Section V: Annexation
A. Petition for Annexation to the Town of Ault
The undersigned, in accordance with Title 31, Article 12, Chapters 101 et. Seq., Colorado Revised Statutes, hereby
petition the Mayor and the Trustees of the Town of Ault, Colorado for annexation to the Town of Ault the
unincorporated territory described herein and described and shown on the map as designated as
Simpson Annexation ." Copies of said map are suhtniited herewith and by this reference
are incorporated herein. The description of the territory hereby petitioned for annexation into the Town is set forth
in Exhibit A attached hereto and incorporated herein by reference.
Exhibit A must be an original printed property description on an 8`h x 1 /" white paper.
In support of this petition, the petitioner(s) allege(s) that:
1) It is desirable and necessary that the attached described territory be annexed to the Town of Ault, Colorado.
2) The requirements of Section 31-12-104 and 31-12-105 of the Colorado Revised Statutes exist in have been
met in that:
a) Not less than one -sixth (1/6 of the perimeter of the area proposed to be annexed is contiguous with
the Town of Ault;
b) A community of interest exists between the territory proposed to be annexed and the Town of
Ault;
c) The territory proposed to be annexed is urban or will be urbanized in the near future;
d) The territory proposed to be annexed is integrated or is capable of being integrated with the Town
of Ault, Colorado.
3) The signatures of the Petition comprise one hundred percent (100%) of the landowners of the territory to be
included in the area proposed to be annexed and said landowners attesting to the facts and agree that the
conditions herein contained will negate the necessity of any annexation election.
4) No land held in identical ownership, whether consisting of one tract or parcel of real estate or two or more
contiguous tracts or real estate:
a) Is divided into separate parts or parcel without the written consent of the landowner or landowners
thereof, except and unless such tracts or parcels are separated by a dedicated street, road or other
public way;
b) Comprising twenty (20) acres or more and which together with the buildings and improvement
situated thereon has an assessed value in excess of Two Hundred Thousand Dollars ($200,000.00)
for ad valorem tax purposed to be annexed without the written consent of the landowner or
landowners.
5) Except as otherwise provided, no part of the area proposed to be annexed is more than three miles from a
point on the municipal boundary, as such was established more than one year before this annexation will
become effective.
6) The territory proposed to be annexed does not include any area included in another annexation preceding
involving a town other than the Town of Ault.
7) The territory to be annexed is not presently a part of any incorporated municipality, town and county, or
town.
8) Petitioner represents that no part of the property to be annexed is included within any site specific
development plan approved by Weld County, Colorado.
9) The territory to be annexed does not include any area that is the same or substantially the same area in
which an election for an annexation to the Town of Ault was held within the. twelve months preceding the

filing of this petition.
10) The area pioposed to be annexed comprises more than ten square acres and an impact report as provided
for in Section 11-12-105.5, CRS will be required.
I I) The area to he annexed is located within Weld County.
12) The mailing address of each signer, the legal description of the land owned by each signer and the date of
each signature are all shown on this Petition.
13) A Concept Muster Plan and supporting documents as required under the Concept Master Plan section.
THEREFORE, the undersigned respectfully petition the Board of Trustees of the Town of Ault to annex the territory
described and referenced in Exhibit A to the 'Town of Ault in accordance with and pursuant to the statues of the
State of Colorado.

SUBSTANTIAL COMPLIANCE WITH COLORADO

WHEREAS, the Town of Ault ("Town") has received a petition to annex certain property
owned by C & H Excavation, LLC, a Colorado limited liability company ("Petitioner"); and
WHEREAS, the property included within the petition is within three miles of Town
limits; and
WHEREAS, Petitioner comprises over fifty percent of landowners in the area to be
annexed, excluding public streets and alleys; and
WHEREAS, the petition for annexation contains one (1) plat to be annexed, Simpson
Annexation; and
WHEREAS, the proposed annexation plat, as allowed by C.R.S. 31-12-104(1)(a), meets
the one -sixth contiguity requirement of said statute; and
WHEREAS, there are no exceptions or limitations that would disallow Petitioner's
proposed annexation;

