WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on October 23, 2013, the Board was presented with the application of
Anthony and Lorraine Stumpf, 40511 CR 17, Ft. Collins, CO 80524, for a Zoning Permit,
ZPHB13-0006, for a Class II Home Occupation (tree service business) in the A (Agricultural)
Zone District, and located in the A (Agricultural) Zone District on a parcel of land being more
particularly described as follows:
Lot A of 2nd Amended Recorded Exemption, 2nd
AmRE-1873, being part of the NE1/4 of Section 8,
Township 7 North, Range 67 West of the 6th P.M.,
Weld County, Colorado
WHEREAS, at said hearing Anthony and Lorraine Stumpf were note present, but
submitted a written request to withdraw said application, and
WHEREAS, the Board of County Commissioners, having heard all of the testimony,
finds that said request to withdraw be, and hereby is, accepted.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the request of Anthony and Lorraine Stumpf to Withdraw their
application for a Zoning Permit, ZPHB13-0006, for a Class II Home Occupation (tree service
business), be, and hereby is, accepted.

Section 23-4-990.C.5. of the Weld County Code states, "When ... negative responses are received from
at least thirty percent (30%) of the surrounding property owners within five hundred (500) feet of the
subject property, a hearing shall be scheduled before the Board of County Commissioners."
This case comes before the Board of County Commissioners due to the fact that staff has received
negative responses from approximately thirty percent (30%) of the surrounding property owners.
Description: The applicant is requesting approval of a zoning permit for a Home Occupation - Class II
a tree service business.
Staff received six (6) letters from the surrounding property owners. One letter stated 'no
concerns' and the other letters indicated that a business at this location would be
detrimental to the neighborhood. The surrounding property owner's letters outline
nuisances created by the home occupation such as noise and dust associated with the
chipping of trees and tree branches on the site.
Additionally, the surrounding property owners have indicated that the smoke generated
from the on -site wood -burning hot-water boiler is a nuisance. The decreased visibility
and odors from the smoke generated from the boiler is a cause of concern. Staff has
determined that a building permit and an inspection from the Department of Public Health
and Environment are required for a citizen to own and operate a wood -burning hot-water
boiler in the County. The applicant has not submitted a building permit for this boiler nor
received the required inspections. Mr. Phil Brewer of the Weld County Department of
Public Health and Environment has stated that this type of boiler is required to meet
certain EPA criteria. Regardless of the outcome of this public hearing the permits
regarding the wood -burning hot-water boiler are required. (This information was provided
to the applicant on September 24, 2013.)
DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE
APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section 23-4-
990.B. of the Weld County Code.
2. It is the opinion of the Department of Planning Services' staff that the applicant has shown
compliance with Section 23-4-990.D.1. thru D.B. of the Weld County Code as follows:
A. Section 23-4-990.D.1. -- Compatibility with surrounding area, harmony with the character of
the neighborhood and its effects upon the immediate area.
The applicant is requesting a home occupation for a tree service business. Currently the site
is under violation (ZCV13-00023). This violation was initiated due to the operation of a
commercial business and associated storage of vehicles and equipment without first
completing the necessary Weld County Zoning Permits.
The applicant has stated that:
1) The number of commercial vehicles will be reduced to two (2).
2) There will be no outdoor storage of materials or equipment related to the business on the
site; and
3) There will be no chipping of the wood on the site.
The above actions by the applicant will bring the site into compliance with the Weld County
Code for a Home Occupation - Class II.

