RE: ACTION OF THE BOARD CONCERNING REQUEST FOR ADDITIONAL EXTENSION OF
TIME TO COMPLETE CONDITIONS OF APPROVAL FOR CHANGE OF ZONE, PZ-1125 -
PIONEER COMMUNITIES, INC. / H.P. FARMS, LLC
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on January 9, 2008, by Resolution #2008-0050, the Board approved the
application of Pioneer Communities, Inc., and H.P. Farms, LLC, 4643 South Ulster Street,
Suite 1300, Denver, Colorado 80237, requesting Change of Zone, PZ-1125, from the
A (Agricultural) Zone District to the PUD (Planned Unit Development) Zone District for a maximum of
9,455 residential dwelling units, commercial uses up to 200,000 square feet, five (5) elementary
schools, two (2) middle schools, two (2) high schools, twelve (12) local and community parks,
wastewater and water storage areas, and various agricultural and open space uses on a total of
approximately 5,073 acres, for a parcel of land located on the following described real estate, to -wit:
Parts of Sections 4, 5, 7, 8, 9, 17, and 18, Township 2
North, and Section 32, Township 3 North, Range 64
West; and Sections 11, 12, 13, 14, and 15,
Township 2 North, Range 65 West of the 6th P.M.,
Weld County, Colorado
WHEREAS, on February 14, 2011, the Board determined that a one (1) year extension from
the date of approval of Resolution #2008-0050 shall be approved, with said Change of Zone plat to
be recorded no later than January 9, 2012; that a recording continuance charge, in the amount of
$550.00, be assessed, in accordance with Condition of Approval #1.X of Resolution #2008-0050;
and that if the applicant determines it cannot record the Change of Zone plat by January 9, 2012, it
shall make a request to the Department of Planning Services, in writing, for additional time, with
such request being made at least 30 days prior to January 9, 2012, and such request will
subsequently be presented to the Board of County Commissioners, and
WHEREAS, on March 14, 2012, the Board of County Commissioners determined that a
one (1) year extension shall be approved with quarterly reports to be submitted to the Department of
Planning Services, with said Change of Zone plat to be recorded no later than January 9, 2013; that
a recording continuance charge, in the amount of $550.00, be assessed, in accordance with
Condition of Approval #1.X of Resolution #2008-0050; that if the applicant determined it cannot
record the Change of Zone plat by January 9, 2013, it shall make a request to the Department of
Planning Services, in writing, for additional time, with such request being made at least 30 days prior
to January 9, 2013, and such request will subsequently be presented to the Board of County
Commissioners; and that the applicant submit quarterly progress reports to the Department of
Planning Services, and
WHEREAS, on May 29, 2013, the Board deemed it advisable to grant an extension of time
until July 10, 2013, to allow Planning Services staff adequate time to review the submitted plat to
complete outstanding Conditions of Approval for Change of Zone, PZ-1125, and

WHEREAS, on July 10, 2013, the Board of County Commissioners heard all the testimony
and statements of the Department of Planning Services, and, having been fully informed, hereby
finds all of the outstanding issues to be addressed.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that all of the Conditions of Approval for Change of Zone, PZ-1125, have been
addressed, the plat is ready to be recorded, and the matter of an additional extension of time, be,
and hereby is, dismissed.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 10th day of July, A.D., 2013.
