RE: APPROVE AGREEMENT TO MINE WITHIN 200 FEET OF PERMANENT MANMADE
STRUCTURES AND AUTHORIZE CHAIR TO SIGN - AMERICAN CIVIL
CONSTRUCTORS, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Agreement to Mine within 200 Feet of
Permanent Manmade Structures between the County of Weld, State of Colorado, by and through
the Board of County Commissioners of Weld County, and American Civil Constructors, Inc., for
property described below, commencing upon full execution, with terms and conditions being as
stated in said agreement, and
Located in part of Section 21, Township 9 North, Range 66 West of
the 6th P.M., Weld County, Colorado
WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of
which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Agreement to Mine within 200 Feet of Permanent Manmade Structures
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, and American Civil Constructors, Inc., be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign said agreement.

To whom it may Concern,
I apologize for having to send this letter multiple times however this letter has been sent
again intentionally. There was a change made to the section number for the legal
description of the Nietfield Borrow Pit which will be used for the US -85 Bridge
Replacement. Please see the enclosed letter.

RE: Damage Reimbursement Agreement
American Civil Constructors, Inc. - Nietfeld Borrow - East
Weld County, Colorado
To whom it may concern:
American Civil Constructors, Inc., is filing for a Special 111 Permit from the Colorado Mined Land
Reclamation (MLR) permit to extract construction materials from a tract of land located in Part of Section
21, T -9-N, R -66-W, 6th Prime Meridian, Weld County, Colorado.
State MLR law requires the permit applicant to agree to reimburse the owner of any permanent man-made
structures within 200 feet of the mining area for damage done to the structure as a result of the permitted
operation. We believe Weld County owns the structure listed below. American Civil Constructors, Inc.
agrees to reimburse Weld County for any damage done to the structure listed below as a result of the
proposed mining operation. Your acknowledging signature and a notary seal in the spaces provided
below should satisfy the MLR law reimbursement requirement.
Please return this agreement within 30 days of receiving it if at all possible. Enclosed is a stamped
addressed envelope so you can return the executed agreement to us. We have also enclosed a second
copy of this letter that you may keep for your files. Thank you for your cooperation.