B. Section 23-4-990.D.2. -- The proposal is consistent with the policies and goals of Chapter 22
of this Code.
Section 22-2-20.G - A. Goal 7 states, "County land use regulations should protect the
individual property owner's right to request a land use change."
Section 22-2-W0.E. - C.Goal 5. states "Minimize the incompatibilities that occur between
commercial uses and surrounding properties."
Section 22-2-20.G.2 - A.Policy 7.2 states, "Conversion of agricultural land to nonurban
residential, commercial, and industrial uses should be accommodated when the subject site
is in an area that can support such development, and should attempt to be compatible with
the region."
The applicant has stated that the activities associated with this home business occur off -site
and that there will be only two commercial vehicles on site. The applicant has noted that
there will be no exterior storage of equipment or materials and no wood chipping will occur
on -site.
C. Section 23-4-990.D.3. -- Availability of adequate water and sewage disposal facilities.
The property is served by the North Weld County Water District Account #2165003 as a
source of public water and has a septic system (permit number SP -9900595). The referral
comments from the Department of Public Health and Environment, dated July 3, 2013 did not
indicate any concerns with this septic system.
D. Section 23-4-990.D.4. -- The general health, safety and welfare of the inhabitants of the area
and the county.
The requirements of Section 23-1-90 for a Home Occupation - Class II and Conditions of
Approval (attached and part of the Home Occupation - Class II Permit - Conditions and
Limitations) will ensure that there are adequate provisions for the protection of health, safety,
and welfare of the inhabitants of the neighborhood and the County.
E. Section 23-4-990.D.5. -- The proposal is consistent with the definition as expressed in
Section 23-1-90 of this Chapter. The approval of the zoning permit may be conditioned or
restricted to carry out the intent of Section 23-1-90 of this Chapter or to mitigate impacts or
address concerns of referral agencies. Conditions of approval shall be met prior to recording
the permit/agreement, and restrictions may be enforced by means of conditions in the
perm it/agreement.
The applicant is requesting a Zoning Permit for a Home Occupation - Class II per the
definition in Section 23-1-90. The applicant has stated that the activities associated with this
home business occur off -site and that there will be only two commercial vehicles on site. The
applicant has noted that there will be no exterior storage of equipment or materials and no
wood chipping will occur on -site. Based on the this information, the applicant is eligible for a
(ZPHB) Zoning Permit for a Home Occupation - Class II per the Weld County Code Section
23-1-90.
Staff has attached the Home Occupation - Class II Permit - Conditions and Limitations which
contains the Conditions of Approval and addresses the items listed in Section 23-1-90.
F. Section 23-4-990.D.6. -- The application complies with any Homeowners Association (HOA)
standards, if applicable.
This parcel is not part of an HOA.

G. Section 23-4-990.D.7. -- The proposed zoning permit complies with Division 13 of this Article.
The applicant has stated that the activities associated with this home business occur off -site
and that there will be only two commercial vehicles on site. The applicant has noted that
there will be no exterior storage of equipment or materials and no wood chipping will occur
on -site. Therefore, it appears as if this request for a zoning permit complies with Division 13 -
Home Occupation - Class II Permits.
H. Section 23-4-990.D.8. -- An access is or can be made available that provides for safe ingress
and egress to a public road. All accesses shall be in accordance with Chapter 12, Article V of
this Code, and shall endeavor to achieve the goal of no "net increase" in the number of
accesses onto adjacent County roads when accesses already exist.
The site has one access point off of County Road 17. Per the referral comments from the
Department of Public Works, dated July 19, 2013 there are no concerns identified with the
access point for this site.
Carlson Court is part of the subdivision Prairie Ridge Estates that surrounds the property but
does not include the property. The cul-de-sac, Carlson Court, is adjacent to the property on
the north-eastern boundary; however, there is no access off of Carlson Court to the site.
This recommendation is based, in part, upon a review of the application materials submitted by the
applicant, other relevant information regarding the request, and responses from referral entities.
The Department of Planning Services' staff recommendation for approval is conditional upon Statement
of Terms and Conditions (attached).

