A Use by Special Review permit for a natural gas compressor station.
The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process.
COMMENTS:
CR 61 is a local gravel road and requires a 60 -foot right-of-way at full build out. There is presently a 60 -
foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the
Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line.
An access permit has been approved for the access to the site (AP13-00101). An access easement
provides access from the site to CR 61. Please show and label the access easement on the plat.
The traffic information provided with the submittal states that the site will be unmanned and will be visited
by one employee per day and one semi per week.
Access improvements are required and shall include 60ft radii to accommodate turning trucks and double
cattle guards across the access to prevent the tracking of mud onto the County maintained gravel
roadway.
A right of way permit is required for any work within the County right of way. A special transport permit is
required for over length, width, height, or weight vehicles. Contact Permitting/Inspection agent, Amy

A water quality design was submitted that exceeds the Weld County Criteria. In discussions with the
applicant this is in order for the operator to check stormwater runoff for contaminants before it leaves the
site. Please show that the release from the pond does not exceed the 5 year historic runoff rate for the
property or provide written agreement from the neighboring property owner to accept a higher flow rate.
The pond must be emptied within 72 hours to comply with State regulations.
An Improvements Agreement between the Applicant and the County will be required for this project. It will
detail the approved haul route(s), any onsite and offsite requirements, and a maintenance agreement for
the haul routes. Road maintenance after construction is not required for this site due to the minimal traffic
stated in the application.
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA).
REQUIREMENTS:
1. Prior to recording the plat:

1. County Road 61 is designated on the Weld County Road Classification Plan as a
local roadway, which requires 60 feet of right-of-way at full build out. This road is
maintained by Weld County.
2. Show the approved access on the Plat and label with the approved access permit
number.
3. The applicant shall indicate specifically on the plat the type of access easement and
indicate whether it is dedicated, private, or deeded.
4. Show and label the tracking control and turning radius at the site access.
5. Delineate the water quality feature(s) on the plat and label as "Water Quality Feature,
No Build/Storage Area".
B. An accepted water quality depression is required for this site.
C. The applicant shall enter into an Improvements Agreement According to the Policy Regarding
Collateral for Improvements and post adequate collateral for all transportation (access drive,
parking areas, et cetera) and non -transportation (fencing, screening, drainage, et cetera).
The agreement and form of collateral shall be reviewed by County Staff and accepted by the
Board of County Commissioners prior to recording the USR plat. Road maintenance
requirements including dust control, and damage repairs for improvements will be a part of
the agreement. Road maintenance agreement will be required for construction only.
2. Prior to Construction:
A. In the event that 1 or more acres are disturbed during the construction and development of
this site, the applicant shall obtain a stormwater discharge permit from the Water Quality
Control Division of the Colorado Department of Public Health and Environment.
B. If more than 1 acre is to be disturbed, a grading permit will be required prior to the start of
construction. The grading permit application must contain: an erosion and sediment control
plan, a grading plan, installation details of all BMPs to be utilized, typical installation and
maintenance notes for all BMPs to be utilized, and a copy of the approved CDPHE
stormwater permit.
3. Place the following notes on the plat
1. Should noxious weeds exist on the property or become established as a result of the proposed
development the applicant/landowner shall be responsible for controlling the noxious weeds,
pursuant to Chapter 15, Articles I and II of the Weld County Code.
2. Off-street parking spaces including the access drive shall be surfaced with gravel, asphalt,
concrete, recycled asphalt or recycled concrete and shall be graded to prevent drainage
problems.
3. The historical flow patterns and runoff amounts will be maintained on site in such a manner that it
will reasonably preserve the natural character of the area and prevent property damage of the
type generally attributed to run-off rate and velocity increases, diversions, concentration and/or
unplanned ponding of storm run-off.
4. The applicant must take into consideration storm water quality and provide accordingly for best
management practices.
5. Weld County will not maintain on -site drainage related areas or medians.

