'-It r ' •tot3-. _:~h r. ¶, a • . 4 ' , _ • • r • September 10, 2013 Weld County Commissioners Greeley, Colorado RE: Schleining Special Use Permit RECEIVED SEP 10 2013 WELD COUNTY COMMISSIONERS The purpose of this letter is not intended to deny anyone the right to make a living, however when that pursuit negatively impacts my quality of life and economic well-being then I feel compelled to respond. The following is an outline of my concerns. 1. The request is for too many cattle for the amount of land. It is unreasonable to put 7,250 head of cattle, feed storage, lagoons and a cattle handling facility on 70 plus acres of land. 2. There is a significant drainage issue, which has not been addressed, other than diverting the water onto the County Road. 3. This proposal calls for locating pens and feed handling facilities far too close to HWY 14, which has considerable more traffic on it. I have called Mr. Schleining numerous times to suggest that he stop grinding because the dust was so thick going across the highway that it was dangerous to the vehicle on the road. 4. The feed handling and cattle pens are too close to the neighboring homes. The proposal, as outlined, will have a significant impact on the neighboring property owners. a. Property values will be adversely affected due to the proximity of the pens and feed grinding operation. b. Our quality of life is being compromised due to the dust, order and flies. A more reasonable solution is: Reduce the permit to 4,000 head. (If you check you will see that this is quite a large number of animals for less than 80 acres of land.) Move the expansion west to the middle of the property. This moves the pens away from the neighbors and gets the hay grinding away from the highway and the neighbors. By moving everything to the west it also mitigates the drainage issue. The present proposal requires significant dirt work to make the water run uphill which in turn would divert the flood water onto the County Road. Moving the operation to the west is the right thing to do to protect the neighbor's property rights. The value of neighboring land should not be negatively impacted due to the proximity of a feedlot. I expect that this proposal will be amended to insure that my quality of life and property values are not adversely affected. This is a reasonable solution. To do otherwise is going to inflict unreasonable damages on the neighbors. I urge you to not just rubber stamp this request and to carefully look at the solution that I have set forth. The holding pond is downgrade from SH 14 and will not outlet into the right-of-way for SH 14. If there are pre- existing drainage issues near the intersection with WCR 39, I don't see where the cattle operation would cause these issues to worsen. I also looked into any potential legal history at this site involving CDOT and the State Engineer's Office, but was not able to locate any such records. No one I spoke to here in the Region had any recollection of litigation here.