The following is a compilation of the requirements imposed by the Board of County
Commissioners of Weld County Colorado on behalf of Weld County (hereinafter called
"County,"), for all business entities and/or individuals who have received Home Occupation —
Class II land use permit to operate a commercial enterprise.
In this case, Permittee is the owner of the following described property in the County of Weld,
State of Colorado:
Lot A 2nd Amended Recorded Exemption 2ndAmRE-1873; Part
NE4 of Section 8, T7N, R67W of the 6th P.M., Weld County, CO
hereinafter referred to as "the Property," and
Under the terms of the Permit, Permittee is allowed to conduct the following commercial
enterprise: tree service business.
Permittee acknowledges that the issuance of the Home Occupation — Class II permit is
conditional upon Permittee's completion of the improvements and/or meeting of the conditions
which are described below.
Permittee is not allowed to engage in any activity described in the above paragraph and/or any
activity related to the business(es) described above, (OR ANY OTHER ACTIVITY WHICH HAS
NOT HERETOFORE BEEN PERMITTED), until said improvements have been completed or
said conditions have been met.
A. Required Conditions: The following conditions must be met at all times throughout the
existence of the Home Occupation — Class II permit.
1. The business use of the property must be secondary to the use of the property as a
dwelling site.
2. Hours of operation for public access shall be limited between 7:00 a.m. and 7:00
p.m.
3. No exterior storage of materials, goods, supplies or equipment related to the
business is permitted.
4. The size of the business area is limited to fifty percent (50%) of a dwelling unit and/or
in accessory buildings with appropriate building permits.
5. The business shall be conducted by the inhabitants of the dwelling plus no more than
two (2) external employees.
6. Only incidental sales of stocks, supplies or products shall be conducted on the
premises.
7. The parcel is limited to two (2) commercial vehicles.

8. The business use must not create any negative impact to the public health, safety or
welfare of adjacent property owners.
9. Only one sign advertising the business shall be allowed, subject to the following
restrictions:
a. Sign must be non -illuminated;
b. Sign must be no greater than nine (9) square feet
c. Sign must be attached to the face of the dwelling unit.
10. The traffic volume produced by the business must not exceed that produced by the
dwelling unit by more than sixteen (16) trips daily. Eight vehicles create sixteen trips
as each single vehicle creates two trips. Trips include those produced by the
residents for purposes related to the business, the one or two employee(s), clients,
deliveries, and etc.
11. The applicant shall maintain compliance with Health, Building and all other local,
state and federal regulations.
12. County Road 17 is a local paved road and requires a 60 -foot right-of-way at full build
out. There is presently a 60 -foot right-of-way. This road is maintained by Weld
County.
13. Should noxious weeds exist on the property or become established as a result of the
proposed development, the applicant/landowner shall be responsible for controlling
the noxious weeds, pursuant to Section 15-1-180 of the Weld County Code.
14. The applicant shall submit a dust abatement plan for review and approval, to the
Environmental Health Services, Weld County Department of Public Health &
Environment.
15. The applicant shall submit a waste handling plan, for approval, to the Environmental
Health Services Division of the Weld County Department of Public Health &
Environment. The plan shall include at a minimum, the following:
a) Final disposition of the wood waste, including the name, address and phone
number of the disposal facility (e.g. compost site).
16. This facility shall adhere to the maximum permissible noise levels allowed in the
Residential Zone as delineated in Section 14-9-30 of the Weld County Code.
17. The applicant shall ensure that there is no wood chipping on the property.
18. The applicant shall obtain all the required inspections and permits for the wood -
burning, hot-water boiler from the Weld County Building Department, the Department
of Public Health and Environment, and the State, as applicable.
B. Timing of Improvements: Permittee shall be required to complete all improvements
and/or meet the limitations of the foregoing conditions within 60 days of the issuance of
the Permit.
C. Violation of Terms: If Permittee does not perform as outlined in this document, such
non-performance will constitute a violation of Permittee's Home Occupation - Class II
permit granted by County, and County will take whatever remedial measures it deems
necessary against Permittee. In addition to any other remedy available to the County in
law or equity, a failure to meet the conditions will result in the loss of the permit and in
the initiation of legal action against the Permittee.

