The City of Evans received on March 4, 2013 a petition for annexation on behalf of
Brian Doll by EnviroTech Services, Inc. The property consists of 16.980 acres, all of
which is proposed to be included into the City of Evans. The property currently is zoned
agricultural and contains one single family residence and one utility building. Access to
the property is located approximately 0.57 miles south of the intersection of County
Road 394 and County Road 35.
According to the Colorado Revised Statutes, section 31-12-108, and the City of Evans
municipal code, it is required to notify the Weld County Attorney of any petition seeking
annexation. Please take the time to review the petition documents to determine if the
inclusion of this property of land will affect Weld County's operations.
In addition, the Annexation Impact Report has been submitted in accordance with
Colorado Revised Statutes, section 31-12-108.5
The City of Evans has set a public hearing date of May 21, 2013 for City Council to
consider and act upon the petition for annexation. The hearing will be held at 7:30 pm in
the Evans Community Complex Council Chambers, located at 1100 37th Street, Evans,

PETITION FOR ANNEXATION
The undersigned, in accordance with Article 12, Chapter 31, CRS, as amended, hereby
petition for City Council of the City of Evans, Colorado, for annexation to the City of
Evans the unincorporated territory more particularly described below, to be known as
(name of annexation)
EnviroTech Services Industrial Park Annexation No. 2 and No.3
and in support of said Petition, petitioners allege that:
1) It is desirable and necessary that the following described territory be annexed
to the City of Evans (attach legal description as well);
PART OF THE NORTH 'A OF THE SOUTHEAST 1/4 SECTION 2 TOWNSHIP 4 RANGE 66 OF
THE 6'" PM MORE PARTICULARY DESCRIBED AS LOT B OF RECORDED EXEMPTION # RE -
2430 OF WELD COUNTY, COLORADO, ALSO KNOWN AND NUMBRED AS 23435 WELD
COUNTY ROAD 35, LASALLE, CO 80645
2) Not less than one -sixth (1/6) of the perimeter of the area proposed to be
annexed is contiguous with the City of Evans, Colorado;
3) A community of interest exists between the territory proposed to be
annexed and the City of Evans, Colorado;
4) The territory proposed to be annexed is urban or will be urbanized in the
near future;
5) The territory proposed to be annexed is integrated or is capable of being
integrated with the City of Evans, Colorado;
6) The signatures of the Petition comprise one hundred percent (100%) of
the landowners of the territory to be included in the area proposed to be
annexed and said landowners attesting to the facts and agreeing to the
conditions herein contained will negate the necessity of any annexation
election;
7) No land held in identical ownership, whether consisting of one tract to
parcel of real estate or two or more contiguous tracts or parcels of real
estate:

a) Is divided into separate parts or parcels without the written consent
of the landowner or landowners thereof, unless such tracts or
parcels are separated by a separate dedicated street, road or other
public way;
b) Comprising twenty (20) acres or more and which, together with the
buildings and improvements situated thereon has an assesses value
in excess of Two Hundred Thousand Dollars ($200,000) for ad
valorem tax purposes for the year proceeding the annexation, is
included within the territory proposed to be annexed without the
written consent of the landowner or landowners.

No part of the area proposed to be annexed is more than three miles from
a point on the municipal boundary, as such was established more than
one year before this annexation will take place;
The area proposed -to -be -annexed -comprises (CI ieck-One):
More than 10 acres and the Board of County Commissioners of
Weld County has agreed to waive the requirement of an impact report as
provided for in section 31-12-108.5, C.R.S., as amended.

