BOARD OF COUNTY COMMISSIONERS
WELD COUNTY, COLORADO
NOVEMBER 20, 2013
The Board of County Commissioners of Weld County, Colorado, met in regular session in full
conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County
Administration Building, Greeley, Colorado, November 20, 2013, at the hour of 9:00 a.m.
a ROLL CALL: The meeting was called to order by the Chair and on roll call the following members
were present, constituting a quorum of the members thereof:
Commissioner William F. Garcia, Chair
Commissioner Douglas Rademacher, Pro-Tem
Commissioner Sean P. Conway
Commissioner Mike Freeman
Commissioner Barbara Kirkmeyer

• MINUTES: Commissioner Conway moved to approve the minutes of the Board of County
Commissioners meeting of November 18, 2013, as printed. Commissioner Rademacher seconded the
motion, and it carried unanimously.
le AMENDMENTS TO AGENDA: There were no amendments to the agenda.
• CONSENT AGENDA: Commissioner Rademacher moved to approve the Consent Agenda as
printed. Commissioner Conway seconded the motion, and it carried unanimously.
PRESENTATIONS:
▪ 1) MOUNTAIN VIEW FIRE PROTECTION DISTRICT CERTIFICATE OF APPRECIATION TO
THE BOARD OF WELD COUNTY COMMISSIONERS: Chief Mark Lawley spoke in regard to the
District's appreciation to the Board for the van they purchased last year, at a discount, from Weld
County and are using to house a public education tool presented to over 15,000 children called
Barnyard Safety Buddies. Chris Allard, Foundation Director, gave an overview of the district, and
said they have lowered their ISO fire suppression ratings, which were at a 3/9 as of December 1, 2012.
They operate on a cash basis with five stations (soon to be six), and earned Accreditation through the
Commission on Fire Accreditation International in August, 2013. Amy Fallon, Public Relations
Officer, talked about the thought process behind their Community Outreach Safety program, which is
targeted to younger kids and uses animated farm animals to demonstrate safety actions such as: Stop
Drop and Roll, How to Call 911, Fire Alarm, Poison Control, Pedestrian Safety and Helmet Safety. She
noted 90 percent of kids don't wear the correct size helmet, so correcting that is a huge benefit of the

program. She outlined the District's 13 Safety and Wellness Programs, and said next year they will
offer many of these in Spanish. la Chief Lawley reiterated his district's appreciation for the moral,
financial and public support the Board gives all the emergency services in Weld County; he read the
plaque for the record and presented it to Chair Garcia. Commissioner Kirkmeyer mentioned it would
good to have a link to the Barnyard Safety Buddies on the Discover Weld County website and said her
three-year old grandson loves the program and the animals. She thanked them for putting this van to
such great use. Commissioner Freeman concurred, saying he hopes this program can spread to other
agencies. Commissioner Conway said what they've created is really inspiring. Commissioner
Rademacher said Mountain View has always been on the cutting edge.
e PUBLIC INPUT: No public input was given.
e COMMISSIONER COORDINATOR REPORTS: Commissioner Kirkmeyer reported on attending,
with Commissioner Conway, the Town of Evans recognition and appreciation event for individuals,
corporations and government agencies who helped them during the recent flood and read the plaque
presented to the Board into the record. She said they reviewed the flood and recovery, and then Town
Manager Aden Hogan and Mayor Lyle Achziger talked about how valuable the County sponsored
FEMA training turned out to be, as well as having an open line of communication with the Board.
Jennifer Finch, Public Information Officer, was also recognized for keeping the whole County updated
via the website and Facebook page, as was Roy Rudisill, Director of the Office of Emergency
Management. e Commissioner Conway mentioned the Board's decision to create a new office of
Emergency Management and an Emergency Operations Center and showed a line graph, entered into
the record as Exhibit "A", showing the road work and recovery pro ress on the County's 160 impacted
roads from September 15, 2013 (the Sunday the rain stopped). ri Commissioner Freeman read a
letter addressed to Toby Taylor from FEMA, entered into the record as Exhibit "B", thanking the County
for its support. Chair Garcia reported on a meeting with the Sheriff to discuss issues such as
'Coordination', public safety, and criminal justice. Friday he represented the Board in the "We the
People Hearings", a mock hearing/competition designed for high school students. ItEi Commissioner
Kirkmeyer reported on new methane regulations announced by the Governor's Office, and said
although she is generally in support of them, she finds it disconcerting that Weld County was excluded
from the discussion of these regulations, even though it has 80 percent of oil and gas production in the
state.
BIDS:
Fi 1) APPROVE BID #61300167, INMATE SUPPLIES - SHERIFF'S OFFICE: Trevor Jiricek,
Director of General Services, reported the Sheriffs Office needs more time to determine quality, etc. for
this bid's 28 items and, therefore, requested a continuation until December 9, 2013. Commissioner
Kirkmeyer moved to continue this matter until December 9, 2013, at 9:00 a.m. The motion was
seconded by Commissioner Conway, and it carried unanimously.
.El 2) APPROVE BID #61300188, COPIER (80-100 PAGES PER MINUTE) - PRINT SHOP:
Mr. Jiricek reported the print shop staff has also requested a continuance of time to test the machines
and explore electrical limitations in the building. Commissioner Freeman moved to continue this matter
until December 9, 2013, at 9:00 a.m. The motion was seconded by Commissioner Rademacher, and it
carried unanimously.