D. Enqineerinq Services: In the event that Permittee is required to complete any
improvements or meet any conditions which require the services of an engineer,
Permittee shall furnish, at its own expense, all such services. The required engineering
services shall be performed by a Professional Engineer and Land Surveyor registered in
the State of Colorado, and shall conform to the standards and criteria established by the
County for public improvements. The required engineering services shall consist of, but
not be limited to, surveys, designs, plans and profiles, estimates, construction
supervision, and the submission of necessary documents to the County.
E. Successors and Assigns: This Home Occupation - Class II permit may not be delegated,
transferred or assigned in whole or in part by Permittee. This Permit shall terminate
immediately upon the sale of the Property and or commercial enterprise, the cessation of
the commercial enterprise, or the death of the Permittee (if the Permittee is an
individual). County's rights and obligations under this Agreement shall automatically be
delegated, transferred or assigned to any municipality which, by and through annexation
proceedings, has assumed jurisdiction and maintenance responsibility over the roads
affected by this Agreement.
F. Violation of Terms of Agreement: If in County's opinion, Permittee has violated any of
the terms and conditions set forth in this document, County shall notify Permittee of its
belief that there have been violation(s) and shall state with specificity the facts and
circumstances which County believes constitute the violation(s). Permittee shall have
fifteen (15) days within which to either cure the violation or demonstrate compliance. If,
after fifteen (15) days have elapsed, County believes in good faith that there has been a
violation of the terms of this Agreement, County shall initiate proceedings to revoke the
Home Occupation — Class II permit.
G. Termination of Permit: A Home Occupation — Class II permit shall terminate upon the
earliest of the following events:
1) Cessation of all Permit Related Activities: Termination of the Permit shall occur upon
Permittee's complete cessation of all activities permitted under the terms of the
Permit. Permittee shall provide written notice to County of a cessation of activity,
which the County shall then verify. If written notice is not provided to the County,
termination of the Permit shall occur three (3) years after County observes the
cessation of the activities for which the Permit was issued.
2) Execution of Replacement "Home Occupation — Class II Agreement": The
Agreement shall terminate following County's execution of a new Home Occupation
— Class II Agreement with a new Permittee who has purchased or then inhabits the
Property, and intends to make use of the rights and privileges available to it through
the then existing Home Occupation — Class II permit.
3) Sale or Transfer of Property and/or Commercial Enterprise: The Permit shall
immediately terminate upon Permittee's sale or transfer of the property upon which
the commercial enterprise is conducted. The Permit shall also terminate immediately
upon Permittee's sale or transfer of the commercial enterprise.
H. Governmental Immunity: No term or condition of this agreement shall be construed or
interpreted as a waiver, express or implied, of any of the immunities, rights, benefits,
protections or other provisions, of the Colorado Governmental Immunity Act §§24-10-
101 et seq., as applicable now or hereafter amended.

I. No Third Party Beneficiary Enforcement: It is expressly understood and agreed that the
enforcement of the terms and conditions of a Home Occupation — Class II permit, and all
rights of action relating to such enforcement, are strictly reserved to the County.
By its signature below, Permittee specifically acknowledges receipt, review and understanding
of the information contained in this document entitled "HOME OCCUPATION CLASS II
PERMIT, CONDITIONS AND LIMITATIONS". Permittee shall be bound by the requirements set
forth herein, and by any documents attached hereto.

Dear Ms. or Mr.:
We are requesting a renewal or replacement of a permit for a for a new septic
system, G-920261, to be built at 40511 WCR 17 which expired October 30, 1993.
We plan to build a single family residence under building permit no. 41771,
issued September 9, 1993, on a 132 acre parcel of farmland, located 7 miles
north of Windsor.
We were unable to get a contractor to put in a septic system when we requested
it in September of 1993 because of the large increase in building activity
in the Fort Collins area is the fall of 1993 and all of the contractors were
busy at that time. We were able to get a foundation poured and some of the
underground work was started. However, when the winter weather set in last
October we decided to put off further work until spring.
There have been no changes in the planned location or use of the septic system
since the permit was issued.
We would greatly appreciate your attention to this request at the earliest
opportunity.