10) The area proposed to be annexed is located within Weld County, and the

shown on this Petition;
12) Accompany this Petition are four (4) prints of the annexation map
containing the following information:
a) A written legal description of the boundaries of the area proposed to be
annexed;
b) A map showing the boundary of the area proposed to be annexed;
c) Within the annexation boundary map there is shown the location of
each ownership tract in unplatted land, and if part or all of the area is to
be platted, then the boundaries and the plat number of plots or of lots and
blocks are shown;
d) Next to the boundary of the area proposed to be annexed is drawn the

any other municipality abutting the area proposed to be annexed;
e) The dimensions of the contiguous boundaries are shown on the map.
13) The territory to be annexed is not presently a part of any incorporated
city, city and county, or town;
14) The undersigned agree to the following, which shall be covenants running
with the land, and which shall, at the option of the City, appear on the
annexation map;
15) Petitioner represents that:
a) Water rights shall be provided pursuant to City Ordinance;
b) The owners shall participate in providing drainage plans and
improvement and payment of a unit drainage fee as may be required by
the City for the area;
c) The undersigned hereby waives any and all "vested rights" previously
created pursuant to Section 24-68-103, CRS, as amended;
X No part of the property to be annexed is included within any site
specific development plan approved by Weld County, Colorado; OR
A site specific development plan has been approved by Weld

County, Colorado, which has created a vested right.
d) The undersigned and the City may enter into a Pre -Annexation
Agreement prior to the effective date of this annexation, which agreement
shall be additional conditions as effectively as if set forth in this Petition;
and
16) The petitioner understands he/she will be responsible for costs incurred by
the City of Evans such as, but not limited to, advertising and recording
fees, attorney fees, and other professional costs incurred by the city.

A RESOLUTION ESTABLISHING MAY 21, 2013 AS THE DATE TO
REVIEW AN APPLICATION FOR ANNEXATION INTO THE CITY OF
EVANS, KNOWN AS THE ENVIROTECH INDUSTRIAL PARK
ANNEXATION NOS. 2 AND 3.
WHEREAS, the City of Evans has received a petition from Brian Doll, property
owner, for annexation into the City of Evans, and
WHEREAS, pursuant to the Colorado Municipal Annexation Act of 1965, as
amended, and the City of Evans Municipal Code a public hearing must be held to review
the petition, and
WHEREAS, the passing of this resolution will establish a date set neither less than
thirty days nor more than sixty days for City Council to review an ordinance regarding said
petition for annexation, and
WHEREAS, the submitted application is found to be substantially complete.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
EVANS, COLORADO, that the City Council will hold a hearing on May 21, 2013 to review a
petition for annexation for compliance with Section 30 of Article II of the Colorado State
Constitution, the Colorado Municipal Annexation Act of 1965, as amended, as well as
Chapter 19.08 of the City of Evans Municipal Code.

NOTICE is hereby given, pursuant to the Evans Municipal Code and the Colorado Revised Statutes, the Evans City Council will hold a public hearing on Tuesday May 21, 2013,
commencing at 7:30 pm, to be held at the Evans Community Complex Council Chambers, 1100 37th Street, Evans, Colorado, at which time and place they will consider and act
upon a petition for annexation. The parcel in question consists of 16.980 acres located south of CR 394 and approximately 1600 feet west of CR 35 and just north of the Union
Pacific Railroad, Access to the property is generally located .57 miles south of the intersection of County Road 394 and County Road 35.

(a) A map or maps of the municipality and adjacent territory to show the following information:

ditches, and the proposed extension of such streets and utility lines in the vicinity of the proposed
annexation; and Attached

(c) A statement setting forth the plans of the municipality for extending to or otherwise providing
for, within the area to be annexed, municipal services performed by or on behalf of the
municipality at the time of annexation;
The only municipal services to be provided by the City of Evans would include fire, police and ambulance.
These services already encompass the existing 40 acres that the additional 16+/- acres immediately abut,
and as such no additional requirements or expenses would be anticipated.
All water is provided via a fully augmented industrial well, and a septic system that adheres to all Weld
County Department of Public Health and Environment rule and regulations has been constructed on
existing office site.
(d) A statement setting forth the method under which the municipality plans to finance the
extension of the municipal services into the area to be annexed;
Per the statement regarding section (c) above, it is not anticipated that any additional services will be
needed.
(e) A statement identifying existing districts within the area to be annexed;,

Preliminary Utility Plan
EnviroTech Services, Inc. is not requesting any utility services from the City of Evans. The location of the
property is not serviceable by the City of Evans, or any other entity in the area. Also, the conceptual use
of the property (rail facility) would not require any additional utilities than what is already on our
adjacent property.
Upon annexation, the additional property's utility needs will be serviced via our current facility located
immediately on the western border. Currently, we have a 6,000 ft2 office building which is serviced by a
fully augmented well for production, fire protection and domestic water. Also, the building also uses a
septic tank and leach field for our sewage that meets Weld County's requirements.

