RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 297 - BRUCE MARRS . WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Com- missioners of Weld County, Colorado, at a public hearing held on the 19th day of December, 1977, in the Chambers of the Board of County Commissioners of Weld County, Colorado, that the div- ision into two parcels of a certain parcel of land, as shown on the plat known as Recorded Exemption No. 297, being the property of Bruce Marrs, located in Part of the NEa of Section 21 and part of the SWp of Section 22 , Township 1 North, Range 67 West of the 6th P.M. , Weld County, Colorado, and being more particul- arly described as follows, to-wit: All of the Northwest one-quarter of Section 22, Township 1 North, Range 67 West of the 6th Principal Meridian, Weld County, Colorado. Contains 160 acres more or less. Also; That part of the Northeast one-quarter of Section 21, Township 1 North, Range 67 West of the 6th Principal Meridian, Weld County, Colorado, described as: Beginning at the Northeast corner said Section 21; thence S00°00'00" W on an assumed bearing along the East line said Northeast one-quarter a distance of 63.00 feet to the True Point of Beginning; thence continuing S 00°00'00" W along said Fast line a distance of 832.06 feet; thence N62°07'35" W a distance of 394.86 feet; thence N 05°44'35" W a distance of 227.95 feet; thence N 41°28'35" E a distance of 561.45 feet to the True Point of Beginning. Contains 4.41 acres more of less. does not come within the purview of the definition of the terms , "subdivision" and "subdivided land" , pursuant to its authority under Section 20-38-101 (10) (d) , CRS 1973 , as amended, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, finds that this particular division of land is not within the purposes of the Weld County Subdivision Regulations and the Board desires to exempt this particular division of land from the definition of "subdivision" and "subdivided land" pur- suant to its authority under Section 30-28-101 (10) (d) , CRS 1973 , 770697 N., -- as amended, and Section 2-1A(3) of the Weld County Subdivision Regulations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that the hereinabove de- scribed parcel of land owned by Burce Marrs be exempt from the definition of the terms, "subdivision" and "subdivided land" pursuant to its authority under Section 30-28-101 (10) (d) . The parcel of land is described as Pt . of the NE4 of Section 21 and Pt . of the NW'+ of Section 22, T1N, R67W of the 6th P.M. , Weld County, Colorado. Said property is located 2z miles west and 1 mile north of Wattenburg. The subject property contains 164. 449 acres of predominantly Class I and II irrigated soils, and Class VI nonirrigated soils . The request is to split the property into parcels of 4 . 949 acres and 159 . 5 acres . The 159. 5 acre parcel contains an existing residence and it is the property for which a Special Use Permit for a dairy operation was ap- proved by the Board of County Commissioners on April 4 , 1977 . The 4 . 949 acre parcel is presently unimproved agricultural land consisting of Class VI nonirrigated soils . As indicated in a letter dated Aug. 22, 1977, submitted by Bruce Marrs , Mr . Marrs desires to sever the 4 . 949 acre parcel as a new residential site for one of his sons who will be working with him in the dairy operation . Based upon the information submitted and the adopted policies in the County, the Department of Planning Services Staff recommends the re- quest be approved for the following reasons : 1 . The proposed split conforms with the intent clause of the Recorded Exemption procedure (Section 9-2 of the Weld County Subdivision Regulations) , the intent clause of the Agricultural District (Sec- tion 3 . 3a of the Weld County Zoning Resolution) , and the Weld County Comprehensive Plan since the use would be compatible with the surrounding agricultural uses . 2.
