USR Questionnaire — Redtail Gas Plant, Whiting Petroleum Corporation
1. Explain in detail the proposed site use: This property will be used as a gas
processing plant. Gas from surrounding well head pipelines and compressor stations
will be piped to this location. The gas will be processed and sent on to existing 3rd party
gas pipelines. Liquids will be trucked out to sales.
2. Explain how this proposal is consistent with the intent of the Weld County Code,
Chapter 22 of the Comprehensive Plan: With the acknowledgement of the desire to
promote and protect Weld County's agricultural environment, care will be taken to
minimize the impact on the surrounding area per Sec 22-2-10 D. The adjacent county
roads will continue to be maintained at no cost to landowners. No water rights will be
transferred and no irrigation water will be used to service this site therefore causing no
water related changes for the owner. The owner is agreeable to the land use change for
this parcel, Sec 22-2-20 G-2, and it provides supplemental income while allowing the
continuance of a rural lifestyle.
3. Explain how this proposal is consistent with the intent of the Weld County Code,
Chapter 23 (Zoning) and the zone district in which it is located: This gas
processing site falls under the allowable Zoning consideration for Use by Special
Review as Article II, Div 4, (A.) Mineral resource development facilities, (2.) Oil and gas
support and service. In addition, all necessary permits have been and will be obtained
for access, grading, foundations/buildings, etc. and work performed according to Weld
County Codes.
4. What type of uses surrounds the site (explain how the proposed use is consistent
and compatible with surrounding land uses): The land uses surrounding this site
are agricultural therefore a minimal parcel of land will be used for this processing site.
All equipment will be painted to blend with the current landscape.
5. Describe, in detail, the following:
a) Number of people who will use this site: 3-4 people.
b) Number of employees proposed to be employed at this site: 1-2 people,
although it will not be manned 24/7.
c) Hours of operation: 24 hours a day, 7 days a week
d) Type and number of structures to be erected (built) on this site: Structures: 1
Office building and 1 MCC/PDC building. Equipment on this site will be
Compressors, Slug Catcher, Pig Receivers, Membrane Skid, Glycol Skid, Flare
Knock Out, Flare. Air Skid, Coolers/Condensers, Refrig Skid, Process Skids, various
storage tanks, and pumps. Future equipment could include ail of the above. The
Laydown Yard will be used as a place to set equipment and pipe as it arrives to the
site.
e) Type and number of animals, if any, to be on this site: None
f) Kind of vehicles (type, size, weight) that will access this site and how often:
3/4 ton pickup trucks will access the site about 10 times a day and 70' trucks will
access the site about eight times a day.
g) Who will provide fire protection to the site: New Raymer/Stoneham Fire
Protection District 229 Baird St New Raymer
h) Water source on the property (both domestic and irrigation): There will be a
domestic well and no irrigation. We are in the process of applying for a well permit.
There will be bottled water during construction.
i) Sewage disposal system on the property (existing and proposed): Sewage
disposal will be a septic system. A septic permit is being applied for. There will be
portable toilets present during construction per OSHA requirements.
j) If storage or warehousing is proposed, what type of items will be stored:
There will be a shop attached to the office building for storing parts.
6. Explain the proposed landscaping for the site. There will be a gravel base around
the site equipment and on the road in/out of the facility. The remaining unused land will
be naturally occurring vegetation.
7. Explain any proposed reclamation procedures when termination of the Use by
Special Review activity occurs: There are no plans to terminate the USR anytime in
the foreseeable future.
8. Explain how the storm water drainage will be handled on the site: We are
submitting a grading plan to show how water will drain from the site.
9. Explain how long it will take to construct this site and when construction and
landscaping is scheduled to begin: Construction will begin when the permit is issued
and should take about 6-7 months to complete. Desired completion is September/
October, 2013.
10. Explain where storage and/or stockpile of wastes will occur on this site: The
drain/oil tanks will be used for over flow in the system and will be emptied on an as
needed basis by an outside source that will be responsible for the proper disposal.
Dumpsters will be present during construction for trash collection. Dumpsters will be
emptied on a weekly basis per contract agreement.

