Water Division 1 Water District 2 Dear Ms. Aungst: John W. Hickenlooper Governor Mike King Executive Director Dick Wolfe, P.E. Director This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-101(10)(a), C.R.S Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide informal comments The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure the issuance of a well permit, or physical availability of water. The application seeks a site specific development plan and use by special review permit for an automotive repair business on a 2.6 -acre lot. The proposed business will not have any employees and the site will not be used for business purposes by anyone other than the landowner. The site also contains an existing residence. The current and proposed water supplier is the Central Weld County Water District ("District"). The District most recently provided this office with information about their water supplies in September of 2012. Based on this information, the District is considered to have adequate water supply. The application proposes to construct a water quality feature on the site to collect water. Any stormwater runoff intercepted by this water quality feature, that is not diverted or captured in priority, must be released to the stream system within 72 hours. Otherwise, the applicant will be required to make replacements for evaporation. Information available in this office indicates that the well with permit no. 155183-A is located on the subject property. This well is permitted to be used for fire protection, the irrigation of not more than 30,000 square feet of home gardens and lawns, and the watering of livestock. This well may continue to be used in accordance with its permitted terms and conditions but may not be used as a water supply inside the existing residence or for the proposed business. Should you or the applicants have any questions, please contact Sarah Brucker of this office.