Annexation Impact Report

Introduction
C&H Construction has submitted a petition to annex property consisting of approximately
150.69 acres more or less into the Town of Ault. The property is currently being famed and is
zoned Agriculture (A) in Weld County. The applicant is requesting the Industrial zoning (I) in
the Town of Ault.
The property is located in the SW1/4 1/4 of Section 2, Township 7 North, Range 66 West of the 6th
P.M in Weld County. It is bounded on the west by Weld County Road 33 and to the south by
Weld County Road 84. In the appendix of this report is a map showing the existing town
boundary (Exhibit A) and the boundary of the proposed annexation (Exhibit B).
Water
Ault receives potable water from North Weld County Water District through a master meter at
5th Street and Graefe Avenue. The water flows into an existing 0.50 million -gallon storage tank.
The tank is only 24 feet tall so the pressure must be boosted using pumps prior to entering the
distribution system. The pumping station has a capacity to pump approximately 1,600 gallons
per minute at a pressure of 67 psi. A map of the water system (Exhibit D) is included in the
appendix of this report.
The Simpson annexation property will need to be served with water from the Town of Ault's
distribution system. Ault currently has a 16 -inch waterline in Conestoga Drive at Cimarron Trail
in Conestoga Subdivision. To serve this property the developer will need to extend this 16 -inch
line approximately' of a mile to Weld County Road 84. This will require an easement through
property owned by Thornton. The developer will be required to dedicate the necessary raw
water for the subdivision. The individual builders of each lot will need to pay the Town's tap fee
and the NWCWD's plant investment fee at the time a tap is requested. Additional booster
station pumping capacity may be required to serve this area. Exhibit C in the appendix reports
shows the approximate route of the proposed waterline extension to serve this property.
Sewer
The Town of Ault's wastewater is carried through the collection system and into the treatment
plant which is located at the south end of town and just west of lst Avenue. The plant is a lagoon
system with a rated design capacity of 250,000 gallons per day (gpd). However, the rapid
infiltration beds that provide discharge into the groundwater appear to only be able to handle
approximately 120,000 gpd. The current influent flow to the plant averages approximately
90,000 gpd. A map of the sewer system (Exhibit E) is included in the appendix of this report.

The Simpson annexation site will need to be served with sewer through the Town of Ault. Ault
currently has a 10 -inch sewer line in Conestoga Subdivision. The developer will need to extend
the line from the intersection of Conestoga Drive and Cimarron Trail north approximately %
mile to Weld County Road 84 to get to the south end of the property. Sewer tap fees will be paid
to the Town by builders when a sewer tap is requested. Exhibit C shows the approximate route
of the proposed sewer line extension to serve this property.
Should the Town not have capacity in their sewer plant at the time the property develops, the
Town may allow temporary individual sewer disposal systems (ISDS). Any ISDS systems
would need to be permitted through Weld County.
Streets
Weld County Road 33 right-of-way to the west of this site is already within the Town of Ault.
At this time there is no plan to annex Weld County Road 84 that bounds the property to the
south. Any future accesses to Weld County Road 84 will need to be approved by Weld County.
Location of streets through the property will be determined during the subdivision process and
will be the requirement of the developer to construct.
Municipal Service Extensions
The developer will be required to extend water and sewer to the site, make improvements to
existing roadways as required and install all infrastructure within the property as part the
subdivision and development process. Ault will insure that all facilities are constructed in
accordance with Town standards, and once the facilities are accepted will take over operation
and maintenance.
Financing of Municipal Service Extension
It is the Town of Ault's position that all development must pay its own way. As such all utility
extensions and roadway construction will be the responsibility of the property developer.

Re: Simpson Annexation
The purpose of this document is to provide a statement regarding the impact on the
Weld Re -9 school district if the Town of Ault is to complete the "Simpson Annexation".
The impact on the district is very difficult to determine with the limited information
provided. However, one can generally address three areas including: transportation,
increased student enrollment and capital/environmental issues.
• The annexation could result in increased transportation expense for the district
and possible routing changes due to the location of the annexation.
• If the property included housing opportunities or evolved into a residential area, it
is estimated that the district could see forty (40) additional students.
• It is possible that an increase in students could result in additional capital needs
including a bus purchase, additional technology or building space. Currently, the
district spends a minimum of $200 per student on capital projects each year.
Depending on the type of industry, district property could be impacted
environmentally. Initial concerns include water, noise and air quality.
While the above information could create a financial expense, additional students
would provide additional revenue for the district and the annexation may increase the
assessed valuation, thus increasing the tax structure within the district. This scenario
could offset the impacts mentioned above.
Weld Re -9 reserves the right to modify or append this public impact statement should
more information regarding the proposed annexation become available to district
personnel. The district office of Weld Re -9 would be willing to provide additional
information upon request.