Thank you for the email dated 8/26/13. (below) In that email you state that you have three (3) commercial vehicles. "We
own a 1971 Ford flat bed, and a 1975 ford flatbed with a bucket lift mounted on it. We also own a 1999 Dodge van used in
our cleaning business." Per Section 23-1-90 a Home Occupation — Class 11 allows two (2) commercial vehicles. (see
below). Since the number of commercial vehicles exceeds the amount allowed in a Class II Zoning Permit you will need
to submit for a Use by Special Review Permit (USR).
The first step in applying for a USR permit is to have a Pre -Application meeting with staff. Please fill out the attached Pre -
Application form both front and back and submit it to me and I will schedule a meeting here at the planning offices.
Overview of the USR process: The USR fee is $2,500.00 dollars and takes about 6 months to complete. There will be two
public hearings and all the property owners within 500 feet of your parcel will be invited to testify at both public hearings.
The deadline to have the Pre -Application form submitted is September 10, 2013.
HOME OCCUPATION — CLASS II: A HOME OCCUPATION — CLASS II shall be conducted by the inhabitants of
the DWELLING UNIT plus up to two (2) external employees and comply with all criteria called out in the HOME
OCCUPATION definition above. Two (2) associated COMMERCIAL VEHICLES can be included under this
application. There shall only be incidental sales of stocks, supplies or products conducted on the premises. Signage: may
consist of a maximum of one (I) nonilluminated sign no more than nine (9) square feet in size which must be attached to
the face of the DWELLING UNIT. Does not produce traffic volumes exceeding that produced by the DWELLING UNIT
by more than sixteen (16) average daily trips, provided adequate off-street parking is provided. Please keep in mind that
one ( I ) vehicle produces two (2) trips, one ( I ) when arriving and one ( I ) when leaving. Therefore, an average of only
eight (S) cars can come to the property per day. Trips include those produced by the residents for any purpose related to

conducting the business, the two (2) employees, clients, deliveries related to the business, etc. Ordinarily, a HOME
OCCUPATION — CLASS II shall include uses similar to hair salon, welding shop, tax preparation with customers, etc.,
provided it meets the criteria set forth.

Environmental Health Services has reviewed this proposal to allow a home business for
a tree service business. According to the application, the business will be operated by
the residents, no outside employees.
The existing residence is served by an individual sewage disposal system (Permit No.
G19920261), and by North Weld County Water District (Acct. No. 2165003). There is
also an existing septic system connected to the barn on the property (Permit No. SP -
9900595).
The application states that wood splitting and brush chipping operations will occur once
per week. Noise from the wood splitting and brush chipping operation should comply
with noise standards as designated for the residential zone district which is 55 decibels
from 7 a.m. to 9 p.m. There was no information in the application on the final
disposition of the wood waste.
The following conditions are recommended to be part of any approval:
1. The applicant shall submit a dust abatement plan for review and approval, to
the Environmental Health Services, Weld County Department of Public Health
& Environment.
2. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of
Public Health & Environment. The plan shall include at a minimum, the
following:
a) Final disposition of the wood waste, including the name, address and
phone number of the disposal facility (e.g. compost site).
3. This facility shall adhere to the maximum permissible noise levels allowed in
the Residential Zone as delineated in Section 14-9-30 of the Weld County
Code.

is not an EPA approved/certified device for use in the State of Colorado.
The reason this is not approved/certified is in the basic design and operation of the unit.
This unit utilizes burning wood for heat. The combustion products and smoke are released uncontrolled
to the ambient atmosphere (nothing between the burning wood and stack to collect or reduce air
pollutant emissions). To control or regulate water temperature in the surrounding jacket the device is
designed to reduce the volume of combustion air supplied to the combustion chamber . The result is
increased generation of smoke emissions that likely will result in violation of Colorado air pollution
regulations.
The smoke emissions during routine use of the boiler are likely in violation of the Colorado Air Quality
Control Commission Regulation No. 1, II.A.1. and II.A.2, which read:
II.A.1.: "Except as provided in paragraphs 2 through 6 below, no owner or operator of a source should
allow or cause the emission into the atmosphere of any air pollutant that is in excess of 20% opacity"
(stationary sources).
II.A.2.: "Except as provided in paragraphs 3 through 6 below, no owner or operator of an intermittent
source shall allow or cause the emission into the atmosphere of any pollutant that is in excess of 20%
opacity..." (intermittent sources).
The regulation in paragraph 6 referred to above exempts the following devices from the 20% opacity
rule. This section reads:
II.A.6.a.: "Emissions from fireplaces, fireplace inserts and stoves, provided such devices are burning only
clean dry wood or wood products and are used for noncommercial or recreational purposes."
The Central Boiler E Classic 2300 outdoor, wood -burning, water boiler is neither a fireplace, a fireplace
insert, nor a stove.
The approved reference test method for visible emissions measurement is EPA Method 9 (40 CFR, Part
60, Appendix A [July, 1992]).
Valid opacity evaluations using EPA Method 9 are performed only by an EPA certified opacity (smoke)
evaluator who is re -certified every 6 months.