Soil Description and Limitations
The Doll property is currently a non -irrigated parcel of land without any water rights associated with it.
Other than the residential house and out -building, the property has not been used for any discernible
uses.
The soil on the property generally consists of sandy, silty topsoil to a depth of 2.5'. Below that lies
poorly graded sand with silt and extend to a depth of approximately 35' followed by loose gravel
between 36' and 47'. Bedrock was found at approximately 47'.
Without any water available to allow for irrigation, the land is not suitable for agricultural purposes and
the "sandy poorly graded sand with silt" being the majority of the remaining of the ground below, it is
not feasible that this property could be commercially mined.

Statement of Community Need
EnviroTech Services, Inc. has submitted an annexation request to help facilitate additional opportunities
that are uniquely tied to the property. Due to the proximity and access to the Union Pacific Rail Road's
Fort Collins industrial lead, the property for which annexation is being proposed can be readily
developed to allow products to be shipped both into the area and out of the area via railcars. This
should be looked at favorably by the City of Evans, as rail traffic, as opposed to truck traffic, does not
require any additional infrastructure expenses by the municipality, by reducing the amount of truck
traffic throughout the city.
The subject property, combined with EnviroTech's existing property has been identified as "preferred"
by the Union Pacific, as it pertains to new business development. The property is looked favorably by
the Union Pacific because of burgeoning market place within Weld County, and it high service
capabilities.
In addition to the above listed benefits, the additional job and tax base dedicated to the City of Evans
will increase as well.

Economic Impact Report
On the property that EnviroTech Services currently operates, the City of Evans has collected roughly
$20,000.00 in sales taxes over the last 2 years. The new property would also be subject to the property
tax of a 3.356 levy. In addition to the benefit EnviroTech Services would realize, the annexation of the
additional property would also have benefits to the City of Evans beyond the additional sales and
property taxes this project would provide.
By encouraging rail shipments into the City of Evans, the anticipated increase in volumes used to service
the recent growth in industrial materials will be focused in a single area on the outskirts of town.
Combined, the rail service, and the location of the project will keep truck traffic out of Evans Proper
thereby reducing congestion, increasing safety and overall quality of life for the City's citizens. It also
allows the City of Evans to take advantage of its unique proximity to a highly desirable rail infrastructure
and realize the industrial growth within the City's control and not have to defer to other local
communities that have similar rail access.

Dear Mr. Pike,
The LaSalle Fire Protection District is aware of the annexation application
that will annex an additional 16 acres directly east of your current site for rail road
access into the City of Evans. This letter is to just inform you of our knowledge of
the process taking place. We will be doing a more detailed review at the time we
receive the referral from the City of Evans.
Based on our Discussion with Mr. Pike there will be no facilities on the new
annexation property at this time. We also discussed that there would not be any
buildings, loading racks or any loading or off loading at this time. It is important
to understand that water supply for firefighting, fire access and building and fire
code requirements are triggered by new buildings and facilities. Any future
buildings or facilities will trigger these requirements even though they would not
be required for the rail lines now.
We have spoken with other jurisdictions that have required access
roadways. This is something that both LaSalle Fire and Evans Fire would like to
see. This would be a minimum of a 20' access road with an all-weather driving
surface along one side of the rail lines that accessible from the public street.
We will still request that if any changes or additions are made to this facility
that we be notified to review the plans and enforce any other codes that this
might trigger.
