RE: APPROVAL OF SUBDIVISION EXEMPTION NO. 79 - HAROLD ELAM
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
r' Colorado has reviewed the request of Harold Elam for an exemption
from the definition of "subdivision" and "subdivided land" in
Section 30-29-101 (10) , CRS 1973, as amended and Section 2-1 of
the Weld County Subdivision Regulations , and
WHEREAS, the Board of County Commissioners finds that
Harold Elam is the owner of a parcel of land in Part of the
Southwest Quarter of Section 21, Township 5 North, Range 66 West
of the 6th P.M. , Weld County, Colorado. Mr. Elam desires to
enlarge the existing one-acre parcel of land by adding a one and
one-half acre parcel of land. The resulting legal descripticn of
said tract is as follows :
Part of the Southeast Quarter of the Southwest Quarter
of Section 21, Township 5 North, Range 65 West of the
6th P.M. , County of Weld, State of Colorado, being more
particularly described as follows:
Beginning at the South Quarter Corner of said Section
21, and considering the South line of the Southeast
Quarter of said Section 21 as bearing North 89°57'01"
Fast, with all other bearings contained herein relative
thereto;
Thence South 89°45'40" West, 133.58 feet to the True
Point of Beginning;
Thence North 00°50'09" Fast, 310.50 feet;
Thence South 89°45'40" West, 400.00 feet;
Thence South 00°50'09" West, 310.50 feet;
Thence North 89°45'40" Fact, 400.00 feet to the True
Point of Beginning.
Said described parcel of land contains 2.851 acres, more
or less, and is subject to any rights-of-way or other
easements as recorded by instruments of record or as
now existing on said described parcel of land.
The subdivision exemption does not create any new parcels but
simply changes the existing property lines, and
WHEREAS, the Board of County Commissioners has considered
the recommendation of the Department of Planning Services in this

matter and has reviewed the information submitted by the applicant.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis-
sioners of Weld County, Colorado that the aforementioned tract of
land owned by the applicant be, and hereby is, declared to be
exempt from the definition "subdividion" and "subdivided land"
as set forth in Section 30-29-101 (10) , CRS 1973, as amended, and
in Section 2-1 of the Weld County Subdivision Regulations , and
further finds that said tract shall be considered a single lot.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 21st day of
February, A.D. , 1979.

Subdivision Exemption # 79
Applicant: Harold Elam
The owners of the following described property have requested an
exemption from Section 2-1 of the Weld County Subdivision Regu-
lations adopted August 30, 1972, which defines the term subdivi-
sion:
Pt . SWi Section 21 , T5N, R65W
The Planning Department has reviewed this request and recommends
that the request be approved for the following reasons:

COMMENTS:
1. Mr. Elam has purchased an additional 1-1/2 acres to enlarge an
existing 1 acre parcel .
2 . Mr. Elam requires the additional land to accommodate equipment and
to add existing corrals and outbuildings.
3. No new parcels are created.
4. The subdivision exemption will simply change existing property lines.
5. It should be noted that said parcel lies in the 100-year floodplain
of the South Platte River, according to Panel #080266-0639 of the
Preliminary Flood Insurance Rate Maps dated October 31, 1978.
However, the improvements on the parcel already exist and the pro-
posed floodplain regulations govern only future improvements.
