Attached for review is our updated USR13-0023 Plat and comment response memorandum addressing the conditions of
approval prior to recording the plat. Also attached for reference is a copy of our completed CDL&E Oil and Public Safety
LP -Gas Installation Application. A copy of the application is in response to condition 1(B) and will be submitted to the
Colorado Division of Oil and Public Safety concurrently with applying for a building permit for the tank foundations.
In regard to your previous email requesting clarification on the trailer to be located on -site, we are proposing a mobile
8'x20' conex office trailer that is a temporary block and tie. Please let me know if you have any additional questions.

SUBJECT: Use by Special Review USR13-0023 Front Range Polar Gas, LLC
Response to Land Use Application Conditions of Approval
Following is our response to the Conditions of Approval outlined in the draft Land Use Application Summary
Sheet received July 3, 2013 for the Front Range Polar Gas storage facility near Briggsdale, CO.
CONDITIONS OF APPROVAL:
1. Prior to recording the plat:
A. The applicant shall submit a lighting plan for review and approval by the Department of
Planning Services. (Department of Planning Services)
Response: There will not be any lighting for the site.
B. Evidence of an application submitted to the Colorado Department of Labor and
Employment Division (CDL&E), Oil and Public Safety in accordance with the Liquefied
Petroleum Gas (LPG) rule 7 ccr 1101-15 shall be submitted to Environmental Health
Services, Weld County Department of Public Health & Environment. Alternately, the
applicant can provide evidence from the CDL&E, Oil and Public Safety Section that they
are not subject to these requirements. (Department of Public Health and Environment)
Response: The CDL&E, Oil and Public Safety LP -Gas installation Application has been
completed for Polar Gas — Front Range, LLC USR13-0023. The completed application,
including plot plan is attached for your reference. This application will be submitted to
the Colorado Division of Oil and Public Safety concurrently with applying for a building
permit with the Weld County Building Department.
C. The applicant shall submit evidence of an Aboveground Storage Tank permit from the
Colorado Department of Labor and Employment (CDL&E), Oil Inspection Section for any
aboveground storage tanks located on the site. Alternately, the applicant can provide
evidence from the CDL&E, Oil Inspection Section that they are not subject to these
requirements. (Department of Public Health and Environment)
Response: An aboveground storage tank permit from the Colorado Department of Labor
and Employment, Division of Oil and Public Safety is not required for USR13-0023.
Propane storage tanks are excluded from CDL&E, Division of Oil and Public Safety
aboveground storage tank registration requirements per Section 3-1(b)(5) of the Division
of Oil and Public Safety Storage Tank Regulations.

E. The plat shall be amended to delineate the following:
1. All sheets of the plat shall be labeled USR13-0023 (Department of Planning
Services)
Response: All sheets are labeled USR13-0023.
2. The attached Development Standards. (Department of Planning Services)
Response: The Development Standards included with the Staff Summary have been
added to Sheet 1 of the USR Plat.
3. The plat shall be prepared in accordance with Section 23-2-260.D of the Weld
County Code. (Department of Planning Services)
Response: The USR plat has been prepared in accordance with Section 23-2-260.D of
the Weld County Code.
4. The applicant shall delineate the trash collection areas. Section 23-3-350.H of
the Weld County Code addresses the issue of trash collection areas. Areas used
for storage or trash collection shall be screened from adjacent properties and
public rights -of -way. These areas shall be designed and used in a manner that
will prevent trash from being scattered by wind or animals. (Department of

Response: A small dumpster is to be situated within the chain link fenced area,
behind the conex office trailer and portable toilet, as shown on the revised plat. The
dumpster is to be serviced by Waste Chasers out of Eaton, CO as needed.
5. County Road 77 is designated on the Weld County Road Classification Plan as an
Arterial road, which requires 140 feet of right-of-way at full buildout. There is
presently 100 -feet of right-of-way. A total of 70 -feet from the centerline of
County Road 77 shall be indicated on the plat as "Edge of Future Right -of -Way".
The applicant shall verify and delineate on the plat the existing right-of-way and
the documents creating the right-of-way. All setbacks shall be measured from
the edge of future right-of-way. If the right-of-way cannot be verified, it shall be
dedicated. This road is maintained by Weld County. (Department of Public
Works)
Response: Setbacks for the site have been measured from the future 140 ft wide
right-of-way.
6. The plat shall delineate the approved Lighting Plan. (Department of Planning
services)
Response: As mentioned above, there will not be any lighting for the site.
7. Show the approved accesses on the Plat and label with the approved access
permit numbers (will be provided). (Department of Planning Services)

Response: The approved access permit number is labeled on the revised plat.
2. Upon completion of Condition of Approval #1 above, the applicant shall submit two (2) paper
copies or one (1) electronic copy (.pdf) of the plat for preliminary approval to the Weld County
Department of Planning Services. Upon approval of the plat the applicant shall submit a Mylar
plat along with all other documentation required as Conditions of Approval. The Mylar plat shall
be recorded in the office of the Weld County Clerk and Recorder by the Department of Planning
Services. The plat shall be prepared in accordance with the requirements of Section 23-2-260.D
of the Weld County Code. The Mylar plat and additional requirements shall be submitted within
one hundred twenty (120) days from the date of the Board of County Commissioners
Resolution. The applicant shall be responsible for paying the recording fee. (Department of
Planning Services)
Response: Noted.
3. In accordance with Weld County Code Ordinance #2012-3, approved April 30, 2012, should the
plat not be recorded within the required one hundred twenty (120) days from the date of the
Board of County Commissioners Resolution, a $50.00 recording continuance charge shall added
for each additional three (3) month period. (Department of Planning Services)
Response: Noted.
4. The Department of Planning Services respectfully requests a digital copy of this Use by Special
Review, as appropriate. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation);
acceptable GIS formats are ArcView shapefiles or ArcGIS Personal GeoDataBase (MDB). The
preferred format for Images is .tif (Group 4). (Group 6 is not acceptable). This digital file may be

Response: A copy of this USR application, in .dwg format, will be sent to the email address
mentioned.
5. Prior to Operation:
A. If more than 1 acre is to be disturbed, a We'd County grading permit will be required prior to the
start of construction. (Department of Public Works)
Response: The area to be disturbed is greater than 1 acre and a W.C. grading permit application will
be prepared and submitted for approval prior to construction.
6. The Use by Special Review activity shall not occur, nor shall any building or electrical permits be
issued on the property, until the Use by Special Review plat is ready to be recorded in the office
of the Weld County Clerk and Recorder. (Department of Planning Services)

I understand your uncertainty because I had the same questions for my Client. Per my discussion with Nathan Reed, all
trucks entering the site are equipped with their own lightening for loading/unloading propane. Also, all gages on the
tanks are backlit so they are visible in the dark.

Just a question on one of your responses. No on -site lighting even though the hours are up to 24/7 daily and your
heaviest business will be in the winter time when it gets dark earlier? That seems a bit strange to me.