The operation of outdoor, wood -burning, hot-water boilers in Colorado is subject to Colorado Air Quality
Control Commission, Regulation No. 1.II.A.1. that reads:
II.A.1.:
"Except as provided in paragraphs 2 through 6 below, no owner or operator of a source shall allow or
cause the emission into the atmosphere of any air pollutant that is in excess of 20% opacity. This
standard is based on 24 consecutive opacity readings taken at 15 -second intervals for six minutes. The
approved reference test method for visible emissions measurement is EPA Method 9 (40 CFR, Part 60,
Appendix A (July, 1992)) in all subsections of Section II. A and B of this regulation."
II.A.2.: "Intermittent Sources:
Except as provided in paragraphs 3 through 6 below, no owner or operator of an intermittent source
shall allow or cause the emission into the atmosphere of any pollutant that is in excess of 20% opacity.
If EPA Method 9 (40 CFR, Part 60, Appendix A (July, 1992)), a continuous emissions monitor, or other
credible method is used and 24 consecutive opacity readings are taken at 15 -second intervals cannot
be taken because such a source does not operate continuously for six minutes, the readings shall be
taken at 15 -second intervals during the periods of operation until 24 readings have been made or for a
period of thirty minutes, whichever is sooner, and the source shall be deemed in violation if the
average opacity of suchf readings exceed 20%"
II.A.3.: "Pilot Plants and Experimental Operations:
No owner or operator of a process unit of a pilot plant or experimental operation shall emit or cause
to be emitted into the atmosphere from any such process unit particulate matter for a period or
periods aggregating more than six minutes in any sixty consecutive minutes which is in excess of 30%
opacity..."
I I.A.4. "Fire Building, Cleaning of Fire Boxes, Soot Blowing, Start-up, Process Modification or
Adjustment of Control Equipment Except as provided in Sections ll.A.6, no owner or operator of a
source shall allow or cause to be emitted into the atmosphere any air pollutant resulting from the
building of a new fire, cleaning of fire boxes, soot blowing, start-up, any process modification, or
adjustment or occasional cleaning of control equipment, which is in excess of 30% opacity for a period
or periods aggregating more than six minutes in any sixty consecutive minutes."
Summary of the Central Boiler, E Classic 2300 operating at 40511 WCR 17.
Smoke emissions from a Central Boiler, E Classic 2300 in Colorado is regulatorily limited to emissions of
20% opacity smoke. 30% opacity smoke is allowed only during start-up, process modification, or
adjustment of control equipment for a period of six minutes in any sixty consecutive minutes.
This referenced device is not an EPA -certified wood burning device as it is specifically engineered and
designed to restrict air flow to the burning wood mass when the water in the jacket surrounding the
combustion chamber reaches a preset temperature. Restricted air flow will result in a drop of
temperature of the combustion chamber and the water in the jacket.
Restricted air flow to the burning wood in the combustion chamber will result in increased opacity of
the smoke generated and emitted from the stack.
The opacity of this generated and emitted smoke likely will be >20% opacity. The opacity of the smoke
may be >70% (90-100% may be observed during air -restricted burning).
The evaluation of the opacity of emitted smoke must be conducted by an EPA Method 9, certified
opacity evaluator. I am re -certified every 6 months for this purpose. Presently, I am the only certified
person on staff of the WCDPHE.
I must be notified when smoke emissions are observed so that I can arrive during the emissions event
for conduct of the Method 9 evaluation. As I am only certified to evaluate smoke emissions during the
daytime, smoke emissions opacity between sunset and sunrise is not possible. I am aware of only one
person in Colorado who is certified to evaluate opacity at night.

