HomeMy WebLinkAbout20133224RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO NOVEMBER 18, 2013 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, November 18, 2013, at the hour of 9:00 a.m. �— ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner William F. Garcia, Chair Commissioner Douglas Rademacher, Pro -Tern Commissioner Sean P. Conway Commissioner Mike Freeman Commissioner Barbara Kirkmeyer Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Susan Brown Director of Finance and Administration, Monica Mika MINUTES: Commissioner Kirkmeyer moved to approve the minutes of the Board of County Commissioners meeting of November 13, 2013, as printed. Commissioner Conway seconded the motion, and it carried unanimously. CERTIFICATION OF HEARINGS: Commissioner Conway moved to approve the Certification of Hearings conducted on November 13, 2013, as follows: 1) USR13-0039 - Lee and Andrea Larson, and 2) COZ13-003 — Inez Gutierrez. Commissioner Kirkmeyer seconded the motion, which carried unanimously. AMENDMENTS TO AGENDA: There were no amendments to the agenda. ID CONSENT AGENDA: Commissioner Rademacher moved to approve the Consent Agenda as printed. Commissioner Conway seconded the motion, and it carried unanimously. PROCLAMATIONS: 1) ALZHEIMER'S DISEASE AWARENESS MONTH - NOVEMBER, 2013: Chair Garcia read the certificate into the record. Marcia Shafer, Regional Director, Northeast Colorado Chapter Alzheimer's Association, said her organization directly serves nine counties, with free services including education, information, consultation, and support groups, and their goal is to let more people know these resources exist, and provide information about other resources in Minutes, November 18, 2013 2013-3224 Page 1 BC0016 4 the County. She gave a short presentation on symptoms, what happens in the brain and the state of research on the disease. 2) WELD COUNTY ADOPTION DAY — NOVEMBER 22, 2013, AND NATIONAL ADOPTION DAY - NOVEMBER 23, 2013: Chair Garcia read the certificate into the record and welcomed Heather Walker, Head of the Child Welfare Division of the Department of Human Serices, who introduced Desiree Flores and Donna Haines, Adoption Case Workers, Jackie McDonald, Supervisor, and Gabrielle Brighton, Unit Manager. Ms. Walker reported 41 adoptions this year, and expressed gratitude for the recent re -organization. She thanked all the parts of this system, including the Judicial, the GALS, Attorneys, Providers, Foster Parents and Case Workers and said case workers use a valuable skill set to make sure families and kids are well matched. Commissioner Conway thanked them for their work, noting there will be eight adoptions this Friday and there was a record number this year. e PUBLIC INPUT: There was no public input. BIDS: • 1) APPROVE BID #B1300182, 2014 AMMUNITION - SHERIFF'S OFFICE: Trevor Jiricek, Director of General Services, the Sheriffs Office is recommending the low bid from Ultra -Max Ammunition. Commissioner Conway moved to approve staff's recommendation of the low bid. The motion was seconded by Commissioner Rademacher, and it carried unanimously. ID 2) APPROVE BID #B1300184, .45 CALIBER ACP TRAINING AMMUNITION - SHERIFF'S OFFICE: Mr. Jiricek said staff recommends the low bid from Proforce Marketing, Inc.; however, the Sheriffs Office is recommending the second low bid from Adamson Police Products. a Deputy Gerald Porter said Adamson has been a good provider for several years and are local. Commissioner Rademacher expressed support for the recommendation of the Sheriff's Office because the bids are close, and Commissioner Freeman concurred. In response to Commissioner Conway, Deputy Porter said these are simply suppliers, so there are no benefits, other than keeping business within the County, and they have also historically been timely with their delivery. Commissioner Rademacher moved to approve the second lowest bid in accordance with the Sheriff's Office's recommendation. Seconded by Commissioner Freeman, the motion carried unanimously. Commissioner Kirkmeyer expressed support for this, stating the Charter requires in -County vendors be given preference when bids are within a reasonable range. Commissioner Conway also noted that as ammunition becomes tougher to get it may be important to have a local vendor. ID 3) APPROVE BID #61300185, 5.56X45 MM OR .223 REM TRAINING AMMUNITION - SHERIFF'S OFFICE: Mr. Jiricek explained this is similar to the previous item and Deputy Porter said in his opinion the rifle ammunition provided by Adamson works better, but either will work, so his Office is more open to accepting the lowest bid on this one due to the price differential. Commissioner Conway moved to approve the low bid in accordance with staffs recommendation. Seconded by Commissioner Rademacher, the motion carried unanimously. Minutes, November 18, 2013 2013-3224 Page 2 BC0016 NEW BUSINESS: 1) CONSIDER TWO (2) AGREEMENTS FOR SERVICES WITH VARIOUS PROVIDERS AND AUTHORIZE CHAIR TO SIGN: Judy Griego, Director of Department of Human Services, stated these agreements are with Catholic Charities of Weld County and Greeley Transitional House to provide emergency shelter and case management, in the amount of $10,000 each, for a period from June 1, 2013 to February 28, 2014, at the reimbursement rates in the memorandum. Commissioner Freeman moved to approve said agreements and authorize the Chair to sign. Seconded