A Use by Special Review permit for storage of pipe and production equipment, and LNG fueling
The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process.
COMMENTS:
CR 57 is a local gravel road and requires a 60 -foot right-of-way at full build out. There is presently a 60 -
foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the
Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line.

foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the
Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
The traffic information provided with the submittal states that the site will generate around 55 roundtrips
per day of which 50 will be large trucks.
An improvements agreement is required for this site. Public Works will provide a draft of the agreement
after the Board of County Commissioners hearing for this project. An example Improvements Agreement
is available on the County Planning website under Application Assistance. Road maintenance including
dust control and damage repairs and triggers for improvements, will be a part of the agreement.
A new access has been proposed for this project. The new access will be reviewed by the County Traffic
Engineer and either approved or denied. Please show the approved access point(s) on the Plat and label
them with the Access Permit numbers (will be provided).
The applicant is showing 100' of pavement plus double cattleguards as permanent tracking control for the
site onto CR 57. This meets the County's tracking control requirements.
Contact the Permitting/Inspection agent for Weld County Public Works, at (970) 304-6496, ext. 3764 for a
Right -of -Way permit for any work that may be required in the right-of-way on County roads. A special
transport permit will be required for any oversized or overweight vehicles that may access the site and
may also be obtained through the same office.
In the event that 1 or more acres are disturbed during the construction and development of this site, the
applicant shall obtain a stormwater discharge permit from the Water Quality Control Division of the
Colorado Department of Public Health and Environment.
If more than 1 acre is to be disturbed, a grading permit will be required prior to the start of construction.
The grading permit application must contain: an erosion and sediment control plan, a grading plan,
installation details of all BMPs to be utilized, typical installation and maintenance notes for all BMPs to be
utilized, and a copy of the approved CDPHE stormwater permit.
The applicant provided a "Phase II Drainage Study" dated March 22, 2013 and signed and stamped by
John D. Enochs, PE 26057 with Diamondback Engineering. Please provide revised drainage report and a

complete set of construction drawings that have been stamped, signed, and dated by a registered
professional engineer licensed in the State of Colorado.
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA).
REQUIREMENTS:
1. Show on the Plat:
a. CR 57 is a local gravel road and requires a 60 -foot right-of-way at full build out. The
applicant shall verify the existing 60 feet of right-of-way and the documents creating the
right-of-way and this information shall be noted on the plat. If the right-of-way cannot be
verified, it shall be dedicated. This road is maintained by Weld County.

2. Before recording the Plat:
a. An Improvements Agreement including collateral for all on -site and off -site improvements
as well as road maintenance is required for this site. Road maintenance including dust
control, damage repair, and triggers for improvements will be included.
b. Submit a revised Final Drainage Report that follows the USR-SPR Drainage Report
Checklist and a complete set of Construction Drawings that have been stamped, signed,
and dated by a registered Professional Engineer licensed in the State of Colorado.
3. Before Construction:
a. In the event that 1 or more acres are disturbed during the construction and development
of this site, the applicant shall obtain a stormwater discharge permit from the Water
Quality Control Division of the Colorado Department of Public Health and Environment.
b. If more than 1 acre is to be disturbed, a grading permit will be required prior to the start of

4. Add the following notes to the plat:
a. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist
on the property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds.
b. Off-street parking spaces including the access drive shall be surfaced with gravel,
asphalt, recycled asphalt base, concrete or the equivalent and shall be graded to prevent
drainage problems.
c. The historical flow patterns and run-off amounts will be maintained on site in such a
manner that it will reasonably preserve the natural character of the area and prevent
property damage of the type generally attributed to run-off rate and velocity increases,
diversions, concentration and/or unplanned ponding of storm run-off.
d. The applicant must take into consideration storm water capture/quantity and provide
accordingly for best management practices.
e. Weld County is not responsible for the maintenance of onsite drainage related features.

