HomeMy WebLinkAbout20133064.tiffHEARING CERTIFICATION DOCKET NO. 2013-70 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR13-0046, FOR ANY USE PERMITTED AS A USE BY RIGHT, ACCESSORY USE OR USE BY SPECIAL REVIEW IN THE COMMERCIAL OR INDUSTRIAL ZONE DISTRICTS (ELECTRICAL CONTRACTORS SHOP) PROVIDED THAT THE PROPERTY IS NOT A LOT IN AN APPROVED OR RECORDED SUBDIVISION PLAT OR PART OF A MAP OR PLAN FILED PRIOR TO ADOPTION OF ANY REGULATIONS CONTROLLING SUBDIVISIONS IN THE A (AGRICULTURAL) ZONE DISTRICT - ELECTRICAL SYSTEMS PROFESSIONALS, INC. A public hearing was conducted on October 30, 2013, at 10:00 a.m., with the following present: Commissioner William F. Garcia, Chair Commissioner Douglas Rademacher, Pro -Tern Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Barbara Kirkmeyer Also present: Acting Clerk to the Board, Susan Brown Assistant County Attorney, Brad Yatabe Planning Department representative, Kim Ogle Public Works representative, Don Carroll Health Department representative, Mary Evett The following business was transacted: I hereby certify that pursuant to a notice dated September 25, 2013, and duly published September 30, 2013, in the Greeley Tribune, a public hearing was conducted to consider the request of Electrical Systems Professionals, Inc., for a Site Specific Development Plan and Use by Special Review Permit, USR13-0046, for any use permitted as a Use by Right, Accessory Use or Use by Special Review in the Commercial or Industrial Zone Districts (electrical contractors shop) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. Le Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. He reviewed the location and nearby commercial and residential structures. He stated there are currently 20 employees and the business provides electrical work for Noble Energy, Inc. (USR13-0046) PAGE 2 Don Carroll, Department of Public Works, provided a brief overview of the transportation plans and requirements. He stated access is off CR 74, at the west end of Galeton, and projected traffic is 10 half -ton trucks per day. Mary Evett, Department of Public Health and Environment, reviewed the water and sewer provisions. There will be a bathroom facility in the shop and a letter from the Town of Galeton has been received stating their intention to grant a sewer tap at the site. In response to Commissioner Rademacher, Ms. Evett said there is currently no sewage system of any kind at this site. pa Jeff Murray, co-owner, represented the applicant and stated this is a place to stage equipment and materials, but nothing is stored on -site long-term because most of their equipment remains at the Noble site. They mainly perform new installation of automation, metering, data collection, solar arrays, and electric compressors, and perform some maintenance. In response to Commissioner Kirkmeyer, he said 7:00 a.m. - 5:00 p.m., Monday — Saturday, are their typical hours; they are usually out in the field and no business will be conducted at the shop, where they will do light vehicle maintenance. Commissioner Rademacher noted that under these rules, if Mr. Murray needs to work after hours, he would be in violation. Mr. Murray said the closest neighbor is a contractor and not likely to object to extended work hours. No public testimony was offered concerning this matter. Commissioner Rademacher suggested no hours of operation are necessary. Mr. Murray concurred, noting emergency calls happen occasionally. Mr. Murray asked about the Condition of Approval regarding screening, and Mr. Ogle confirmed the dumpster needs to be screened and fenced, perhaps in the back of the property, and onsite storage requires screening. Mr. Murray noted there is scarcely enough room to turn vehicles around as it is, so fencing the other storage would limit room, and there are no residences looking directly at the property. Commissioner Rademacher noted there is a subdivision to the south, and Mr. Ogle suggested a fence along the rear of the property line to the east and place immobile equipment back there. Mr. Ogle noted that future right-of-way on CR 74 will be an issue at some point in the future. Mr. Murray confirmed all vehicles at the site are licensed and operational. Commissioner Rademacher noted that this building has been here a long-time, so it doesn't seem anyone has noticed or is bothered by the activity here. He proposed eliminating the screening requirement entirely; therefore, Conditions of A0 roval #1.D, #1.F.5, and Development Standard #17 were deleted by consent of the Board. Development Standard #4, regarding hours of operation, was also deleted by consent of the Board. It was noted that on a sewer system it shouldn't matter if there are a few more employees, so the number of employees in Development Standard #5 was increased to 30, by consent of the Board. In response to Chair Garcia, Mr. Murray said he and the applicant have reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as amended. 2013-3064 PL2244 HEARING CERTIFICATION - ELECTRICAL SYSTEMS PROFESSIONALS, INC. (USR13-0046) PAGE 3 Commissioner Freeman moved to approve the request of Electrical Systems Professionals, Inc., for a Site Specific Development Plan and Use by Special Review Permit, USR13-0046, for any use permitted as a Use by Right, Accessory Use or Use by Special Review in the Commercial or Industrial Zone Districts (electrical contractors shop) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as amended and entered into the record. The motion was seconded by Commissioner Conway, and it carried unanimously. There being no further discussion, the hearing was completed at 1:57 p.m. This Certification was approved on the 4th day of November, 2013.
