Dear Honorable Judge Carpenter :
We have found ourselves in a dilema regarding the full
time County Attorney post as mandated in the Weld County
Home Rule Charter. The committee which drew the Charter
set forth certain qualifications in Section 5-2 :
"The County Attorney shall be a resident of the County
of Weld and a duly licensed attorney for the State of
Colorado for at least five (5) years immediately prior
to his appointment, and shall have been actively en-
gaged in the practice of law during such five years. "
The qualifications must be adhered to before the
County Attorney can be selected. Therefore, we are asking
for your interpretation of the qualifications in Section
5-2. Your reply is needed before we may proceed with the
readvertising for this post.
We would appreciate your prompt attention to this matter,
as time is of the essence.
