RE: APPROVE VACATION OF USE BY SPECIAL REVIEW PERMIT USR-1069 — JOHN
WARDLAW
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated January 11, 1995, the Board approved Use by Special
Review Permit USR-1069 for a Feedlot (2,000 head) in the A (Agricultural) Zone District on the
following described real estate, to -wit:
Lot A of RE #1119, being a part of the E112, SW1/4
of Section 4, Township 5 North, Range 64 West
and a part of the NW1/4 of Section 9, Township 5
North, Range 64 West of the 6th P.M., Weld
County, Colorado
WHEREAS, the Board has received a request from John Wardlaw, property owner,
26260 County Road 60.5, Greeley, Colorado 80631, to vacate said Use by Special Review
Permit USR-1069, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Department of Planning Services staff and all of the exhibits and evidence presented in this
matter and, having been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Use by Special Review Permit USR-1069 be, and hereby is,
vacated.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 17th day of June, A.D., 2013.

SUBJECT: Proposed Vacation of USR-1069 (2,000 Head Feedlot)
Background: Use by Special Review Permit (USR-1069) for a 2,000 head feedlot was approved
by the Board of County Commissioners on January 11, 1995.
Legal Description & Location: The feedlot USR is located in part of the E2 of the SW4 of Section
4 and part of the E2 of the NW4 of Section 9, T5N, R65W of the 6th PM. The feedlot
encompasses two (2) parcels on the north side and south side of County Road 60 located Y
mile east of State Highway 37.
Request:
The property owner, John Wardlaw, is requesting to vacate USR-1069.
Staff Recommendation:
Staff is in support of the requested vacation of USR-1069.

portion of the E1/2NW1/4 Section 9, all in Township 5 North, Range 64 West of the 6th P.M.,
Weld County, Colorado.
To Whom IT May Concern:
It is my, the Undersigned's, request that I be allowed to vacate U.S.R. 1069. It is also my decision to
remove the feeding pens (livestock facility) in the reasonable future. I personally have not used the
facility for several years. The facility was leased it to a third party this past season and I have not been
happy leasing.