NEW BUSINESS:
F 1) CONSIDER BOARD CERTIFICATION OF NOVEMBER 5, 2013, COORDINATED GENERAL
ELECTION: Bruce Barker, County Attorney, said this certifies the results of the recent election.
Commissioner Kirkmeyer moved to approve said certification. The motion was seconded by
Commissioner Conway, and it carried unanimously.
F 2) CONSIDER ACCEPTANCE OF DONATION OF STRYKER POWER COT TO WELD
COUNTY CORONER, BY NORTH COLORADO MEDICAL CENTER INC. BOARD: Dave Bressler,
Chief of Ambulance Services for NCMC, expressed his deep appreciation to the Weld County Public
Works crews for their teamwork during the flood in getting ambulances to areas that were cut off,
mitigating hazards, and participating directly in rescues, and it is unfortunate they went largely
unheralded by local media. He also said the Emergency Operations Center has never worked better in
the 35 years of his experience. Mr. Bressler said due to half -million in grant funds received by NCMC
last year, NCMC is updating and replacing their ambulance technology, so following a precedent set by
the County, decided to give these cots, worth up to $20,000, to coordinating agencies. Commissioner
Conway said this has been a problem in the Coroner's Office for some time and noted Mr. Ward's thank
you letter mentioned that a body may need to be moved up to seven (7) times. Commissioner
Rademacher thanked NCMC as well, saying these cots are of huge benefit to staff by preventing back
injuries. Commissioner Kirkmeyer said they also add dignity with the handlin of human remains, and
expressed appreciation for the County's 40 year relationship with NCMC. El Mark Ward, County
Coroner, expressed his department's gratitude to NCMC and their Board for the power cot and their
close working relationship; his letter was entered to the record. Commissioner Kirkmeyer moved to
approve said donation and authorize the Chair to sign. The motion was seconded by Commissioner
Conway, and it carried unanimously.
F 3) CONSIDER TEMPORARY CLOSURE OF CR 38 BETWEEN CRS 39 AND 43: Janet Carter,
Department of Public Works, reviewed the provisions of a closure for a bridge replacement.
Commissioner Rademacher moved to approve said temporary road closure. The motion was seconded
by Commissioner Freeman, and it carried unanimously.
F 4) CONSIDER CERTIFICATION OF WEED ENFORCEMENT LIEN — MICHAEL LAXAMANA:
Tina Booton, Pest and Weed Division, requested the certification of a weed enforcement bill in the
amount of $242.00, which will appear on Mr. Laxamana's property tax notice in January. She noted the
landowner lives outside Weld County and was given more than adequate notice. Commissioner
Rademacher moved to approve said certification. The motion, which was seconded by Commissioner
Kirkmeyer, carried unanimously. Commissioner Kirkmeyer also thanked Ms. Booten for her hard work
and coordinating flood debris removal for Weld County citizens.
F 5) CONSIDER CONSENT TO ASSIGNMENT OF TEMPORARY CONSTRUCTION EASEMENT
FOR RECONSTRUCTION OF A PIPELINE FROM ROCKY MOUNTAIN PIPELINE SYSTEM, LLC, TO
MAGELLAN PIPELINE GP, LLC, AUTHORIZE CHAIR TO SIGN, AND ACCEPT REPLACEMENT
COLLATERAL: Bruce Barker, County Attorney, said on October 10, 2013, the Board entered this
agreement with collateral of $1.5 million to cover repairs to a flood damaged pipeline under the
St. Vrain river, and Rocky Mountain is now selling this pipeline to Magellan. Commissioner Freeman
moved to approve said consent to assignment, authorize the Chair to sign, release the bond and accept
replacement collateral. Seconded by Commissioner Conway, the motion carried unanimously.

RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
Consent Agenda. No Ordinances were approved.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Acting Clerk to the Board.
There being no further business, this meeting was adjourned at 10:01 a.m.

I want to personally thank you for your outstanding coordination and support in allowing FEMA
to set-up a Branch Office at 918 10th Street in Greeley. By allowing us to establish an office in
Greeley, we have been able to respond more quickly to the needs of disaster Survivors and
communities throughout Weld County in a more timely and efficient manner. Your help in
providing a comfortable and consistent space for the FEMA teams to reach out to and assist the
citizens and municipalities of Weld County has gone a long way to enabling us to explain,
answer questions, and generally support disaster Survivors within the communities. Your
support to the whole community partnership has allowed the FEMA team to support Weld
County efficiently and effectively in a comfortable environment.
We are fortunate to have you and the Weld County Commissioners as full team partners and your
dedication is much appreciated by the Federal Emergency Management Agency as well as the
citizens of Weld County who have been affected by this most recent disaster. Thank you for your