violation was initiated due to the operation of a commercial business and associated storage of vehicles
and equipment without first completing the necessary Weld County Zoning Permits. This case has not
been presented to the Weld County Court Magistrate through the Violation Hearing process. Since this
application was submitted prior to an actual court date being scheduled, no investigation fee is required.
Due to records release laws, staff no longer tracks complainant information, but please be aware it is

Dear Ms. Aungst:
These are our comments on the zoning permit, case number ZPHB13-0006. We know some of
these comments do not pertain to the permit but we are trying to show the history of the
Stumpf family since they have moved to their location in 2008.
1. Anthony Stumpf has run a carpet cleaning business from this location since they moved
to this location.
2. They have had multiple non family members renting and residing in parts of the house
from them over the years.
3. We have had numerous issues with the Stumpf dogs running free and coming on our
property. I have discussed this with Anthony Stumpf and he agrees to keep his dog's
home but they still come back and run around free after a period of time.
4. Since his son started his tree service at least a year ago the traffic has increased and
especially the noise. The grinding of tree limbs and sawing up trees on the property is
very annoying as it can last for a long periods of time.
5. Some of the tree service equipment appears to be in bad shape and in need of repair.
Notably a large bucket truck which engine runs badly and smokes severely when they
drive by.
6. They have appeared to have installed an outside wood boiler and large outside wood
storage shed to supplement heat for their house. They use some of the wood from the
tree service for their wood supply. The odor in the winter is a constant bad smell of
burning wood (possibly green or unseasoned wood) when we go outside. You cannot
stand to be outside due to the smell like a pungent forest fire. We are concerned about
the particulate levels they are creating and adding to the pollution levels in our area as it
burns constantly in cold weather.
7. We are also very concerned that when they bring in trees and grind them up from any
location their business takes them. They can bring in diseased trees such as beetle kill
and Dutch elm disease. Proper diagnosis of diseased trees and proper disposal of
diseased trees are of upmost concern.
8. What chemicals do they intend to store in this location. Do they have proper permits
and facilities to store chemicals? Are they properly licensed to use these chemicals?
How are they going to properly dispose of outdated and unused chemicals?

9. The rezoning letter does not specify what activities they are allowed to pursue if this
rezoning is approved. We would like to know to what extent their business is allowed to
do such as the possible sale of firewood, mulch and other tree byproducts. If so, this
would lead to more traffic and a dead end road where there is an intersection of 5
private drives.
10. After reading the Weld County Residential Zone District regulation Sec. 23-3-10 thru
Section 23-3-160 we do not see anything about for use as pertaining to this request for
Class II home occupation tree service business. Sec. 12-3-40 (Uses by special review)
does not have any use listed pertaining to this request.
11. The Stumph's have in the past proven not to be respectful of their neighbor's rights on
numerous occasions. We are not trying to be over critical as we realize they also have
rights.
As for reasons cited above, we strongly object to this rezoning permit and feel you should deny
the request for zoning permit number ZPHB13-0006. This is a residential agricultural zoned
neighborhood and should remain with no new special zoning. Your approval of this permit
would allow for more daily noise, traffic and road dust.

regarding Case Number ZPHB 13-0006. This project, regarding a zoning permit for a
class II home occupation (Tree service business) in the A (Agricultural) zone district, is
of concern to us and the following is why we object to having this approved.
History
For purposes of discussion, see attachments. Attachment #1 is a plat map that shows our
property (Lots #7 & #8) in relation to the property owned by Anthony Stumpf.
Attachment #2 is an aerial view that shows the property surrounding Anthony Stumpf s
property (outlined in red).
Attachment #3 is an aerial view that shows where the current activity involving wood
materials appears to be occurring on the Stumpf property.
Just prior to our planning to build our home in 2007, we were told that the land related to
this current zoning request was in the process of being sold to a new owner. This owner
intended to build an "event center" on the property. Chris Gathman was the county
planner overseeing this request. All property owners surrounding this location objected to
this because of its potential impact on the area. In the spring of 2007, Weld County
refused the request for permission to build the event center.
The potential owner of the property backed out and the property went into foreclosure. A
short while later, the property was purchased by Anthony Stumpf. From that point
forward, there have been several incidents caused by the Stumpf family that have raised
concerns on the part of the surrounding property owners. Among these incidents are
these:
1. Individuals living at the Stumpf location would drive across our property to get
access to Carlson Court, a private road owned by our subdivision.