by Commissioner Kirkmeyer, the motion carried unanimously. El 2) CONSIDER THREE (3) CHILD PROTECTION AGREEMENTS FOR SERVICES WITH VARIOUS PROVIDERS AND AUTHORIZE CHAIR TO SIGN: Ms. Griego explained these agreements were reviewed and the rates were approved for Paid In Full, Inc., for provision of a a role model mentor program, Counseling Services of Longmont, Inc., for provision of anger management and substance abuse programs, and Goldschmidt and Associates, LLC for polygraph examinations. Commissioner Rademacher noted the $250 cost per polygram and asked if the County could now do this in-house. Ms. Griego said that that had been discussed some years ago, and she would be happy to continue this matter to bring it up again with the Sheriff's Office. Commissioner Kirkmeyer noted that the Board was previously told these cost $500-600. Commissioner Conway noted some of these are Court ordered and need to meet specifications, and Ms. Griego said she was not sure, but this agreement might be to cover the southern part of the County. Chair Garcia said these can be approved now with the stipulation on record that in-house polygraph services would be investigated further with the Sheriff's Office. Commissioner Kirkmeyer moved to approve said child protection agreements and authorize the Chair to sign. The motion, which was seconded by Commissioner Rademacher, carried unanimously. El 3) CONSIDER PETITION FOR ABATEMENT OR REFUND OF TAXES - MASOUD SHIRAZI, S&E INVESTMENTS, LLC: Christopher Woodruff, Assessor, described the property as a distribution type warehouse. He reviewed the petition valued and stated owner is in agreement with the refund amount. Commissioner Conway moved to approve said refund of taxes. The motion was seconded by Commissioner Freeman, and it carried unanimously. El 4) CONSIDER VETERANS SERVICE OFFICERS MONTHLY REPORTS AND CERTIFICATIONS OF PAY FOR AUGUST AND OCTOBER, 2013: Toby Taylor, Veteran's Officer, presented this item of business. Commissioner Conway moved to approve said monthly reports and certifications of pay and authorize the Chair to sign. Commissioner Kirkmeyer seconded the motion and it carried unanimously. Fi 5) CONSIDER AGREEMENT FOR REPAIR AND CONSTRUCTION OF CR 87 AT SOUTH PLATTE BRIDGE AND AUTHORIZE CHAIR TO SIGN — BILL BARRETT CORPORATION: Bruce Barker, County Attorney, explained Bill Barrett will donate the services and materials to reconstruct the roadway and provide a certificate of insurance to the County for the work that they do and he recommended approval. Commissioner Kirkmeyer moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner Conway, and it carried unanimously. El Commissioner Kirkmeyer said this is indicative of the positive relationship the Board has worked hard to foster with these companies. Minutes, November 18, 2013 2013-3224 Page 3 BC0016 ID 6) CONSIDER GRANT APPLICATION FOR REPLACEMENT OF BRIDGE 13/44B - COLORADO COUNTIES, INC.: Dave Bauer, Director of Department of Public Works, said these two items are in response to a CDOT call for projects, and these two bridges over the Little Thompson River are grantable because they need substantial repair to the bridge structure itself, and flood damage is not eligible for these funds. The work would cost approximately $1.6 million and $1.2 million, with Weld County's contribution at 20 percent, and both are unlikely to commence before 2016. In response to Commissioner Kirkmeyer, Mr. Bauer said staff decided that repairs on the bridge she referenced to the north could be done cheaper in-house. Commissioner Kirkmeyer expressed concern that this bridge was not on the last approved Capital Improvement Plan (CIP) plan, and the coming year's plan has not been approved yet. Mr. Bauer confirmed these grant applications are due by 5:00 p.m. today and the problems with these had not been identified until the middle of the year. In response to Commissioner Conway, Commissioner Kirkmeyer said that she will support getting the applications in today, but every year this happens without the Board's prior approval. Commissioner Conway moved to approve said grant application. Seconded by Commissioner Rademacher, the motion carried unanimously. ID 7) CONSIDER GRANT APPLICATION FOR REPLACEMENT OF BRIDGE 19/46.5A - COLORADO COUNTIES, INC.: Mr. Bauer referred to the previous item and discussion. Commissioner Conway moved to approve said grant application submittal. The motion, which was seconded by Commissioner Rademacher, carried unanimously. 8) CONSIDER APPOINTMENT OF DEPUTY DISTRICT ATTORNEY AND CHAIR TO SIGN - JESSE MCLIAN: Commissioner Conway moved to approve said appointment and authorize the Chair to sign. Seconded by Commissioner Freeman, the motion carried unanimously. PLANNING: ID 1) CONSIDER VACATION OF RECORDED EXEMPTION, RE -4239 - THOMAS AND CAROLAN DUNN: Kim Ogle, Department of Planning Services, explained the Dunns are requesting a vacation of their January, 2006, recorded exemption in order to secure a new loan for their residence and reported the planning department is in support. In response to Commissioner Rademacher, Thomas Dunn, applicant, said he was told the two properties would not be acceptable to the lender for collateral separately. Commissioner Kirkmeyer moved to approve a vacation of said recorded exemption. Seconded by Commissioner Rademacher, the motion carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
