A Use by Special Review permit for automotive repair
The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process.
COMMENTS:
The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the state
highways. Please contact Gloria Hice-Idler at the Greeley office (970-350-2148 or 970-350-2163) for
right of way information, to verify the access permit or for any additional requirements that may be
needed to obtain or upgrade the permit. (State Highway 60).
The applicant indicated there will be a maximum of 10 cars coming to the site.
Show on the Plat: access permit numbers for CDOT if applicable and existing CDOT right of way.
The application material indicates an existing water quality depression will be utilized to improve
stormwater quality prior to stormwater leaving the site.
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA).
REQUIREMENTS:
1. Prior to recording the plat:
A. Plat shall be amended to delineate the following:
1. Show the approved Colorado Department of Transportation (CDOT) accesses on
the plat and label with the approved access permit numbers.
Development Standards (notes on the plat):
1. Should noxious weeds exist on the property, or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Chapter 15, Articles I and II, of the Weld County Code.
2. The historical flow patterns and runoff amounts will be maintained on the site.
3. Weld County is not responsible for the maintenance of onsite drainage related features.
4. There shall be no parking or staging of vehicles on County roads. On -site parking shall be utilized.

Environmental Health Services has reviewed this proposal for an automotive repair
business. Central Weld County Water District provides water (Account No. 00092-01).
The existing septic system in the home will be utilized (SP -0700072). It is permitted for
3 bedrooms or 6 persons. As there are no employees, an engineer evaluation of the
septic system will not be required.
The applicant submitted a waste handling plan; however, was found to be incomplete.
The applicant needs to include addresses and phone numbers of the waste handling
companies listed in the plan for the automotive repair wastes. The plan shall also
include procedures for cleanup and disposal of spilled vehicle fluids. B&C Refuse will
provide refuse removal.
There was no mention if there are floor drains in the shop building. If so, floor drain
waste must be collected in a water tight vault for proper off -site disposal. Floor drains
must not drain to a septic system. Also, there was no mention whether vehicles and/or
equipment will be washed onsite (other than personal vehicles). If so, must collect wash
water in a water tight vault for off -site disposal.
A minimal dust abatement plan was submitted. The access drive will be graveled, and
water will be applied to control dust onsite.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a revised waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) Procedures for cleanup and disposal of vehicle fluid spills.
2) The addresses and phone numbers of the waste handling companies and
disposal/recycling facilities for the automotive repair wastes.
2. In the event washing of vehicles will occur on site the applicant shall ensure that
any vehicle washing area(s) shall capture all effluent and prevent discharges
from the washing of vehicles in accordance with the Rules and Regulations of the
Water Quality Control Commission, and the Environmental Protection Agency.
Vehicle washing areas should be designated on the plat.
3. The applicant shall submit documentation that floor drain wastes from any
vehicle maintenance facility is captured in a watertight vault and hauled off for
proper disposal
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions. The applicant shall operate in accordance with the
approved "waste handling plan", at all times.
4. Any vehicle or equipment washing areas shall capture all effluent and prevent
discharges in accordance with the Rules and Regulations of the Water Quality
Control Commission, and the Environmental Protection Agency.
5. Process wastewater (such as floor drain wastes) shall be captured in a watertight
vault and hauled off for proper disposal. Records of installation, maintenance,
and proper disposal shall be retained.

6. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
7. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in Section 14-9-30 of the Weld County Code.
8. Adequate drinking, handwashing and toilet facilities shall be provided for
employees and patrons of the facility, at all times.
9. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
10. The facility shall utilize the existing public water supply. (Central Weld County
Water District)
11.All potentially hazardous chemicals must be stored and handled in a safe manner
in accordance with product labeling and in a manner that minimizes the release
of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's).
12. The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

The structures proposed for uses as a repair garage will be required to have changes uses per
Section 29-3-10 of the Weld County Code, A code analysis, floor plan an complete set of plans
for any alteration will be required .
Building and electrical permits maybe required for any new construction, alteration, or
addition to any building on the property per Section 29-3-10 of the Weld County Code.
Currently the following codes cycles has been adopted by Weld County: 2012 International
Codes; 2006 International Energy Code; 2011 National Electrical Code.

Upon review of my case files and computer, an active Zoning Violation (ZCV13-00042) was noted. This
violation was initiated due to the location of a commercial auto repair service establishment without first
completing the necessary Weld County Zoning Permits. This case has not been presented to the Weld
County Court Magistrate through the Violation Hearing process. Since this application was submitted prior
to an actual court date being scheduled, no investigation fee is required.
Due to records release laws, staff no longer tracks complainant information, but please be aware it is
staff's policy to no longer accept staff initiated complaints.
This application if approved by the Board of County Commissioners and once a plat is recorded will
correct the violation. If this application is denied, all commercial operations and storage of commercial
vehicles, materials and/or equipment shall be removed from the property within 30 (thirty) days of denial or
the violation will proceed in court accordingly.

This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-101(10)(a), C.R.S
Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning
directors, this office will only perform a cursory review of the referral information and provide informal comments
The comments do not address the adequacy of the water supply plan for this project or the ability of the water
supply plan to satisfy any County regulations or requirements. In addition, the comments provided herein cannot
be used to guarantee a viable water supply plan or infrastructure the issuance of a well permit, or physical
availability of water.
The application seeks a site specific development plan and use by special review permit for an
automotive repair business on a 2.6 -acre lot. The proposed business will not have any employees and the site
will not be used for business purposes by anyone other than the landowner. The site also contains an existing
residence.
The current and proposed water supplier is the Central Weld County Water District ("District"). The
District most recently provided this office with information about their water supplies in September of 2012. Based
on this information, the District is considered to have adequate water supply.
The application proposes to construct a water quality feature on the site to collect water. Any stormwater
runoff intercepted by this water quality feature, that is not diverted or captured in priority, must be released to the
stream system within 72 hours. Otherwise, the applicant will be required to make replacements for evaporation.
Information available in this office indicates that the well with permit no. 155183-A is located on the
subject property. This well is permitted to be used for fire protection, the irrigation of not more than 30,000 square
feet of home gardens and lawns, and the watering of livestock. This well may continue to be used in accordance
with its permitted terms and conditions but may not be used as a water supply inside the existing residence or for
the proposed business.