2. When asked to stop doing this, the former owner of our subdivision found that a
section of fence had been cut to allow access to Carlson Court without having to
drive across our land. This required repair to the fence.
3. Individuals living at the Stumpf location were disturbing the neighbors by driving
motorcycles and other vehicles into their yards at high speeds.
4. Dogs owned by people at the Stumpf location were roaming the neighborhood,
chewing up irrigation pipe and frightening horses.
5. On July 4`h, people attending a gathering at the Stumpf location shot aerial
fireworks over our property, setting it on fire.
6. It has been clear that the Stumpf family has been renting out a portion of their
property to individuals over the past few years.
In addition to points added below, these incidents suggest strongly that there is a
disregard for allowed activities in a rural setting. Despite neighbors expressing their
concerns, the Stumpf s response has been minimal.
Recent Activities
There have been two specific activities noted recently that may be related to the request
for the zoning permit cited in your notification. The first has to do with what appears to
be a wood -burning boiler. The second involves the gathering, processing, and storing of
large quantities of wood on the Stumpf property.
With regard to the wood -burning boiler, we began to notice a large amount of smoke
coming across our land this winter. In addition, if we tried to open our garage door, the
garage would be filled with smoke. After looking into it, we saw what appeared to be a
small structure with a smokestack on their property. This is located in the circled area
shown on Attachment #3. Attachment #4 is a photo taken while the wood -burning boiler
was in operation. We have been in touch with Phil Brewer, Weld County Department of
Public Health & Environment: Environmental Services to look into this. According to
what he found, it appears the smoke has, at times, exceeded what the county allows.
Thus far, however, we have noticed no effort to curtail this issue and expect it to recur
when the colder weather returns.
Insofar as the wood -related activities are concerned, we have noticed that there is a lot of
cutting, moving, storing, and "chipping" of wood going on in the general area circled on
Attachment #3. Some of the wood can be seen to the right of the wood -burning boiler in
Attachment #4. The noise level associated with much of this activity has been quite
annoying on several occasions.

Our View
Given all that has occurred since this property has been acquired, we are quite concerned
about how the property has been used and are more than a little worried about how a
change in permit will further impact us.
The details related to this "Tree Service Business" have yet to be revealed. But, among
other concerns, we are worried about the possibility of bringing in insects and wood -
related diseases that could affect our landscaping. In fact, our landscape company has
already raised this issue with us.
The noise level associated with the current activities suggest this won't improve with a
change in permit. And we also would want to know what chemicals might be used in the
course of such a business as we don't want to find that this has now become another
problem for us to deal with.
In reviewing the Weld County information on Zone Districts, we looked for information
related to the use of property zoned for agricultural. We are having a hard time
understanding why a "tree service business" would be considered in this zone. For
example, in Section 23-3-40 (Uses by special review), we cannot fmd reference to such a
business as fitting into this category. Also, given the apparent history of rental activity on
the Stumpf property, this does not seem to fit the standard set in Section 23-3-20 (Uses
allowed by right).
Given everything cited above, we would request that this change of zoning be denied.

We understand that Anthony and Lorraine Stumpf will meet with the Board of Commissioners on October 23,
2013 concerning their intent to continue operating a tree service business at their home located on a spur off of
WCR 17. Although our home at 30461 WCR 17 is not adjacent to the Stumpfs property we are directly down
wind from it which explains why we experienced numerous acrid odors coming from that property during the
past year.
Until talking with Dick Hill I was mystified concerning the source of the burning odor which is apparently
caused by the Stumpfs use of a boiler to heat their home which includes a rental wing that is occupied by
unrelated persons. This unusual and terribly unpleasant odor is extremely objectionable. It would seem to us
that the use of a wood burning boiler that functions regularly without appropriate environmental controls is very
likely illegal.
In addition to this, we are very concerned about the intent the Stumpfs have to increase their depository of
potentially diseased wood (a very large building on their property is filled with it).