Environmental Health Services has reviewed this proposal for a mineral resource
development facility, for oil and gas support and service, including oil and gas
processing facilities and related equipment, five (5) compressors associated with gas
processing or which compress gas to enter a pipeline for transport to market, and one
(1) seventy-foot in height communications tower in the A (agricultural) zone district
There will not be any full time employees located at the facility. A technician will access
the site once a day for approximately 60 to 90 minutes.
The following section is from Environmental Health Services, Weld County Department
of Public Health & Environment, Septic Policies.
2.2.K Use of portable toilets and bottled water (revised 5/8/12)
Purpose: To define when portable toilets and commercially bottled water are
allowed.
Policy: Bottled water from a commercial source and portable toilets are allowed
in the following circumstances:
1. Temporary or seasonal uses that are utilized 6 months or less per year
(for example recreational facilities, firework stands, farmers markets )
2. Gravel mines
3. 10 or less customers or visitors per day
and/or one of the following:
4. 2 or less full time (40 hour week) employees located on site
5. 4 or less part time (20 hour week) employees located on site
6. employees or contractors that are on site for less than 2 consecutive
hours a day
Note: Records of maintenance and proper disposal for portable toilets shall be retained
on a quarterly basis and available for review by the Weld County Department of Public
Health and Environment. Portable toilets shall be serviced by a cleaner licensed in
Weld County and shall contain hand sanitizers.
As indicated above, it is the policy of this department that portable toilets are allowed
when employees or contractors are on site for less than 2 consecutive hours a day. As
personnel will be on site for a short duration, in accordance with Environmental Health
Services policy the use of portable toilets is allowed.
The waste handling plan stipulates that refuse will be contained and removed by a
contracted company. The plan includes a list of types and quantities of chemicals to be
stored on site. Procedures for cleanup and disposal of spilled hazardous materials will
be included in DCP's Spill Prevention Control and Countermeasure plan (SPCC). The
plan shall be available on site at all times.
On site dust will be controlled by having the access drive and areas within the fenced
boundary graveled. A water truck will be utilized if necessary.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirement be met prior to allowing the plat to be
recorded:
1. The applicant shall submit evidence of an Air Pollution Emission Notice
(A.P.E.N.) and Emissions Permit application from the Air Pollution Control
Division, Colorado Department of Health and Environment to Environmental
Health Services Division of the Weld County Department of Public Health &
Environment. Alternately, the applicant can provide evidence from the APCD that
they are not subject to these requirements.
We recommend that the following requirement be incorporated into the permit as a
condition that must be met one month prior to operation:
1. A signed copy of the Spill Prevention, Control and Countermeasure Plan shall be
provided to Environmental Health Services Division of the Weld County
Department of Public Health & Environment.
We recommend that the following requirements be incorporated into the permit as
development standards.
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater

contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, blowing debris, and other potential nuisance conditions. The
applicant shall operate in accordance with the approved "waste handling plan", at
all times.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
5. Adequate drinking, handwashing and toilet facilities shall be provided for
employees and patrons of the facility, at all times. As employees or contractors
are on site for less than 2 consecutive hours a day portable toilets and bottled
water are acceptable. Records of maintenance and proper disposal for portable
toilets shall be retained on a quarterly basis and available for review by the Weld
County Department of Public Health and Environment. Portable toilets shall be
serviced by a cleaner licensed in Weld County and shall contain hand sanitizers.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in Section 14-9-30 of the Weld County Code, or
with all applicable State noise statutes and/or regulations.
7. In accordance with Colorado Oil and Gas Conservation Commission Rule 604, a
spillage retention berm shall be constructed around the aboveground storage
tanks. The volume retained by the spillage berm should be greater than the
volume of the largest tank inside the berm and sufficient freeboard to contain
precipitation. Alternative protective measures may be allowed provided they
comply with the Colorado Oil and Gas Conservation Commission regulations.
8. The operation shall comply with all applicable rules and policies regulated by the
Colorado Oil and Gas Conservation Commission.
9. The applicant shall comply with all provisions of the State Underground and
Above Ground Storage Tank Regulations.
10. All potentially hazardous chemicals must be handled in a safe manner in
accordance with product labeling and in a manner that minimizes the release of
hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All
chemicals must be stored secure, on an impervious surface, and in accordance

with manufacturer's recommendations.
11.The Spill Prevention, Control and Countermeasure Plan shall be available on
site, at all times.
12. The applicant shall obtain a Colorado Discharge Permit System or CDPS permit
from the Colorado Department of Public Health and Environment (CDPH&E),
Water Quality Control Division, as applicable.
13. The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

After reviewing the application and documents submitted the Building Department has the following comments:
Building permits will be required for the Oil and Gas Support and Service Facility and associated buildings and
equipment. A building permit application must be completed and two complete sets of engineered plans including
engineered foundation plans bearing the wet stamp of a Colorado registered architect or engineer must be submitted.
A geotechnical engineering report performed by a registered State of Colorado engineer shall be required or a open
hole inspection.
Buildings, equipment and structures shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 2012 International Building Code; 2012
International Mechanical Code; 2012 International Plumbing Code: 2012 International Energy Code; 2006
International Fuel Gas Code; 2011 National Electrical Code; 2009 ANSI 117.1 Accessibility Code the 2012
International Plumbing Code and Chapter 29 of the Weld County Code.
A plan review shall be approved and a permit must be issued prior to the start of construction.
