HomeMy WebLinkAbout20132602.tiffHEARING CERTIFICATION DOCKET NO. 2013-55 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR13-0030, FOR MINERAL RESOURCE DEVELOPMENT FACILITIES, INCLUDING AN OIL AND GAS SUPPORT AND SERVICE FACILITY (WATER DEPOT) IN THE A (AGRICULTURAL) ZONE DISTRICT - 70 RANCH, LLC, CIO UNITED WATER AND SANITATION DISTRICT A public hearing was conducted on September 18, 2013, at 10:00 a.m., with the following present: Commissioner William F. Garcia, Chair Commissioner Douglas Rademacher, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Barbara Kirkmeyer Also present: Acting Clerk to the Board, Susan Brown Assistant County Attorney, Brad Yatabe Planning Department representative, Chris Gathman Public Works representative, Jennifer Petrik Health Department representative, Lauren Light The following business was transacted: El I hereby certify that pursuant to a notice dated August 2, 2013, and duly published August 7, 2013, in the Greeley Tribune, a public hearing was conducted to consider the request of 70 Ranch, LLC, c/o United Water and Sanitation District, for a Site Specific Development Plan and Use by Special Review Permit, USR13-0030, for Mineral Resource Development Facilities, including an Oil and Gas Support and Service Facility (water depot) in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. Chris Gathman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. He noted there might be neighbors unable to attend due to the flooding in the area. The Board discussed this and decided to proceed. He said most access will off of County Road 380, with 75 truck trips per day, and most truck trips will be traveling to Highway 34. A letter was received from property owners wanting information and the applicant provided a written response, indicating they will install signs stating their trucks are not to go west on County Road 380 and if they do they will be fined by the applicant. Mr. Gathman discussed the wells, noting the applicant is waiting for a decree from Water Court in regard to supplemental wells, and showed pictures of the site. tDln 2013-2602 PL2238 HEARING CERTIFICATION - 70 RANCH, LLC, C/O UNITED WATER AND SANITATION DISTRICTAPPLICANT (USR13-0030) PAGE 2 Jennifer Petrik, Department of Public Works, provided a brief overview of the transportation plans, requirements, and access. She said the USR refers to 75 truck round trips per day, an increase would require an amendment to the USR. She noted that improvement triggers are included in the agreement, and cameras will be installed to ensure trucks are only turning to the east. Ms. Petrik also suggested an additional Condition of Approval #1.1 stating, "the applicant shall provide written documentation from CDOT that any requirements for access onto U.S. Highway 34 have been addressed." Ei Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions. Drew Damiano represented the applicant and explained the project; trucks will come in on the west side which will eliminate light shining towards neighbors homes. He explained they will design the exit so that it is difficult to turn in a westerly direction. Adam Smith said they estimate 4 trucks going eastbound and westbound on U.S. Highway 34, per hour, and he has been in contact with CDOT. In response to Commissioner Conway, he confirmed there are no road or access issues with CDOT. No public testimony was offered concerning this matter. After some discussion, the Board assented to adding Condition of Approval 1.1, stating "The applicant shall attempt to address any requirements that CDOT may have regarding impacts to State Highway 34." In response to Commissioner Rademacher, Ms. Petrik reviewed the traffic triggers. In response to Chair Garcia, Mr. Damiano said he has reviewed, and agrees to abide by, the Conditions of Approval and Development Standards, as amended. Commissioner Freeman moved to approve the request of 70 Ranch, LLC, c/o United Water and Sanitation District, for a Site Specific Development Plan and Use by Special Review Permit, USR13-0030, for Mineral Resource Development Facilities, including an Oil and Gas Support and Service Facility (water depot) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Rademacher, and it carried unanimously.
