COMPANY LAYDOWN YARD, OFFICE, AND REPAIR AND MAINTENANCE SHOP
FOR OIL AND GAS EQUIPMENT) IN THE A (AGRICULTURAL) ZONE DISTRICT -
E.L. DODSON
A public hearing was conducted on November 20, 2013, at 10:00 a.m., with the following
present:

The following business was transacted:
I hereby certify that pursuant to a notice dated October 14, 2013, and duly published
October 17, 2013, in the Greeley Tribune, a public hearing was conducted to consider the
request of E.L. Dodson, for a Site Specific Development Plan and Use by Special Review
Permit, USR13-0043, for a Mineral Resource Development Facility, including an Oil and Gas
Support and Service Facility (oilfield service company laydown yard, office, and repair and
maintenance shop for oil and gas equipment) in the A (Agricultural) Zone District. Brad Yatabe,
Assistant County Attorney, made this a matter of record.
Chris Gathman, Department of Planning Services, presented a brief summary of the
proposal and entered the favorable recommendation of the Planning Commission into the
record as written. He said no concerns have been received from surrounding property owners;
staff has asked for a screening plan due to the proximity to U.S. Highway 85, a lighting plan,
and, because this is currently a zoning violation, building codes and requirements need to be
addressed before recording the plat. A new Condition of Approval #1.J should read, "Proper
building permits will be required for any existing buildings currently being used by the business."
Mr. Gathman presented a slide show of the site and surrounding area. Commissioner Kirkmeyer
commented that she drives U.S. Highway 85 all the time and has never noticed this property
and a six-foot high fence could be uglier than looking at neatly stored equipment.
Commissioner Rademacher concurred. Mr. Gathman apologized that he did not have a picture
of the property taken from U.S. Highway 85. The company is a 24/7 oil and gas support
business, with plans to grow up to 50 employees, of which 10 will be at the site on a regular

basis.
El Jennifer Petrik, Department of Public Works, provided a brief overview of the transportation
plans and requirements. She said the application lists five (5) vehicles per day at the site and an
average of 30 round -trips per day, their access permit is under review and there are two existing
accesses. The applicant shall reference on the plat the planned improvements at U.S. Highway
85.
Mary Evett, Department of Public Health and Environment, reviewed the water, sewer and
waste disposal provisions. One or both domestic wells will need to be permitted. The septic
system for the residence needs to be examined by an engineer, and a new septic permit will be
required for Lot B. There are also Conditions of Approval addressing shop drains.
E.L. Dodson, applicant, said this is a family owned business and one of his sons lives in
the home on the property. He said they employ 24 people in Weld County and want to be good
neighbors; some days there will be a great deal of equipment in the yard, other days there will
be none, and it is always kept neat. In response to Commissioner Kirkmeyer's comment about
unattractive fencing, he said he is committed to making the property look nice, there is a horse
barn and trailer and they tore down the original fencing because it was an eyesore and are
exploring options such as a nice dog-eared wood fence. In response to Commissioner
Rademacher, he said there is a six-foot chain link fence there now and Commissioner
Rademacher said he doesn't believe screening needs to be a requirement but should be up to
their discretion.
El No public testimony was offered concerning this matter.
In response to Chair Garcia, Mr. Dodson said he has reviewed, and agrees to abide by,
the Conditions of Approval and Development Standards, as amended.
a Commissioner Kirkmeyer suggested deletion of the last sentence of Condition of Approval
#1.1 regarding a six-foot opaque fence, done by assent of the Board. She stated that she drives
by here every day and never noticed it, and the last thing they want is to make U.S. Highway 85
unattractive. She said she trusts the applicant's discretion to make the property look nice, such
as a few trees and rocks or appropriate fencing. The Board also consented to a new Condition
of Approval #1.J, "Proper building permits will be required for any existing buildings currently
being used by the business." Mr. Gathman explained the need for building permits for the
existing buildings and Mr. Dodson said he is working on getting the electrical system in the shop
up to Code. There was some additional discussion about these buildings.
Commissioner Conway moved to approve the request of E.L. Dodson for a Site Specific
Development Plan and Use by Special Review Permit, USR13-0043, for a Mineral Resource
Development Facility, including an Oil and Gas Support and Service Facility (oilfield service
company laydown yard, office, and repair and maintenance shop for oil and gas equipment) in
the A (Agricultural) Zone District, based on the recommendations of Planning staff and the
Planning Commission, with the Conditions of Approval and Development Standards as
amended and entered into the record. The motion was seconded by Commissioner
Rademacher, and it carried unanimously. There being no further discussion, the hearing was