This is a preliminary plan of Waste Handling for the Redtail Gas Plant once it is
operational.
Trash Removal for the office building will be removed by Construction Services
out of Cheyenne. Trash service will be once a month or as needed.
The Waste Water, approximately 100 bbls/month, to be disposed of by Bar -S
Services Inc., 3330 1-80 Frontage Road, Cheyenne, WY 82009. Ph# 307-637-8917.
The water disposal site will be High Sierra Water Service, 61635 WCR 77 Grover,

Re: Whiting Red Tail Gas Plant Site Drainage Narrative
Dear Heidi,
Thank you for taking time last week to discuss this project with me. Since that time, the SWMP
has been completed.
As we discussed, the Red Tail site is 40 acres in size. The plan is to develop 5.66 acres. The
attached grading plan shows the site layout and limits of construction. We have created a pad
to house all piping and equipment. Once graded, the pad will be covered with a geogrid and 9"
of Class 6 ABC.
The proposed pad will have a grade of 1% and slope from North to South. Runoff will be
captured in a ditch located along the southern end of the pad. The ditch will convey the runoff
to a storm water quality pond located to the south of the pad.
The Red Tail Gas Plant site is located to the southwest of the intersection of WCR 127 and WCR
116 in unincorporated Weld County. Red Tail Gas Plant Site is located in the Northeast % of
Section 21, Township 10 North, Range 58 West of the Sixth Principal Meridian, County of Weld,

SUBJECT: POLICY CONCERNING THE EVALUATION OF WELL PERMIT APPLICATIONS FOR
EXEMPT COMMERCIAL USES
In 1972 the legislature established a rebuttable presumption in subsection
37-92-602(3)(b)(II), C.R.S., that wells used solely for household purposes in
a single-family dwelling will not materially injure the vested water rights
of others or any other existing well. This presumption has been used to
approve many permits for "household use" wells appropriating ground water
tributary to overappropriated stream systems.
By including small capacity wells used for drinking and sanitary facilities in
a commercial business in the exemptions of Section 37-92-602(1), C.K.S., the
legislature apparently intended for such wells to be approved under special
limiting conditions, however, the presumptions of subsection
37-92-602(3)(b)(II) do not apply to these well permit applications. Therefore
they must be evaluated pursuant to subsection 37-92-602(3)(6)(I)
In order to assist in the evaluation and provide for approval of certain
limited uses of well permit applications to serve drinking and sanitary
facilities in a commercial business, it shall be the policy of the State
Engineer that if the proposed annual diversion and the consumptive use of
water from the well do not exceed those values of ordinary in-house purposes
inside a single-family dwelling, there shall be a rebuttable presumption that
such uses will not injure other vested water rights or wells. This policy
shall be implemented by applying a rebuttable presumption of non -injury when
the following conditions are met:
1. No other water supply source or system is available to serve the
property. An affidavit by the applicant affirming this situation
must accompany the applications as well as an affidavit from any
entity capable of serving the use that it will not do so.

2. The well must be the only well on the site.
3. The site must have been established prior to June 1, 1972, or must
be exempt from the definition of a subdivision pursuant to Section
30-28-101(10)(c) and (d), C.R.S. For lots in subdivisions approved
after June 1, 1972, the recommendations made in the water supply
review process will be honored. Ground water production will be
limited to the aquifer approved during the review process and will
be restricted to one aquifer only by Conditions of Approval.
4. The pumping rate shall not exceed 15 gallons per minute.
5. The amount of ground water diverted shall not exceed 1/3 acre-foot
annually (108,600 gallons). The applicant must support the
application with evidence that the proposed use will not create a
demand greater than 1/3 acre-foot.
6. The consumptive use of the water shall not exceed 10% of the volume
of ground water diverted. The return flow from the use of the water
must be discharged to the same stream system in a location so as to
not injure any vested water right. An approved septic tank and
non -evaporative leach field is an acceptable discharge method.
Other types of disposal systems must be evaluated to determine the
amount and location of the return flow.
7. The use of the water diverted is limited to drinking and sanitary
facilities only in an individual commercial business. No uses of
water are permitted outside of the building.
8. A totalizing flow meter must be installed on the well. Permanent
annual diversion records must be maintained by the well owner and
submitted to the Division of Water Resources annually.
Exempt commercial wells which do not meet the above criteria will be evaluated
on the basis of material injury.
This policy becomes effective immediately and is essential to reduce the back
log of well permit applications. It shall be modified or revoked only in
writing. 1
