RESOLUTION
RE: APPROVAL OF INTERGOVERNMENTAL AGREEMENT BETWEEN WELD COUNTY
AND THE CITY OF FORT LUPTON.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, an intergovernmental agreement between Weld County
and the City of Fort Lupton concerning paving a portion of Weld
County Road 14 , has been presented to the Board of County Com-
missioners of Weld County, Colorado. A copy of said agreement
is attached hereto and incorporated herein by reference, and
WHEREAS, after reviewing said intergovernmental agreement,
the Board deems it advisable and in the best interests of Weld
County to approve said intergovernmental agreement.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the intergovernmental
agreement between Weld County and the City of Fort Lupton con-
cerning the paving of a portion of Weld County Road 14 be, and
hereby is, approved.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 3rd day of
January, A.D. , 1979.

INTERGOVERNMENTAL AGREEMENT
THIS AGREEMENT made this 3rd day of January
197 9 between WELD COUNTY, a. body corporate and politic and a
subdivision of the State of Colorado and the CITY OF FORT LUPTON.
WHEREAS, the City of Fort Lupton and the County of Weld are
desirous of having a portion of Weld County Road 14 (also known as
9th Street in Fort Lupton) paved, and
WHEREAS, both parties desire that, such road, after being
paved, be annexed to the City of Fort Lupton.
The Parties agree as follows :
1) That the City of Fort Lupton shall enter into a contract
for the paving of Weld County Road 14 from that point at which
the entire width of the right-of-way is inside the city limits of
Fort Lupton to the point where it intersects Weld County Road 291.
2) Prior to entering into a contract for paving, the City
of Fort Lupton shall advertise for bidding in such a manner as to
assure open and competitive bidding and shall give preference to a
resident Weld County bidder where the bids are competitive in price
and quality.
3) The Contract shall be preceded by an acceptable proposal
and may not be executed or awarded until the selection of the contractor
and the terms of the contract shall have been approved by Weld county.
All changes in the contract shall be by supplemental agreement and . .
must have prior approval of Weld County.
4) Prior to awarding the contract, Fort Lupton shall submit
to Weld County an itemized list of costs, and a further breakdown of
the amount of costs to be reimbursed by Weld County.
5) Fort Lupton shall maintain all books, documents , papers,
accounting records and other evidence pertaining to costs incurred
and to make such materials available for inspection at all reasonable
times during the period of this agreement.
6) Weld County shall reimburse Fort Lupton for the cost of
only the asphalt surface lying within Weld County, not to exceed a

total cost of $20 ,000. Should the expected cost of this asphalt sur-
face, as shown by the bids received for the project, exceed $20 ,000,
then Fort Lupton and Weld County shall re-negotiate the, .amount that
Weld County is to reimburse Fort Lupton. Should the parties be unable
to reach an agreement as to the amount of Weld County's share within
45 days of the bids having been opened, then this contract shall term-
inate without further action or notice by either party.
7) Prior to the reimbursement, the paving must be completed,
a final itemized bill of cost must be submitted to Weld County, and
Fort Lupton shall have annexed the portion of road within Weld County
to be included within the municipal boundaries of Fort Lupton.
IN WITNESS WHEREOF, the parties hereto have caused the fore-
going agreement to be executed the day and year first above written.
