(REPLACES USR-1772 ON LOT A OF RECX12-0082) — MEADOWLARK MIDSTREAM COMPANY, LLC A public hearing was conducted on June 19, 2013, at 10:00 a.m., with the following present: Commissioner William F. Garcia, Chair Commissioner Douglas Rademacher, Pro-Tem Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Barbara Kirkmeyer - EXCUSED Also present: Acting Clerk to the Board, Susan Brown Assistant County Attorney, Brad Yatabe Planning Department representative, Diana Aungst Public Works representative, Heidi Hansen Public Works representative, Janet Carter Health Department representative, Lauren Light The following business was transacted: a I hereby certify that pursuant to a notice dated May 15, 2013, and duly published May 20, 2013, in the Greeley Tribune, a public hearing was conducted to consider the request of Bear Tracker Energy, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR13-0002, for a Mineral Resource Development, including Oil and Gas Support and Service (natural gas processing facility with a field office, storage yard, processing plant, and a gas metering station) in the A (agricultural) Zone District (Replaces USR-1772 on Lot A of RECX12-0082). Brad Yatabe, Assistant County Attorney, made this a matter of record. a Grant Burchell, applicant, Bear Tracker Energy, LLC, introduced himself. Chair Garcia advised the applicant they had the option of continuing this matter to a date when the full Board will be present. However, if they decide to proceed today, it will require three affirmative votes, or in the case of a tie vote, Commissioner Kirkmeyer will listen to the record and make the determining vote. The applicants indicated they would like to proceed. El Diana Aungst, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. She reviewed surrounding land use and said the site is currently part of USR -1772, requiring a partial revocation of that use. Heidi Hansen, Department of Public Works, provided a brief overview of the transportation cc: CA, Rz,'M #2 9-.-J3 2013-1490 PL2218 HEARING CERTIFICATION - MEADOWLARK MIDSTREAM COMPANY, LLC (USR13-0002) PAGE 2 plans and requirements. She reviewed the traffic count from 2011 and said they propose 7-10 pickup truck trips per day. They will have a drainage easement as part of the overall site, with no additional requirements. Ms. Carter outlined the access points off Weld County Road 71. She said it is a collector roadway, because it is the only one in the area where you can cross in and out of Wyoming — so it has more stringent requirements for access. She reported the applicant had requested a temporary construction access and would now like to keep that access point for more convenient traffic flow and moving equipment around. She said the Board has to approve an excess of allowed access points. There was some discussion of this. Commissioner Rademacher said the additional access should be dealt with at the end of this process. Ms. Carter explained that the parcel will thus have four instead of the three access points allowed by the Code. So perhaps one of the access points can be gated off, but this may not fit the best needs of the site. El Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions. They have a commercial well and a septic system for 15 people; the only outstanding item is an updated Waste Handling Plan. Mr. Burchell said EOG Resources, Inc. has 60 existing wells in this area producing oil and flaring off the gas. Meadowlark has contracted with them to gather all that flare gas and process it in this facility and then deliver it via pipeline. Bear Tracker was purchased by Summit Midstream, and they wanted to own the land, versus leasing from EOG, thus the existing USR needs to be split. Mr. Burchell requested an additional gated access onto County Road 136.5, primarily for emergency vehicles and safety. In response to Mr. Yatabe, Mr. Burchell confirmed that Meadowlark Midstream Company, LLC, is the correct legal name and Bear Tracker, LLC, no longer exists; the USR will be issued to Meadowlark. In response to Commissioner Conway, Ms. Carter said site distance restrictions are not an issue for the second access. La No public testimony was offered concerning this matter. Mr. Burchell said some of the Conditions of Approval and Development Standards are redundant since the site was developed under another USR, but that is fine. Mr. Yatabe explained the process for an applicant regarding appealing an access denial from Public Works. He noted an appeal would not require public input, so it could be addressed by the Board at this time. Commissioner Rademacher said he is in support if the applicant is willing to gate the access. Commissioner Conway clarified that during construction they'd like to have it open and gated, but not locked. He said they do not want it to be used except as an exception. Commissioner Conway reiterated that Ms. Carter said safety and sight distance is fine. Ms. Carter suggested language be added to Development Standard #8, "The existing access point shall be modified from being temporary to being permanent and gated." Commissioner Rademacher made a motion to change this language. Seconded by Commissioner Conway, the motion carried unanimously. El Commissioner Rademacher asked about the number of employees. By assent of the Board, the number of employees in Development Standard #3 was increased from 4 to 15. 2013-1490 PL2218 HEARING CERTIFICATION - MEADOWLARK MIDSTREAM COMPANY, LLC (USR13-0002) PAGE 3 Commissioner Conway proposed reflecting Meadowlark Midstream Company, LLC, in place of Bear Tracker, throughout the Resolution. This was agreed upon by assent of the Board. El In response to Chair Garcia, Mr. Burchell agreed to abide by the Conditions of Approval and Development Standards, as amended. CR Commissioner Conway moved to approve the request of Meadowlark Midstream Company, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR13-0002, for a Mineral Resource Development, including Oil and Gas Support and Service (natural gas processing facility with a field office, storage yard, processing plant, and a gas metering station) in the A (Agricultural) Zone District (Replaces USR-1772 on Lot A of RECX12-0082), based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended and entered into the record. The motion was seconded by Commissioner Freeman, and it carried unanimously. Commissioner Conway said this is a great project; reclaiming flared off gas leads to cleaner air, and Chair Garcia concurred. There being no further discussion, the hearing was completed at 12:10 a.m. This Certification was approved on the 24th day of June, 2013.
