RE: APPROVAL OF RECORDED EXEMPTION NO. 420 - SUTTER, INC.
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing held on
the 12th day of September, 1979 in the Chambers of the Board of
County Commissioners of Weld County, Colorado that the division
into two parcels of land, as shown on the plat known as Recorded
Exemption No. 420, being the property of Sutter, Inc. , described
as Part of the Northwest Quarter of Section 15, Township 6 North,
Range 65 West of the 6th P.M. , Weld County, Colorado, being more
particularly described as follows :
All that part of the Northwest Quarter (NW4)
of Section Fifteen (15) , in Township Six (6)
North, Range Sixty-five (65) West of the 6th
Principal Meridian, Weld County, Colorado,
except that part lying North and East of the
New Cache La Poudre Irrigating Company
does not come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not with-
in the purposes of the Weld County Subdivision Regulations and
the Board desires to exempt this particular division of land
from the definitions of "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS 1973,
as amended, and Section 2-lA(3) of the Weld County Subdivision
Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Sutter, Inc. be, and hereby is, exempt
from the definition of the terms "subdivision" and "subdivided
land" pursuant to its authority under Section 30-28-101 (10) (d) ,
CRS 1973, as amended.

Dear Commissioners :
The attached application, plat , and related items are in reference to
a request from Sutter, Inc. , for approval of a recorded exemption.
The property is described as Pt . NWl Section 15, T6N, R65W of the 6th
P.M. , Weld County, Colorado. The property is located 1/2 mile north
and 2 miles east of Lucerne. The property contains approximately 67
acres of Class II irrigated soils. The request is to divide the pro-
perty into parcels of 1.4 acres and 65. 6 acres.
On August 8, 1979, the Board of County Commissioners approved a lot
size variance for Sutter, Inc. , so that it could make application for
this recorded exemption. At the time the Board made the decision on
that request, the Department of Planning Services Staff submitted a
letter of recommendation for approval to the Board. A copy of that
letter for approval is included in the attached packet . Nothing has
been received by our office that would change our recommendation of
approval for this request as outlined in the letter to the Board of
County Commissioners dated August 8, 1979. This request complies with
the provisions of Section 9-4 A. of the Weld County Subdivision
Regulations.

Dear Commissioners:
The attached letter and related materials are in reference to a request
for a lot size variance from Sutter , Inc . The parcel of land under
consideration is described as Pt . NW$ Section 15, T6N, R65W of the 6th
P.M. , Weld County, Colorado . This property is located 1/2 mile north
and 2 miles east of Lucerne. The property contains approximately 63
acres of Class II irrigated soils . The request is to obtain a variance
from the minimum lot size requirement , Section 9-4 A(6) so that Sutter ,
Inc. may make application for a recorded exemption.
If this lot size variance is granted, Sutter, Inc . will proceed with an
application for a recorded exemption to divide the property into two
parcels of approximately 2 acres and 66 acres. Sutter, Inc. wishes to
sell the smaller improvements parcel due to problems with maintenance
of a rental unit. The applicants will continue to farm the remaining
66 acre parcel.
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services Staff recommends the re-
quest be approved for the following reasons :
1. The proposed split conforms with Section 9-2 of the Weld County
Subdivision Regulations ( intent clause of the recorded exemption
procedure) , Section 3 . 3 A of the Weld County Zoning Resolution
(intent clause of the Agricultural Zone District ) , and the Weld
County Comprehensive Plan. The use will be compatible with
surrounding agricultural uses. The request will allow agri-
cultural and related uses to he the predominant land use. There
will be no reduction in the amount of land currently being used
for agricultural production.

2. This request complies with the provisions of Section 9-4 A. of
the Weld County Subdivision Regulations.
The Department of Planning Services Staff would like to make the appli-
cant aware of Weld County setback requirements. The Agricultural Zone
District requires a side and rear yard setback of 3 feet , and a front-
yard setback of 50 feet .

I have been requested, by Mrs. Jennifer Sutter, to give my opinion
on the availability of domestic water on a tract of land,
approximately 1.8 acres, located in the NW i of section 15 T 6 N
R65W-6P.M.
The subject property is serviced by a six inch hard-water well,
sixty feet deep with a static water level of fifteen feet. At
present, there is a 4- h.p. jet pump in the well pumping 12 g.p.m.
which is quite adequate for domestic use.
The balance of the farm is served by an irrigation well and pump
for the irrigation of farm crops. This well is capable of
producing 600 to 800 g.p.m. which would indicate a very good
water bearing aquifer.