Environmental Health Services has reviewed this proposal fora mineral resource
development facility, oil and gas support service, including storage of pipe and
production equipment, and an LNG fueling facility.
It is proposed to have up to 5 full-time employees and up to 50 drivers accessing the
site on a daily basis. Permanent water and sewage disposal will be required for
employees, drivers and other personnel. An engineer designed septic system will be
required and the septic permit will require Weld County Board of Health approval. The
applicant shall designate the location of the proposed septic system on the plat. The
septic system must be protected from vehicle traffic.
The facility is proposing to share a water tap provided by North Weld County Water
District with the parcel directly north of the proposed facility. The applicant will need to
provide documentation from the North Weld County Water District that water service is
approved for the commercial facility, and provide evidence of a recorded easement for
the water line crossing two parcels.
The waste handling plan stipulates that there will be trash dumpsters on site and will
likely be serviced by Waste Management or another disposal company. The applicant
will need to revise the waste handling plan to include a list of types and quantities of
chemicals to be stored on site, and the contact information for the chosen disposal
company. Also, include procedures for cleanup and disposal of hazardous material
spills.
On site dust will be controlled by having the access drive and circulation areas graveled,
and a water truck will be utilized to suppress dust.
An air permit may be required for the LNG fueling facility. An air permit will be required if
more than 25 acres are disturbed.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.)
and Emissions Permit application from the Air Pollution Control Division, Colorado
Department of Health and Environment, if applicable. Alternately, the applicant can
provide evidence from the APCD that they are not subject to these requirements.
(Note: An Air Pollution Emission Notice (APEN) is also required if the amount
of disturbed area exceeds 25 acres.)
2. The applicant shall designate the location of the proposed septic system on the plat.
The septic system must be protected from vehicle traffic.
3. Submit documentation from North Weld County Water District indicating that water
service is approved for the commercial facility.
4. Submit evidence of a recorded easement for the water line crossing two parcels, and
the easement shall be designated on the plat.
5. The applicant shall submit a revised waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of the type and volume of chemicals expected to be stored on site.
2) Hazardous material spill cleanup and disposal procedures.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
conditions that must be met one month prior to construction activities:
1. A State stormwater discharge permit may be required for a development / redevelopment /
construction site where a contiguous or non-contiguous land disturbance is greater than or
equal to one acre in area. Contact the Water Quality Control Division of the Colorado
Department of Public Health and Environment at www.cdphe.state.co.us/wq/PermitsUnit for
application more information.
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to the issuance of the Certificate of Occupancy:
1. An individual sewage disposal system is required for the proposed facility and shall
be installed according to the Weld County Individual Sewage Disposal

Regulations. The septic system is required to be designed by a Colorado
Registered Professional Engineer according to the Weld County Individual Sewage
Disposal Regulations.
2. The applicant shall submit evidence of an Underground Injection Control (UIC)
Class V Injection Well permit from the Environmental Protection Agency (EPA) for
any large -capacity septic system (a septic system with the capacity to serve 20 or
more persons per day). Alternately, the applicant can provide evidence from the
EPA that they are not subject to the EPA Class V requirements.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan".
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan" at all times.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in Section 14-9-30 of the Weld County Code.
7. Adequate drinking, hand washing and toilet facilities shall be provided for
employees and patrons of the facility, at all times.
8. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
9. A permanent, adequate water supply shall be provided for drinking and sanitary

purposes.
10. Adequate toilet facilities (portable toilets) and hand washing units shall be
provided during the construction of the facility.
11. Bottled water shall be utilized for drinking during construction of the project.
12. All potentially hazardous chemicals must be stored and handled in a safe manner
in accordance with product labeling and in a manner that minimizes the release
of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All
chemicals must be stored secure, on an impervious surface, and in accordance
with manufacturer's recommendations.
13. The facility shall comply with the Air Pollution Emission Notice (A.P.E.N.) permit
requirements as stipulated by the Air Pollution Control Division, Colorado
Department of Public Health and Environment, as applicable.
14. The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

Dear Sir/Madam,
The Weld County Building Department has reviewed the application and has the following comments:
The proposed oil and gas business and structures will occupy a non -improved lot. No structures are currently
located on this parcel. A commercial building permit will be required. On the back of this permit you will find
the necessary items that must be submitted with the application. The submittal must be complete with all
the documents before it can be accepted. In addition this building will require the following: Engineered
drawings for all structural work and architectural drawings that show the floor plan, elevations, ect. Also, a
life safety plan showing occupancy and building type, egress routes, emergency lights/exist, frontages, and
travel distance must be submitted. A ComCheck for the building envelope, mechanical, and electrical must
be submitted showing that the building will comply with the 2006 International Energy Code. Bathroom
plans with details must be submitted to show accessibility. Also an overall accessibility plan must be
submitted. Mechanical, plumbing and electrical drawings with a one line and fault current calculations are
required. The building must comply with the requirements set forth by the fire district. A letter of
notification that they have received the drawings are they are ok with the release of the building permit must
be submitted to our office with the application.
Currently we are under the 2006 IECC, 2011 NEC and the 2012 IBC, IRC, IFGC, IMC and IPC.
