BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
OCTOBER 8, 2013
2:40 p.m. Special Meeting
The Board of County Commissioners of Weld County, Colorado, met in regular session in full
conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County
Administration Building, Greeley, Colorado, October 8, 2013, at the hour of 9:00 a.m.
Fi ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:

BIDS:
ri PRESENT AND APPROVE EMERGENCY BID #61300177, BRIDGE 13/26A FLOOD REPAIRS -
DEPARTMENT OF PUBLIC WORKS: Wayne Howard, Engineer, Department of Public Works, reported
that this project was advertised with three options: which included completion of the project in 14
calendar days (Option 1), 21 calendar days (Option 2), and 28 calendar days (Option 3). Bids ranged
from $670,700.00 to $1,497,248.29. Determination of the lowest bidder will be dependent on which
option the Board selects for time of contract completion. If the BOCC selects Option 1 (14 Days) then
Northern Colorado Constructors would be low bid at $727,075.00. If the BOCC selects Option 2 (21
Days) then Mountain Constructors would be low bid at $670,700.00. If the BOCC selects Option 3 (28
Days) then Northern Colorado Constructors would be low bid at $716,075.00. In response to
Commissioner Rademacher, Mr. Howard said there are liquidated damages in place which are a
percentage of the amount; i.e. the higher the amount, the higher the liquidated damages for non -
completion by due date. In response to Chair Garcia, Mr. Howard confirmed these companies have the
resources to get the work done and have all previously worked with the County (with the exception of
Northern Colorado Constructors). In response to Commissioner Rademacher, Mr. Howard confirmed
Northern Colorado Constructors are in a unique situation as they have all of their equipment on -site due
to working on the water and sewer lines, and would not be in conflict with themselves because they are
already working on the utilities, the other companies would have to wait until repairs are completed by
Central Weld County Water District ("Central Weld"). In response to Commissioner Kirkmeyer, Mr.
Howard confirmed Central Weld is working on a 36 -inch water line in the County right-of-way and there
isn't room for two companies to be working there at the same time. Commissioner Rademacher
explained there is a water line in one right-of-way and a sewer line in the other right-of-way. In

response to Commissioner Freeman, Mr. Howard said the start date would have to be discussed with
Northern Colorado Constructors, but they could certainly start the project sooner than October 24th.
Commissioner Rademacher related that Central Weld said they would not be done until the 24th and he
had already expressed his displeasure at that delay. Mr. Howard did not know if Central Weld had
obtained a right-of-way permit. Fi Chair Garcia declared a five minute recess to ask Northern when
their fourteen day countdown could start. Commissioner Kirkmeyer concurred that the fourteen day
timeline is key, and said the Board should demand Central Weld complete the project sooner.
Commissioner Rademacher noted they should have been there two weeks ago getting started. Mr.
Howard concurred, noting they were probably waiting on materials.
Ei Commissioner Kirkmeyer moved to approve Option #1, with the low bidder Northern Colorado
Constructors. Commissioner Conway seconded the motion. Commissioner Conway stated that the
Board should push hard to get this done due to the weather and coming harvest; farmers need to get
their products to market and every day this road is closed is a hardship to them. Commissioner
Rademacher said that someone needs to be onsite to keep them on task and not putting non -essential
work ahead of getting the road open. Commissioner Kirkmeyer said staff needs to tell Central Weld
and any other utilities to expedite their work, even if they need to pay more or work longer hours. She
noted if that doesn't happen, then the Board needs to address their boards. The Commissioners also
gave direction to staff to inform the Board of a firm start date, preferably by tomorrow. Commissioner
Conway noted there is a full-time engineer on County Road 61 and also Weld County staff on -site at
County Road 53, and being able to use this contractor is a benefit. The motion carried unanimously.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Acting Clerk to the Board.
There being no further business, this meeting was adjourned at 3:05 p.m.
