RE: RECORDED EXEMPTION NO. 265 - DOUGLAS G. HOWARD.
WHEREAS , the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public meeting held
on the 27th day of June, 1977 , in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that a certain
parcel of land, being the property of Douglas G. Howard located
21 miles east of 1st Avenue on the east side of Greeley, Colorado,
80631, more particularly described as follows :
LEGAL DESCRIPTION LOTS A and B
A parcel of land located in the Southeast One-Quarter (SEa) of Sec-
tion 11, Township 5 North, Range 65 West of the 6th Principal Meri-
dian, Weld County, Colorado, being more particularly described as
follows:
Beginning at the South Quarter Corner (Sa Cor) of said Section 11
and considering the west line of the Southeast One-Quarter (SE') of
said Section 11 to bear North 00°12'41" Fast with all other bearings
contained herein being relative thereto;
Thence North 00°12'41" East along said West line, 1330.59 feet;
Thence South 89°32'52" East, 1975.76 feet;
'thence South 29°25'27" West, 1289.81 feet;
Thence South 01°51'24" West, 211.29 feet to the Southeast Corner

does not come within the purview of the definition of the terms
"subdivision" and "subdivided land" as set forth in Section 30-
28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado desires to exempt this particular division of land from
the definition of "subdivision" and "subdivided land" pursuant to
its authority under Section 30-28-101 (10) (d) , CRS 1973 as
amended, and Section 2-la (3) of the Weld County Subdivision Reg-
ulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove de-
scribed parcel of land owned by Douglas G. Howard, be exempt from
the definition of the terms, "subdivision" and "subdivided land"
pursuant to its authority under Section 30-28-101 (10) (d) , CRS
1973, as amended, and Section 2-1A(3) of the Weld County Sub-
division Regulations.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 27th day of
June, A.D. , 1977.
The above and foregoing Resolution was read into the record
and signed on the 6th day of July, A.D. , 1977.

RE: Recorded Exemption #265
Dear Commissioners :
The attached application, plat, and related items are in reference to
a request by Douglas Howard for a recorded exemption. The parcel of
land in question is described as Pt. of the SE* of Section 11, T5N,
R65W of the 6th p.m. , Weld County, Colorado
Said property is located 2z miles east of 1st Avenue on the east side
of Greeley. The subject property contains 49.402 acres of Class III
and IV irrigated soils. The request is to split the property into
parcels of 8.480 acres and 40. 922 acres. As indicated in a letter
submitted by Mr. Howard, his desire is to retain the 8 .480 acre parcel
with the existing improvements and to convey the cropland portion of
his farm.
Based upon the information submitted and the adopted policies in the
county, the Planning Commission staff recommends the request be approved
for the following reasons :
1. The City of Greeley Planning Commission has indicated the request
to split complies with their Comprehensive Plan and recommends the
recorded exemption be approved.
2. The proposed split conforms with the intent clause of the recorded
exemption procedure (Section 9. 2 of the Weld County Subdivision
Regulations) , the intent clause of the Agricultural District
(Section 3 . 3(A) of the Weld County Zoning Resolution) , and the
Weld County Comprehensive Plan since the use would be compatible
with the surrounding agricultural uses.

Dear Sirs :
We wish to make application to you for approval of our pro-
posed plan to sell the cropland portion of our farm. We
wish only to keep the building site , corrals , and small pas-
ture .
We wish to sell the cropland as a farm with permission for
construction of one home .
Our purpose in making this request is as follows . We plan
to make this our permanent home and have improved the build-
ings accordingly over the past two years . We do not farm
for a livlihood and wish to sell the cropland to help us pay
for our parcel and improvements .

V. REFERRAL FROM THE COUNTY: RECORDED EXEMPTION
LOCATION: County Road 1158 , Approximately One Mile East
of Linn Grove Cemetary
The applicants , Douglas and Sandra Howard (3226 East 18th
Street) , desire to split off a 40 . 9 acre parcel of cropland
from their total property of 49 . 4 acres . The remaining 8 . 4
acre parcel is improved with corrals and pasture land . The
applicants request a permit to build a house on the 8-acre
parcel .
Darryl Alleman, Water and Sewer Department , commented that
the proposed Delta sewage treatment plant will be located
in the immediate area.
•
Mr. Given, Current Planner, noted that the property may be
located in an area of mineable gravel deposits . The site is
not located in the flood plain . The area is designated in
the Comprehensive Plan for development in 1990- 2010 . Build-
ing lots should be a miniimuin of 10 acres .

LOCATION: County Road 66 , West of County Road 41 (1%
Miles North of Greeley)
Moro Farms , Inc. is requesting a recorded exemption for the pur-
pose of providing and remodeling a house for an operator of the
farm. John Given, Current Planner, indicated the planning staff
had no concerns regarding this request .
Commissioner Keirnes moved the Planning Commission recommend
approval of the recorded exemption to the County. The motion
was seconded by Commissioner Mathews and carried unanimously.
IX. REFERRAL FROM COUNTY: RECORDED EXEMPTION
LOCATION: Weld County Road 58 and County Road 45%
East of Linn Grove Cemetary
The applicants , Douglas and Sandra Howard, propose to split off
a 40 . 9 acre parcel from their total property of 49 . 4 acres .
They plan to build a house on the 8 . 5 parcel and sell the larger
parcel .
Commissioner Keirnes moved that the Planning Commission recommend
approval of the recorded exemption to the County. The motion was
seconded by Commissioner Roeth and carried unanimously.
