include these wells into the 70 Ranch Plan for
Augmentation which was previously decreed in Case Nos. 02CW404 and 03CW442.
We anticipate that we will obtain a decree in Case No. 10CW306, incorporating the
United Diversion Facility No. 6 into the 70 Ranch Plan for Augmentation sometime in
May or June of 2014. In the meantime, we can apply to include a well or wells from
this Facility in a Substitute Water Supply Plan. Under an SWSP we will be required to
demonstrate that we have sufficient water available from the 70 Ranch Plan for
Augmentation to replace any depletions caused by pumping of a well or wells.
